Regulations under the Orchard and Garden Diseases Act, 1908,
in regard to the Importation of Potatoes into New Zealand.—

ORDER IN COUNCIL.
At the Government House at Wellington, this 4th day of July, 1927.
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
WHEREAS by Order in Council dated the twenty-third day of August, one thousand nine hundred and fifteen, and published in the Gazette on the second day of September, one thousand nine hundred and fifteen, at page 3100, regulations (hereinafter referred to as “the said regulations”) were made under the Orchard and Garden Diseases Act, 1908 (hereinafter referred to as “the said Act”), for the prevention of the introduction of diseases affecting fruit and plants:
And whereas it is deemed expedient to revoke the said regulations in so far as they relate to the importation of potatoes, and to make other provision in lieu thereof:
And whereas in the opinion of the Governor-General the unrestricted introduction of potatoes into New Zealand is likely to introduce disease into New Zealand:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred upon him by the said Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby revoke the said regulations in so far as they relate to the importation of potatoes, and doth hereby declare that the introduction into New Zealand of potatoes is absolutely prohibited except when such introduction takes place in accordance with the following regulations, and doth further declare that such revocation shall take effect and the regulations hereby made shall come into force on the day of publication hereof in the Gazette: Provided always that with respect to the introduction of any potatoes that may then be in transit by sea to the Dominion the said regulations shall continue to apply and the following regulations shall not apply.
REGULATIONS.
- PRELIMINARY.
THESE regulations may be cited as the Importation of Potatoes Regulations, 1927.
- INTERPRETATION.
In these regulations, if not inconsistent with the context,---
“Disease” means any disease as defined in the said Act, and includes any disease declared to be a disease within the meaning of that Act:
“Director” means the Director for the time being of the Horticulture Division of the Department of Agriculture:
“Inspector” means an Inspector under the said Act:
“Owner” of potatoes includes consignee, and also the master of any vessel in which such potatoes have been brought to New Zealand.
- PORTS OF ENTRY.
For the purposes of these regulations the Ports of Auckland, Wellington, Lyttelton, Dunedin, and Bluff are hereby appointed to be the only ports of entry for potatoes for other than seed purposes:
Provided that in the case of direct consignments of such potatoes for any other port than those above mentioned the whole consignment, or any portion thereof, as may be required by the Inspector, shall be actually landed by the owner or person in charge thereof, at the owner’s expense, for examination at a port of entry; and on compliance with the requirements of Regulation 4 hereof, so far as may be applicable, and on a permit being issued by such Inspector, after examination, authorizing their release at the port of destination, such potatoes may be carried to such other port and be there cleared and landed on production of such permit to the local Customs officer.
- ADMISSION OF POTATOES FOR OTHER THAN SEED PURPOSES.
(1) Each consignment of potatoes for other than seed purposes imported into the Dominion must be accompanied by a certificate in the form set out in the First Schedule hereto, signed by a responsible officer of the Department of Agriculture or other responsible Government officer charged with the supervision of matters relating to horticulture of the country in which the potatoes were grown, setting forth that he has examined the potatoes; that they are entirely free from disease; the place at which they were grown; that they were grown on premises known after due investigation not to be infected with disease; and that they are packed in clean new sacks.
(2) On the production of the certificate prescribed in the last preceding clause at the office of an Inspector situate at one of the prescribed ports of entry, such Inspector may,
