ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 6th day of
December, 1926.

Present :

THE HONOURABLE W. DOWNIE STEWART PRESIDING IN
COUNCIL.

IN pursuance and exercise of the powers and authorities
conferred on me by section twenty-five of the Naval
Defence Act, 1913, and of all other powers and authorities
enabling me in that behalf, I, General Sir Charles Fergusson,
Baronet, Governor-General of the Dominion of New Zealand,
acting by and with the advice and consent of the Executive
Council of the said Dominion, do hereby amend and supple-
ment the regulations referred to in the Schedule hereto as
shown therein.

SCHEDULE.

REGULATIONS FOR THE GOVERNMENT AND PAYMENT OF THE
NEW ZEALAND DIVISION OF THE ROYAL NAVY.

REGULATION No. 4, paragraph 3, between “Division” and
“shall” in first line, insert “except those under training in
the training establishment who shall be granted fourteen
days’ leave at Christmas, fourteen days at Easter, and four-
teen days in August”; at the end of paragraph 3 insert
“Permanent New Zealand Ratings proceeding to England
for courses, &c., may, subject to the exigencies of the service,
be granted ten days’ leave before sailing; such leave to be
in addition to the annual allowance. On returning to New
Zealand, ratings are to be granted foreign service leave at the
rate of seven days per six months and one day per complete
month of absence from the Dominion.”

Appendix III—Seamen Ratings: Gunnery, Torpedo, &c.—
Training Allowances.

In last two lines cancel “Admiralty Monthly Order No.
2367/1920” and substitute “K.R. and A.I. appendix 15 No.
99.”

Miscellaneous Special Duty.—Add— Per Diem.

Senior Allowance (as from 15th August, 1926)—Payable at
the discretion of the Naval Board.

Add new Regulation No. 37B.

Pensions in respect of Death or Disablement of Members of the
New Zealand Naval Forces.

Commence by inserting :—

  1. (i.) In the event of the death of any member of the New
    Zealand Naval Forces by misadventure, suffered in the per-
    formance of his duties, there may be paid out of the Con-
    solidated Fund, to or on behalf of his dependants, an allowance
    by way of pension at rates not exceeding the rates that would
    be payable if he had been a member of the Forces within the
    meaning of the War Pensions Act, 1915, and if his death had
    been due to service with those Forces.

(ii.) In the event of the disablement of any member of the
New Zealand Naval Forces by reason of misadventure suffered
in the performance of his duties, there may be paid out of the
Consolidated Fund to that member, and to or on behalf of
his dependants, an allowance by way of pension at rates not
exceeding the rates that would be payable if he had been a
member of the Forces within the meaning of the War Pen-
sions Act, 1915, and if his disablement had been due to service
with those Forces.

(iii.) All applications for pensions under this section shall
be referred to the War Pensions Board under the War Pensions
Act, 1915, and the Board shall, with respect to the hearing of
such applications, have the same powers as if the application
were an application under that Act.

(iv.) In making any recommendation for the grant of a
pension under this section the Board shall take into con-
sideration any amount paid by way of pension, retiring-allow-
ance, compensation, or compassionate allowance out of the
Public Account, or out of any superannuation fund, in respect
of the death or disablement of the person in respect of whose
death or disablement the application is made.

(v.) For the purposes of this section the term “New
Zealand Naval Forces” means the Naval Forces established
under the Naval Defence Act, 1913; and the term “depend-
ants,” in relation to a member of the said Force, has the
same meaning, with the necessary modifications, as in the
War Pensions Act, 1915.

  1. Nothing in the foregoing shall reduce the powers con-
    ferred upon the Naval Board by Regulation No. 37 of Order
