THE NEW ZEALAND GAZETTE.

Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Wellington City Council on the eighteenth day of October, one thousand nine hundred and twenty-three, viz. :—

"The Wellington City Council, being the local authority having control of the streets in the City of Wellington, hereby declares that the provisions of section one hundred and seventeen of the Public Works Act, 1908, shall not apply to the south-western side of all that portion of Lindum Terrace beginning from the south-eastern boundary of Lot 3, D.P. 3366, and extending for a distance of 63·64 links, being frontage of Lot 4, D.P. 3366, part Section 1, Evans Bay Registration District, Block VII, Port Nicholson Survey District";

subject to the condition that no building or part of a building shall at any time be erected on the south-western side of the portion of Lindum Terrace described in the Schedule hereto, within a distance of thirty-three feet from the centre-line of the said portion of street.

SCHEDULE.

THE south-western side of that portion of street situated in the Wellington Land District, City of Wellington, known as Lindum Terrace, fronting Lot 4 on D.P. 3366, part Section 1, Evans Bay Registration District, Block VII, Port Nicholson Survey District. As the same is more particularly delineated on the plan marked P.W.D. 58307, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Land District, and thereon coloured red.

Gibbon Street, in the City of Christchurch, exempted from the Provisions of Section 117 of the Public Works Act, 1908, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 24th day of March, 1924.

Present :

THE HONOURABLE SIR FRANCIS BELL PRESIDING IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1908, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Christchurch City Council on the twentieth day of December, one thousand nine hundred and twenty-three, viz. :—

"The Christchurch City Council, having control of Gibbon Street in the City of Christchurch, hereby by resolution declares that the provisions of section one hundred and seventeen of the Public Works Act, 1908, shall not apply to the said street";

subject to the condition that no building or part of a building shall at any time be erected on either side of Gibbon Street (described in the Schedule hereto), within a distance of thirty-three feet from the centre-line of the said street, such condition being of the same effect as section thirty-five of the City of Christchurch By-law No. 1, 1916, Part I, relating to building-line.

SCHEDULE.

ALL that street, situated in the Canterbury Land District, City of Christchurch, known as Gibbon Street, extending between Roger Street and Ingoldsby Street. As the same is more particularly delineated on the plan marked P.W.D. 58799, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Land District, and thereon coloured red.

Revoking Order in Council licensing John Ralph Bartle to occupy a Portion of the Foreshore at Whangaroa Harbour and to reclaim such Land.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 24th day of March, 1924.

Present :

THE HONOURABLE SIR FRANCIS BELL PRESIDING IN COUNCIL.

WHEREAS by Order in Council dated the twenty-first day of January, one thousand nine hundred and nineteen, and published in the New Zealand Gazette No. 10 of the thirtieth day of the same month, John Ralph Bartle (hereinafter called the licensee) was, in pursuance of the provisions of section thirty-nine of the Harbours Amendment Act, 1910, licensed to occupy a portion of the land between high and low water marks at Whangaroa Harbour and to reclaim such land :

And whereas the licensee has applied to have the said license revoked, and it is desirable so to do :

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the power and authority vested in him, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby revoke the hereinbefore-recited Order in Council of the twenty-first day of January, one thousand nine hundred and nineteen, licensing John Ralph Bartle to occupy a portion of the land between high and low water marks in Whangaroa Harbour and to reclaim such land as from the twenty-first day of January, one thousand nine hundred and twenty-three.

Regulations with regard to the Taking and Sale of Quinnat Salmon (Oncorhynchus tschawytscha).

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 24th day of March, 1924.

Present :

THE HONOURABLE SIR FRANCIS BELL PRESIDING IN COUNCIL.

IN pursuance and exercise of the power and authority conferred upon him by sections eighty-three and ninety-four of the Fisheries Act, 1908, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby make the following regulations with regard to the taking and sale of quinnat salmon (Oncorhynchus tschawytscha); and doth hereby order and declare that the said regulations shall have force and effect throughout the said Dominion.

REGULATIONS.

  1. It shall be unlawful for any person to take salmon in any year during the period from the 15th day of May to the 30th day of September, both days inclusive, which period is hereby declared to be a close season for such fish.

  2. During the period from the date of this Order in Council until the 15th day of May, 1924, anglers licensed by any Acclimatization Society within the Dominion to fish for trout may fish for salmon and dispose by sale of any salmon so taken.

  3. During the period from the date of this Order in Council until the 15th day of May, 1924, sea fishermen duly licensed by the Marine Department under the provisions of section 6 of the Fisheries Act, 1908, and the regulations made thereunder, may fish for and take salmon from the sea outside a radius of 500 yards from the mouth or entrance of any river, and dispose of the same by sale, provided that the above restriction as to radius shall not apply to tidal rivers or estuaries where netting is by regulation allowed, within limits therein defined, for indigenous market fishes.

  4. Such anglers and fishermen shall, on or before the 31st day of May, 1924, forward to the Secretary, Marine Department, Wellington, a return, in such form as may be prescribed, of all salmon taken under the authority of these regulations.

  5. Any person committing a breach of these regulations shall be liable to a fine of £50.
