Regulations under the Land Act, 1924.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 11th day of October, 1926.

WHEREAS by section three of the Land Act, 1924 (hereinafter referred to as the principal Act), it is enacted that the Governor-General may from time to time, by Order in Council, make regulations for the purposes of the said Act:

And whereas by section five of the said Act it is enacted that the Governor-General may in like manner amend any regulation hitherto made for such purposes:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers conferred on him as aforesaid, and acting by and with the consent of the Executive Council of the said Dominion, doth hereby make the following regulations, and declare that the said regulations shall come into force on the date of the publication thereof in the New Zealand Gazette.

R E G U L A T I O N S.

  1. THE regulations prescribing declarations to be made by applicants for land made on the 4th day of January, 1916, are hereby amended by omitting the form of declaration set forth in Schedule A thereof, and substituting the form of declaration set forth in the First Schedule hereto.

  2. Where, pursuant to section three of the Land Laws Amendment Act, 1926, or pursuant to section seventy-seven of the principal Act as amended by section five of the Land Laws Amendment Act, 1926, or pursuant to section six of the last-mentioned Act, a license to occupy on deferred payments is issued, the half-yearly instalments of purchase-money and of interest payable under the license shall be calculated and paid in accordance with the table in the Second Schedule hereto.

  3. (1.) Every license issued to a purchaser pursuant to any of the enactments mentioned in clause 2 hereof shall be in such one of the forms in the Third Schedule hereto as may be appropriate, and such form may be varied to suit the circumstances of any particular case that may arise.

(2.) All forms prescribed by any regulation hitherto made under the said Act or any former Land Act with respect to occupation licenses issuable on the purchase of lands on deferred payments are hereby cancelled.

FIRST SCHEDULE.

DECLARATION TO BE MADE ON APPLYING FOR LAND FOR CASH, ON DEFERRED PAYMENTS, OR ON RENEWABLE LEASE UNDER PART III OF THE LAND ACT, 1924.

I, [Name in full], of [Address], [Occupation], do solemnly and sincerely declare,—

  1. That I am of the age of seventeen years and upwards.

  2. That I am, subject to the provisions of the Land Act, 1924, applying for [or desirous of becoming the transferee of a lease, license, or certificate of occupation of] the land described in the accompanying application solely for my own use and benefit, and not directly or indirectly for the use or benefit of any other person or persons whomsoever.

  3. That, including the area of the largest allotment now applied for, I am not the owner, holder, or occupier under any tenure of more than one year’s duration, either severally or jointly or in common with any other person or persons, of any land anywhere in New Zealand exceeding in the whole 5,000 acres, computed as follows:—

(a.) Every acre of first-class land is reckoned as 7½ acres ;

(b.) Every acre of second-class land is reckoned as 2½ acres ;

(c.) Every acre of third-class land is reckoned as 1 acre.

  1. That my answers to the questions accompanying the attached application are true and correct in every particular.

And I make this solemn declaration conscientiously believing the same to be true, and by virtue of the Justices of the Peace Act, 1908.
