The Samoa Roman Catholic Lands Order, 1925.

ORDER IN COUNCIL.
At the Government Buildings at Wellington, this 21st day of December, 1925.
Present:
THE HONOURABLE J. G. COATES PRESIDING IN COUNCIL.
WHEREAS the lands described in the second column of the Schedule hereto are lands in Western Samoa belonging to the Roman Catholic Church: And whereas such lands have been granted or acquired and are now registered in the Land Register of Western Samoa in the respective volumes and folios thereof set out in the third column of the said Schedule in the several names respectively appearing in the first column of the said Schedule opposite to the descriptions of the said several lands contained in the second column of the said Schedule: And whereas none of such names represents any existing person or body corporate: And whereas it is expedient that all such lands should be vested in the Roman Catholic Bishop for the time being of the Diocese of Samoa as a corporation sole, and that the said corporation sole should have power to acquire other lands hereafter: And whereas legislation is necessary to enable such lands to be so vested:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of that Dominion, and in pursuance of the authority to make regulations for the peace, order, and good government of Samoa conferred upon him by the Samoa Act, 1921, and of all other powers and authorities enabling him in that behalf, doth hereby order as follows:β€”

  1. These regulations may be cited as the Samoa Roman Catholic Lands Order, 1925, and shall come into force on the first day of January, one thousand nine hundred and twenty-six.
  2. The several freehold and leasehold lands described in the second column of the Schedule which belong to the Roman Catholic Church of Samoa and which are registered in the Land Register of Western Samoa in the respective names appearing in the first column of the Schedule under the respective references appearing in the third column of the said Schedule shall vest in and be held by the Roman Catholic Bishop for the time being of the Diocese of Samoa and his successors for ever in perpetual succession as a corporation sole, according to the tenure thereof, subject, nevertheless, to all such encumbrances and other interests, if any, as the same are now subject to, and subject to the trusts and purposes for which such lands may have been granted or acquired.
  3. If any lands in Samoa are hereafter granted to or acquired by the Roman Catholic Bishop for the time being of the Diocese of Samoa, whether in his personal name or by the title of the corporation sole created by this Order, and the instrument of assurance under which they are granted or acquired contains a provision to the effect that this Order is intended to apply to such lands, then such lands shall vest in and be held by the said Bishop as a corporation sole by virtue of this Order according to the tenure thereof, subject, nevertheless, to the trusts and purposes for which such lands may be granted or acquired.
  4. In case at any time there shall be a vacancy in the office of Bishop of the Roman Catholic Diocese of Samoa, then all the lands for the time being vested in such Bishop as a corporation sole by virtue of this Order shall cease to be so vested, and shall be and become vested upon the trusts affecting the same in the Administrator of the said diocese for the time being duly acting until a Bishop shall have been appointed and no longer; and such Administrator shall, during the period for which such lands shall be vested in him, have and possess the same powers and authorities of dealing with the same, and be under the same liabilities in respect of the same, as the Bishop for the time being of the said diocese has and possesses under this Order or under any trust or by operation of law or otherwise.
