ORDER IN COUNCIL.\n
At the Government Buildings at Wellington, this 30th day of\nMarch, 1926.\n
Present:\n
The Right Honourable J. G. Coates, P.C., PRESIDING IN\nCouncil.\n
WHEREAS it is provided by section two of the Public\nWorks Amendment Act, 1910 (hereinafter called\n"the said Act"), that the Governor-General may, if he thinks\nfit, by Order in Council, authorize the Minister of Public\nWorks to construct, maintain, or control any water-race or\nwater-supply works, either within or outside a mining dis-\ntrict, which are proposed to be constructed or which have\nbeen constructed out of funds provided by Parliament:\n
And whereas it is further provided by section five of the\nsaid Act that before any Order in Council is issued autho-\nrizing the said Minister to construct any water-race or water-\nsupply works the owners or occupiers of all the lands likely\nto be benefited thereby shall be given an opportunity to enter\ninto contracts with His Majesty to take water from such works\nwhen completed; and such contracts shall specify the quan-\ntity of water to be so taken and the price or rate to be paid\nfor same:\n
And whereas it is also provided by section five of the said\nAct that if at least one-half of the total number of those owners\nor occupiers enter into contracts to take such quantity of\nwater as the Governor-General thinks reasonable at such a\nprice or rate as the Governor-General may approve, an Order\nin Council authorizing the construction of the works may\nbe issued:\n
And whereas the water-supply works mentioned in the\nFirst Schedule hereto have been partly constructed, and it\nis proposed to complete the construction of the said works\nout of the funds provided by Parliament:\n
And whereas at least one-half of the total number of the\nowners or occupiers of the lands which are likely to be bene-\nfited thereby have entered into contracts with His Majesty\nto take water from such works when completed, which con-\ntracts specify the quantity of water to be taken and the\nprice to be paid for the same:\n
Now, therefore, His Excellency the Governor-General of the\nDominion of New Zealand, in pursuance and exercise of the\npowers conferred by the above-in-part-recited Act, and acting\nby and with the advice and consent of the Executive Council\nof the said Dominion, doth hereby approve and confirm the\nterms of the several contracts aforesaid, and doth hereby\nauthorize the Minister of Public Works to construct, maintain,\nand control the water-supply works described in the First\nSchedule hereto, and doth hereby also define the district to\nbe served by such water-supply works as set out in the\nSecond Schedule hereto, and herein referred to as the Benger-\nburn Irrigation District. \n
FIRST SCHEDULE.\n
BENGERBURN irrigation-works, for the irrigation of the Benger-\nburn District (described in the Second Schedule hereto) by\nmeans of water drawn from the Bengerburn, and any dam or\ndams which are or may be constructed or acquired on said\nBengerburn or any other river or stream, such water being\nconveyed into the said district by the water-race known as\nthe Homestead Race, Water-race License No. 956R, or by any\nenlargement or extension thereof, or by any other race or races\nconstructed or acquired by the Minister of Public Works in\naddition to or in lieu of the said Homestead Race or any en-\nlargement or extension thereof; the said works including all\ndams, weirs, reservoirs, tunnels, fluming, siphons, piping,\nmeasuring or regulating devices, and races, and all other\nworks incidental to or required for the construction, main-\ntenance, and control of the said works for the irrigation of\nthe said Bengerburn Irrigation District.\n
SECOND SCHEDULE.\n
All that area in the Otago Land District bounded by a line\ncommencing at a point on the right bank of the Clutha River\nat the north-eastern corner of Section 82, Block I, Benger\nSurvey District, and proceeding thence in a westerly direc-\ntion generally along the northern boundaries of Sections 82\nand 39, Block I, Benger Survey District, to a public road ;\nthence in a south-easterly direction along the said public\nroad to the northern boundary of Block VI, Benger Survey\nDistrict; thence in a south-westerly direction generally along\nthe northern boundary of Section 3 and the north-western\nboundaries of Sections 2 and 5, Block VI, Benger Survey\nDistrict, and Section 5s, Dalmain Settlement; thence in a\nsouth-easterly direction generally along the boundaries of the\nsaid Section 5s to a public road at the south-eastern corner\nof the said Section 5s; thence along the said public road to\nits junction with another public road forming the north-\nwestern boundary of Allotments 1, 2, and 3, Land Transfer\nplan No. 2412; thence in a north-easterly direction generally\nalong the said public road to the western boundary of the\nTownship of Ettrick; thence in a southerly direction gen-\nerally along the said boundary to the Bengerburn; thence in\nan easterly direction generally along the said Bengerburn to\nthe Clutha River; thence in a northerly direction generally\nalong the right bank of the Clutha River to the point of com-\nmencement.\n
As the same is more particularly delineated on the plan\nmarked P.W.D. 65478, deposited in the office of the Minister\nof Public Works at Wellington, in the Wellington Land\nDistrict, and thereon coloured pink and edged red.\n

The Southern Side of Portion of Creswick Terrace, in the City\nof Wellington, exempted from the Provisions of Section 117\nof the Public Works Act, 1908, subject to a Condition as to\nthe Building-line.\n

IN pursuance and exercise of the powers conferred by the\nPublic Works Act, 1908, and of all other powers in any-\nwise enabling him in this behalf, His Excellency the Governor-\nGeneral of the Dominion of New Zealand, acting by and with\nthe advice and consent of the Executive Council of the said\nDominion, doth hereby approve of the following resolution\npassed by the Wellington City Council on the eleventh day of\nFebruary, one thousand nine hundred and twenty-six, viz. :-\n
"The Wellington City Council, being the local authority\nhaving control of the streets in the City of Wellington,\nhereby declares that the provisions of section one hundred\nand seventeen of the Public Works Act, 1908, shall not\napply to the southern side of all that portion of Creswick\nTerrace beginning at its junction with Wilton Road and\nextending for a distance of 390-57 links, being portion of\nroad fronting Lots 15 and 16, deeds plan 108, and land\ncontained in certificate of title, Volume 223, folio 181, in\noffice of District Land Registrar, City of Wellington;"\nsubject to the condition that no building or part of a building\nshall at any time be erected on the land fronting the southern\nside of the portion of Creswick Terrace (described in the\nSchedule hereto), within a distance of thirty-three feet from\nthe centre-line of the said portion of street.\n
SCHEDULE.\n
The southern side of all that portion of street situated in the\nWellington Land District, City of Wellington, known as\nCreswick Terrace, fronting parts Lots 15 and 16, Deeds Plan\n108, of part Section 32, Karori District. As the said portion\nof street is more particularly delineated on the plan marked\nP.W.D. 60394, deposited in the office of the Minister of Public\nWorks at Wellington, in the Wellington Land District, and\nthereon coloured red.\n
