Variation of an Order in Council prohibiting Alienation of certain Native Land.

ORDER IN COUNCIL.
At the Government Buildings at Wellington, this 11th day of October, 1926.
Present:
THE HONOURABLE W. DOWNIE STEWART PRESIDING IN COUNCIL.
WHEREAS it is enacted by section one hundred and thirty-two of the Native Land Act, 1909, that any Order in Council made thereunder may at any time be varied and revoked:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance of the power and authority vested in him and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby vary an Order in Council made under the said section one hundred and thirty-two of the Native Land Act, 1909, dated the twenty-ninth day of September, one thousand nine hundred and twenty-four (and extended from time to time), regarding the Ahomatariki 2B and other blocks set out in the Schedule to such Order in Council by excluding and excepting from prohibition of alienation the lands set out in the Schedule hereto.

Extending Prohibition of Alienation of certain Native Lands other than Alienation in favour of the Crown.

ORDER IN COUNCIL.
At the Government Buildings at Wellington, this 11th day of October, 1926.
Present:
THE HONOURABLE W. DOWNIE STEWART PRESIDING IN COUNCIL.
ON the recommendation of the Native Land Purchase Board, referred to in section three hundred and sixty-three of the Native Land Act, 1909, and in exercise of the power in this behalf conferred upon him by that section, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council thereof, doth hereby extend for a further period of six months the Order in Council dated the tenth day of November, one thousand nine hundred and twenty-five, and gazetted the twenty-sixth day of November, one thousand nine hundred and twenty-five, prohibiting all alienation of the Native land specified in the Schedule hereto, other than alienation in favour of the Crown.

The South-eastern Side of Portion of Russell Lane, in the City of Auckland, exempted from the Provisions of Section 117 of the Public Works Act, 1908, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.
At the Government Buildings at Wellington, this 11th day of October, 1926.
Present:
THE HONOURABLE W. DOWNIE STEWART PRESIDING IN COUNCIL.
IN pursuance and exercise of the powers conferred by the Public Works Act, 1908, and of all other powers in any-wise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Auckland City Council on the fifth day of August, one thousand nine hundred and twenty-six, viz. :
“That the Auckland City Council, having control of Russell Lane, Auckland, by resolution declares that the provisions of section one hundred and seventeen of the Public Works Act, 1908, shall not apply to the said street fronting part Allotment 70, Section 1, Suburbs of Auckland”;
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-eastern side of the portion of Russell Lane (described in the Schedule hereto), within a distance of twenty-five feet from the centre-line of the said portion of street.

SCHEDULE.
THE south-eastern side of all that portion of street situated in the North Auckland Land District, City of Auckland, known as Russell Lane, fronting part Allotment 70, Section 1, Suburbs of Auckland. As the said portion of street is more particularly delineated on the plan marked P.W.D. 66896, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Land District, and thereon coloured blue.
