Proclaiming Native Land to be vested in His Majesty under Section 368 of the Native Land Act, 1909, and to be Crown Land.

A PROCLAMATION.

WHEREAS by section three hundred and sixty-eight of the Native Land Act, 1909 (hereinafter referred to as “the said Act”), it is provided, inter alia, that the Crown may purchase any Native land in pursuance of a resolution of the assembled owners passed and confirmed in accordance with Part XVIII of the said Act; and on the resolution being adopted by the Native Land Purchase Board it shall become a contract of purchase as between the Crown and all persons who are the owners of the land; and the Governor-General may, by Proclamation, at any time after the contract of purchase has been so made, declare that the land so purchased is vested in His Majesty the King, and it shall vest accordingly and shall become Crown land:

And whereas resolutions were passed by meetings of assembled owners and duly confirmed by the Waiariki District Maori Land Board, that the land set out in the Schedule hereto be sold to the Crown:

And whereas the Native Land Purchase Board has adopted such resolutions:

Now, therefore, in pursuance and exercise of the power and authority conferred upon me by section three hundred and sixty-eight of the said Act, I, General Sir Charles Fergusson, Baronet, Governor-General of the Dominion of New Zealand, do hereby proclaim and declare that the land set out in the Schedule hereto is vested in His Majesty the King, and under the powers vested in me in that behalf, do hereby proclaim the same to be Crown land.

PUKEHINA A No. 1 Block. Approximate area, 1,270 acres 1 rood 6 perches. Waihi South Survey District.

Amending Regulations under the Kauri-gum Industry Act, 1908.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 21st day of December, 1927.

IN pursuance and exercise of the powers conferred on him by the Kauri-gum Industry Act, 1908, and in pursuance and exercise of every other power enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby amend, in the manner set forth in the Schedule hereto, the regulations under the said Act made on the twentieth day of November, one thousand nine hundred and eleven, and published in the Gazette of the first day of December, one thousand nine hundred and eleven, at page 3576.

REGULATIONS.

GUM-BROKERS’ LICENSES.

  1. EVERY application for a gum-broker’s license shall be made to the Kauri-gum Control Board in the form No. 1 in the Schedule hereto, and shall be accompanied by a license fee of £5.

  2. Every gum-broker’s license shall be in the form No. 2 in the Schedule hereto.

  3. Every application for a renewal of a kauri-gum broker’s license shall be made to the Kauri-gum Control Board in the form No. 3 in the Schedule hereto, and shall be accompanied by the license in respect of which renewal is sought, and also by a license fee equal to the fee payable on the original issue of the license.

  4. If in its discretion the Kauri-gum Control Board declines any application for a gum-brokers’ license or for the renewal of a gum-broker’s license the sum tendered by way of license fee shall, on demand, be returned to the applicant.

  5. The said regulations are hereby amended as follows:—
    (a) By omitting from clause 6 thereof, the word “Commissioner” and by substituting the words “Kauri-gum Control Board.”
    (b) By omitting from form No. 5 in the Schedule thereto the words “Commissioner of Crown Lands” and substituting the words “Kauri-gum Control Board.”
    (c) By omitting from form No. 6 in the Schedule thereto the words “Commissioner of Crown Lands” and substituting the following words:—
    “The Common Seal of the Kauri-gum Control Board was hereto annexed in the presence of—

[Form No. 1.

THE KAURI-GUM INDUSTRY ACT, 1908.

Application for Kauri-gum Brokers’ License.

To the Kauri-gum Control Board,
Auckland.

I, of , do hereby apply for a license to carry on the business of a broker of kauri-gum, and agree to comply with and be bound by the conditions of such license as set out below, and agree that the Kauri-gum Control Board may, on any breach of the said conditions, revoke such license. I enclose herewith the license fee of £5.

The conditions referred to to are:—
(1) The proceeds of all gum sold by any holder of a Kauri-gum Broker’s License shall be paid by him to a trust account to be opened by him for that purpose with his banker, and account sales of gum sold shall be rendered and proceeds paid to the customer or his appointee within thirty days from the date of sale.
(2) The licensee will, upon the written request of the customer, give written intimation to the customer of the person to whom the gum of such customer has been sold.

THE KAURI-GUM INDUSTRY ACT, 1908.

Gum-broker’s License.

[NOT TRANSFERABLE.]

of , having paid the sum of five pounds, and having made application on the prescribed form, subject to the conditions below set out, is hereby licensed to carry on the business of a kauri-gum broker, subject to the provisions of the above-named Act and the conditions hereon endorsed, and the regulations for the time being in force under the said Act.

This license continues in force until the 31st day of December next, unless the same be previously revoked.

CONDITIONS REFERRED TO IN THIS LICENSE.

(1) The proceeds of all gum sold by any holder of a Kauri-gum Broker’s License shall be paid by him to a trust account to be opened by him for that purpose with his banker, and account sales of gum sold shall be rendered and proceeds paid to the customer or his appointee within thirty days from the date of sale.
