Constituting a Special Board for the Purpose of controlling the Gates of the Kawarau Falls Dam.

ORDER IN COUNCIL.

At the Government House at Wellington, this 23rd day of August, 1926.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred by section one hundred and ninety of the Reserves and other Lands Disposal and Public Bodies Empowering Act, 1924, and of every other power and authority in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby constitute a special Board, consisting of the following members, for the purpose of determining when the gates of the dam referred to in the license for a dam at Kawarau Falls, Lake Wakatipu, granted under the Mining Act, 1908, on the eighteenth day of January, one thousand nine hundred and twenty-four, by George Cruickshank, Esq., Warden of the Otago Mining District, to Alfred Charles Hanlon, Esq., of Dunedin, Solicitor, and registered as No. 2057 in the Warden’s Court of the Otago Mining District, shall be opened and closed in accordance with the provisions of the said license:—

Alfred Charles Hanlon, Esq., representing the licensee,

Joseph Mosley, Esq., representing the Clutha County Council,

Leo Lee, Esq., representing the Lake County Council,

James R. Copland, Esq., representing the Balclutha Borough Council,

Andrew Simson, Esq., representing the Queenstown Borough Council,

Arthur Cooper Leary, Esq., representing the Clutha River Board,

Alexander Renton, Esq., representing the Inch Clutha River and Drainage Board,—

and doth hereby declare that the said Board shall have the following powers:—

  1. Power from time to time to appoint its own Chairman and regulate its own procedure, including the fixing of a quorum of members (not being less than three) who may in meeting duly convened exercise all powers vested in the Board.

  2. Power to appoint or dismiss a Clerk and such further officers or workmen as may be necessary to ensure the opening and shutting of the gates in accordance with the provisions of the license, and to establish an office in a locality approved by the Board.

  3. Power to collect from time to time from the licensee and any person or company in whom the said license may at any time be vested, all sums of money necessary in the opinion of the Board for the purpose of providing for the expenses that may reasonably be anticipated to be incurred by the Board in carrying-out the powers vested in it by the said license and this Order in Council, and for the purpose of defraying any expenses that may have been incurred as aforesaid.

  4. Power to institute and to authorize any officer or servant of the Board or other person to institute proceedings against any person interfering with or using such gates without the authority of the Board first had and obtained, or committing in relation to the said dam any act in respect of which proceedings of any nature may be instituted.

  5. Power to sue for recovery of any money owing to the Board.

  6. Power to make by resolution passed with the precedent approval of the Minister of Public Works, rules and regulations (not being inconsistent with the terms of the said license) for the control of the dam, and from time to time with the like approval to revoke or amend any such rules or regulations; provided always that copies verified by certificate under the hands of the Chairman and Clerk of every resolution making, revoking, or amending any such rules or regulations shall, within seven days from the passing of such resolution, be forwarded by the Board to the Ministers of Public Works and Mines and to the licensee respectively.

  7. Power, notwithstanding any rule or regulation made hereunder, in an emergency to direct the licensee or any person or company in whom the said license may for the time being be vested to operate the gates in any particular manner, and, in the event of the licensee or any such person or company as aforesaid failing to comply with any of the requirements of the Board or of the said license, to open or close the gates at any time and to keep the gates open or closed as the Board thinks fit.

  8. Power to provide, by resolution notified in writing to the licensee or any other person or company affected, the manner in which any requirement, direction, or notice made or given by the Board shall be authenticated and served so as to be deemed validly made or given.
