Prescribing the Conditions under which the New Zealand Dairy-produce Control Board may give Notice of Intention to assume Limited Control of any Dairy-produce.—Notice No. Ag. 2666.

ORDER IN COUNCIL.
At the Government House at Wellington, this 29th day of August, 1927.
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
WHEREAS by Order in Council made under the Dairy-produce Export Control Act, 1923 (hereinafter referred to as “the said Act”), on the sixth day of October, one thousand nine hundred and twenty-four, and published in the Gazette of the ninth day of October, one thousand nine hundred and twenty-four, at page 2279, conditions were prescribed in accordance with which notice by the New Zealand Dairy-produce Control Board should be given of its intention to assume control in respect of the insurance on any dairy-produce exported from New Zealand :
And whereas by Order in Council made under the said Act, on the seventh day of June, one thousand nine hundred and twenty-six, and published in the Gazette on the eighth day of June, one thousand nine hundred and twenty-six, at page 1585, conditions were prescribed in accordance with which notice should be given by the said Board of its intention to assume absolute control of any dairy-produce for export from New Zealand :
And whereas it is expedient that conditions should be prescribed in accordance with which notice shall be given by the said Board of its intention to assume limited control of any dairy-produce for export from New Zealand otherwise than control in respect of the insurance of any dairy-produce :
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers conferred upon him by the said Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby prescribe that notice by the New Zealand Dairy-produce Control Board of its intention to assume limited control of any dairy-produce for export from New Zealand, otherwise than control in respect of the insurance of any dairy-produce, shall be given in accordance with the following conditions :—

Such notice shall be given either by service or publication as hereinafter provided not less than twenty-one days before it becomes operative. If such notice is given by publication as hereinafter provided, the said period of twenty-one days shall be calculated from the date of the first publication of such notice in any newspaper as hereinafter provided.

Where notice is given by publication in a newspaper or newspapers, such publication shall be made once in the New Zealand Gazette, and in at least two newspapers published in each land district and on at least two days in each newspaper.

Where a notice is to be served on either an owner of any dairy-produce or on any person having possession thereof, such notice shall be forwarded by “registered post.”
