“Wharfinger” shall mean the lessee for the time being of any wharf, and also the person appointed by the Council to the charge of any wharf, and authorized by the Council for the time being to receive or collect any dues, and includes any assistant under or assisting him:
“The Council” shall mean the Hokianga County Council.

No dray, cart, or other vehicle shall be allowed to remain on the wharves longer than the time actually occupied in loading or unloading the same, and no such vehicle shall at any time be left upon the said wharves or entrances thereto, unless in charge of a person competent to manage it.

No shells, lime, timber, stones, bricks, iron, or other building or bulky material shall be allowed to remain on the wharves for more than one clear day after being landed, without written permission from the Wharfinger.

Every boatman, carter, or person employed on any wharf shall be under the control and obey the orders of the Wharfinger.

No vessel shall be allowed to be made fast to the wharves by any lines, warps, or chains, but for the purposes of loading or unloading, without written permission from the Wharfinger.

No person shall place any goods in the sheds at the said wharves, or shall remove any goods therefrom, without first informing the Wharfinger of such intended placing of such goods in or removal of such goods from such sheds.

Gunpowder or explosives shall not be landed or stored except with the written permission of the Wharfinger.

No goods shall be allowed on the wharves for any longer time than may be necessary to ship, store, or cart away the same, and any person who shall land or place any goods on any wharf shall place the same as the Wharfinger may direct, and so as to keep all mooring posts or rings free, and all rails and tramways clear, and no person shall sort any timber or pack or repack any goods, nor screen any coal, nor place any loose coal on any wharf.

Goods landed on any wharf must be taken delivery of by the Wharfinger, and he may store any goods upon which dues are not paid within three hours of being landed, or not removed within one hour of sunset.

The master of any vessel berthed at any wharf shall cause the discharge or loading of such vessel to be commenced and continued till completed by working at such hours as the Wharfinger shall direct, provided that such direction shall not be in contravention of any Customs law or regulation.

The master of any vessel shall provide proper tackle for the proper slinging of all goods discharged from his vessel on, to, or laden, or intended to be laden, from any wharf into his vessel, and shall pay for any damage that may be done to the wharf or other property of the Council either from the breakage of slings or from the goods being imperfectly slung.

No person shall allow any goods to remain on any wharf, or in or upon the approaches thereto, or in any store or warehouse in which goods may be placed, for more than twenty-four hours after the same may be placed there, without the permission of the Wharfinger in writing.

It shall not be lawful for any person to remove any goods from any warehouse or wharf until all entries are passed and all dues paid in respect of such goods and a receipt from the Wharfinger for all dues payable be produced to the person in charge of the goods, and the Wharfinger may hold possession of all goods landed on the wharves, or otherwise entrusted to him, until all dues are paid.

It shall be lawful for the Wharfinger, either alone or with other persons authorized by him, to enter any vessel in order to ascertain the dues payable in respect of the vessel, or of goods therein; and no person shall hinder or molest the Wharfinger, or such other persons, or refuse to allow the Wharfinger or such other persons to enter into any vessel.

The master of any vessel shall produce the certificate of registry of his vessel to the Wharfinger on demand, and shall on demand give to the Wharfinger a copy of the bill of lading, freight list, or manifest of the cargo, or other proper account of all goods intended to be unshipped from the vessel, and the name or names of the owner to whom all or any goods in such vessel are intended to be delivered, and also shall give to the Wharfinger notice of the intended time of unshipment or discharge of any goods in such vessel.

The master of every vessel shall, before his vessel is removed from the wharf, cause all dirt or rubbish to be thoroughly cleared from that portion of the said wharf opposite to the berth occupied by such vessel, and shall deposit such dirt or rubbish at such place or places as may be appointed by the Wharfinger.

It shall not be lawful for any person to ship or unship, load or discharge, any goods into, out of, or from any vessel except at such wharves as are now, or shall hereafter from time to time, be declared public wharves and landing-places, without a written permit from the Council.

Every person who shall use any wharf with any vessel shall pay to the Wharfinger for the use thereof as follows, that is to say:—
For every vessel lying alongside any wharf—
(a.) One half-penny per ton per day or part of a day for every ton register up to 100 tons.
(b.) Exceeding 100 tons, one halfpenny per ton per day or part of a day for the first 100 tons and one farthing per ton per day or part of a day for every ton over 100 tons.
- Every person who shall use any wharf for landing goods or whose goods are stored in any shed shall pay to the Wharfinger wharf dues in respect of the landing, storage, receiving, and delivering such goods, as follows, that is to say:—
For all goods (except such as are hereinafter provided for) landed, stored, received, or delivered, at weight or measurement, at the option of Wharfinger, according to shipping usage.

For passengers’ luggage under ½ ton, provided such luggage is removed from the wharf within one hour of being landed, free from landing dues.

The Council will in nowise be responsible for damage or loss by fire, water, theft, vermin, or otherwise, unless such damage or loss is caused through the negligence of the Council or its employees.

If any person fails or refuses or neglects to do anything required in these by-laws to be done, observed, or performed, or in any manner obstructs, impedes, or interferes with the doing of anything enjoined, required, or authorized to be done, or wilfully does anything prohibited by these by-laws, every such person in any case so offending shall be liable to a penalty not exceeding £20.

Nothing contained in these by-laws shall be deemed to apply to any ship, boat, or other property of His Majesty or to any gunpowder or explosives in charge of officers in the service of the Government of the Dominion, during the performance of the duties of their office.

At the Government Buildings, at Wellington, this 17th day of January, 1927.

IN pursuance and exercise of the powers and authorities conferred upon him by the New Zealand Agricultural College Act, 1926, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby fix the seventeenth day of January, one thousand nine hundred and twenty-seven, as the day on which the New Zealand Agricultural College Council shall be deemed to be constituted pursuant to the provisions of section five of the said Act, and doth, in pursuance of section seven, appoint half-past ten o’clock a.m. on Tuesday, the first day of February, one thousand nine hundred and twenty-seven, as the time, and the Parliamentary Buildings, Wellington, as the place, for holding the first meeting of the said Council.
