Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby prohibit, for the period of one year from the date of this Order in Council, all alienations of the Native lands specified in the Schedule hereto other than alienations in favour of the Crown.

Prescribing the Rate of Interest that may be paid by the Wellington Hospital Board in respect to a Loan of £40,000 authorized to be raised for the Erection of Buildings.

At the Government House at Wellington, this 16th day of May, 1927.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS by section one hundred and fourteen of the Local Bodies’ Loans Act, 1926, it is provided that, notwithstanding anything to the contrary in any Act or in any rule of law, where a local authority or public body has been authorized before the passing of the said Act, or is thereafter authorized to borrow money, whether pursuant to a poll of ratepayers or otherwise howsoever, whether the rate of interest or the term of years of the loan was or was not specified or determined, and such money or part thereof has not been borrowed, the local authority or public body may, with the precedent consent of the Minister of Finance, borrow such money, or such amount thereof as has not been borrowed, at such rate of interest or for such term as may be prescribed by the Governor-General by Order in Council:

And whereas the Wellington Hospital Board has been authorized to borrow the sum of forty thousand pounds for the erection of buildings:

And whereas the Minister of Finance has given his precedent consent as required by the above-recited section one hundred and fourteen, and it is desired that the rate of interest at which the money may be borrowed be not exceeding six per centum per annum:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the power and authority vested in him as aforesaid, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby prescribe that the rate of interest that may be paid by the Wellington Hospital Board in respect of the said sum of forty thousand pounds shall be a rate not exceeding six per centum per annum, and the said Wellington Hospital Board is hereby authorized to borrow the said sum of forty thousand pounds accordingly.

Supplementing and amending Regulations under the Motor-omnibus Traffic Act, 1926, relating to Motor-omnibuses.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred on him by section eighteen of the Motor-omnibus Traffic Act, 1926 (hereinafter referred to as “the said Act”), His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby make the following regulations by way of supplement and amendment to existing regulations made in terms of the said Act, and doth hereby declare that the following regulations shall be read together with and form part of the Motor-omnibus (Constructional) Regulations, 1926, and the Motor-omnibus (Licensing) Regulations, 1926.

REGULATIONS.

  1. THESE regulations may be cited as the Motor-omnibus (Supplementary) Regulations, 1927.

  2. For the purpose of the Motor-omnibus Traffic Act, 1926, an Inspecting Engineer may, at his discretion, make a report that a motor-omnibus is in a fit condition to be licensed as a motor-omnibus, save that certain requirements of Part I of the Motor-omnibus (Constructional) Regulations, 1926, require to be fulfilled, and in such case shall, by his certificate, state such requirements and fix a time limit or limits within which all or each of such requirements shall be complied with.

  3. The licensing authority may thereupon, in pursuance of the said report, issue a license in respect of the motor-omnibus, subject to the condition that the said requirements be fulfilled within the said time limit or limits.

  4. The fact that in the opinion of the Inspecting Engineer the chassis of any motor-omnibus is carrying, or in service is likely to carry, a greater load than it was designed by the makers to carry, may be a ground for refusal by the Inspecting Engineer to make a report that the motor-omnibus may be licensed for the carriage of passengers.

  5. A fresh report shall be obtained from the Inspecting Engineer in terms of section 6 (3) of the said Act before a license for another period is granted in respect of any motor-omnibus that has previously been licensed, whether by the same or any other licensing authority.

  6. Save with the written permission of the Minister of Public Works upon the recommendation of the licensing authority by which the omnibus is licensed, the maximum number of passengers permitted to be carried by any motor-omnibus, in terms of the condition in that behalf to be contained in any license issued in respect of such motor-omnibus, shall be not greater than four-thirds of the number of passengers for which seating-accommodation is provided.

  7. It shall be a condition of every license issued in respect of a motor-omnibus (whether such condition be inserted in the license or not) that no standing passenger shall be allowed to travel on the driver’s platform or forward of an imaginary line drawn at right angles to the length of the omnibus across the back of the driver’s seat and for the full width of the vehicle.

  8. The Motor-omnibus (Constructional) Regulations, 1926, are amended as follows:—

(a) Regulation 28 thereof is amended by adding after “needs” the following words: “provided that any omnibus may, at the discretion of the Inspecting Engineer, by writing under his hand, be exempted for the duration of the current license or such shorter period as may therein be stated, either in whole or in part, from the requirements of this regulation.”

(b) Clause (5) of Regulation 35 thereof is amended by substituting for the words “shall be greater than” the words “shall be not less than.”

(c) Regulation 40 thereof is amended by adding thereto the following additional clause:—

“(5) The chassis shall have a maker’s designed weight-carrying capacity such that the total weight of the body and of any load that the omnibus is, in the opinion of the Inspecting Engineer, likely in service to carry shall be not more than four-thirds of the said designed capacity.”
