NOTICE is hereby given that the Public Trustee has filed in the Supreme Court an election to administer in respect of the several estates of the persons deceased whose names, residences, and occupations (so far as known) are hereunder set forth.

CROWN LANDS NOTICE.
Timber in Hawke’s Bay Land District for Sale by Public Auction.
District Lands and Survey Office,
Napier, 27th October, 1926.
NOTICE is hereby given that the undermentioned milling-timber will be offered for sale by public auction at the District Lands and Survey Office, Napier, at 11 o’clock a.m. on Wednesday, 15th December, 1926, under the provisions of the Land Act, 1924, and the Timber Regulations thereunder.
SCHEDULE.
HAWKE’S BAY LAND DISTRICT.—HAWKE’S BAY COUNTY.
SECTION 1, Block VI, and Section 3, Block VII, Maungaharuru Survey District:—

Upset price : £12,000.
Time for removal : Six years.
Terms of Payment.
A deposit of 5 per cent. to be paid in cash on the fall of the hammer, together with £1 1s. license fee; balance in half-yearly instalments payable 1st January and July, over period of six years, first payment falling due on 1st January, 1927.
All instalment payments shall bear interest at the rate of 5 per cent. per annum as from the date of auction, and, with interest added, shall be secured by “On demand” promissory notes endorsed by two approved sureties; and such bills are to be completed and lodged with the Commissioner of Crown Lands within fourteen days after the purchaser has been notified to complete.
Conditions of Sale.

Intending purchasers are expected to visit the locality and satisfy themselves in every particular on all matters relating to the sale.

The right is reserved to the Commissioner of Crown Lands to withdraw this timber from sale before the date fixed for sale.

The aforementioned quantities, qualities, and kinds as to the said timber shall be taken as sufficiently accurate for the purpose of this sale, and no contract for purchase shall be voidable, nor shall the successful purchaser be entitled to any abatement in price, by reason of the said timber being of less quantity, quality, and kind than as stated herein or in any advertisement having reference to the said timber, nor shall any extra sum be claimed by the Crown if the said quantity of timber is found to be in excess of that stated herein.

The license shall be subject to any right of tramway already granted or that may hereafter be granted over the lands comprised therein, and the Land Board may authorize the laying-down and working of tram-lines through the lot by other persons than the licensee.

The lots will be sold generally in accordance with the areas and boundaries as shown on a map at the District Lands and Survey Office, Napier.

No compensation will be given, nor shall any be claimed, for any error, discrepancy, or misdescription whatever in respect of these lots, or the timber thereon, or in these conditions.

Should any dispute arise as to the boundaries the decision of the Commissioner of Crown Lands shall be final.

In the event of no bids being received for this timber, applications may be received and dealt with at any time thereafter (unless previously formally withdrawn), providing, however, that the amount offered is not less than the upset price stated herein.

If the purchaser is unable to cut the whole of the timber within the term specified owing to causes beyond his control, the license may be extended for a further term of two years, subject to clause 88 of the Forest Regulations.

The purchaser shall have the right to cut the timber for the period specified, but shall have no right to the use of the land.

The timber shall be cut in a face, and the Crown reserves the right to follow up the mill-workings by felling and grassing such areas as from time to time become available, and of disposing of the same.

The licensee shall not allow any sawdust to find its way into any watercourse of any description.

The totara-trees on the block, estimated to contain 37,550 ft. of defective timber, suitable for fencing-posts and house-blocks, must not be felled, and is to be left for the use of future lessees.

The attention of intending purchasers is directed particularly to clauses 9, 18, 22, 27, and 58 of the Forest Regulations under the Land Act, 1908, dated 31st March, 1908.
The promissory notes will be presented at intervals as indicated in terms of payment, but they may be presented for payment at earlier dates if more than a due proportion of the timber is found to be cut, or should any breach of the conditions occur, or if in the opinion of the Commissioner the interest of the Crown is jeopardized.
