of law, where a local authority or public body has been authorized before the passing of the said Act, or is thereafter authorized, to borrow money, whether pursuant to a poll of ratepayers or otherwise howsoever, whether the rate of interest or the term of years of the loan was or was not specified or determined, and such money or any part thereof has not been borrowed, the local authority may, with the precedent consent of the Minister of Finance, borrow such money, or such amount thereof as has not been borrowed, at such rate of interest, or for such term, as may be prescribed by the Governor-General by Order in Council:

And whereas the Whangarei Borough Council has been authorized to borrow the sum of two thousand two hundred pounds for improving roads in the Riverside District:

And whereas the Minister of Finance has given his precedent consent as required by the above-recited section eleven, and it is desired that the rate of interest at which the money may be borrowed be not exceeding six per centum per annum.:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the power and authority vested in him as aforesaid, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby prescribe that the rate of interest that may be paid by the Whangarei Borough Council in respect of the said loan of two thousand two hundred pounds shall be a rate not exceeding six per centum per annum, and the said Whangarei Borough Council is hereby authorized to borrow the said sum of two thousand two hundred pounds accordingly.

The Eastern Side of Portion of Gladstone Road, in the City of Dunedin, exempted from the Provisions of Section 117 of the Public Works Act, 1908.

At the Government Buildings at Wellington, this 24th day of March, 1924.

Present:

THE HONOURABLE SIR FRANCIS BELL PRESIDING IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1908, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Dunedin City Council on the thirtieth day of January, nineteen hundred and twenty-four, viz.:

That the Council of the City of Dunedin hereby resolves that the provisions of section one hundred and seventeen of the Public Works Act, 1908, shall not apply to that portion of the eastern side of that street in the City of Dunedin known as Gladstone Road where the same abuts on Sections 7, 8, 9, 10, and 11, Township of Gladstone; as the said portion of the said street is more particularly shown by brown colour on the plan hereunto annexed”;
such portion of street being described in the Schedule hereto.


SCHEDULE.

THE eastern side of all that portion of street situated in the Otago Land District, City of Dunedin, known as Gladstone Road, fronting Sections 7, 8, 9, 10, and 11, Township of Gladstone. As the same is more particularly delineated on the plan marked P.W.D. 58587, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Land District, and thereon coloured brown.

The North-eastern Side of Portions of Brighton Street, in the City of Dunedin, exempted from the Provisions of Section 117 of the Public Works Act, 1908, subject to a Condition as to the Building-line.

At the Government Buildings at Wellington, this 24th day of March, 1924.

Present:

THE HONOURABLE SIR FRANCIS BELL PRESIDING IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1908, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Dunedin City Council on the nineteenth day of December, one thousand nine hundred and twenty-three, viz.:

“ That the Council of the City of Dunedin hereby resolves that the provisions of section one hundred and seventeen of the Public Works Act, 1908, shall not apply to that portion of the north-eastern side of that street in the City of Dunedin known as Brighton Street where the same abuts on Allotments 5 and 7, L.T. Plan 2622, part Allotment 8, L.T. Plan 9, and part of Allotment 10, L.T. Plan 1468, Block III, Upper Kaikorai District, as the said portion of the said street is more particularly delineated by brown colour on the plan hereunto annexed ”;

subject to the condition that no building or part of a building shall at any time be erected on the north-eastern side of the said portions of Brighton Street (described in the Schedule hereto), within a distance of thirty-three feet from the centre-line of the said portions of street.


SCHEDULE.

THE north-eastern side of all those portions of Brighton Street situated in the Otago Land District, City of Dunedin, fronting Allotments 5 and 7, D.P. 2622, part Allotment 8 on D.P. 9, being parts of Sections 16 and 18, Block III, Upper Kaikorai District, and part Allotment 10, on D.P. 1468, being part Section 16, Block III, Upper Kaikorai District. As the same are more particularly delineated on the plan marked P.W.D. 58736, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Land District, and thereon coloured brown.

The Northern Side of Portion of Pendarves Street, in the Borough of New Plymouth, exempted from the Provisions of Section 117 of the Public Works Act, 1908, subject to a Condition as to the Building-line.

At the Government Buildings at Wellington, this 24th day of March, 1924.

Present:

THE HONOURABLE SIR FRANCIS BELL PRESIDING IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1908, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the New Plymouth Borough Council on the eighteenth day of February, one thousand nine hundred and twenty-four, viz.:

“ That the New Plymouth Borough Council, being the local authority having control of the street hereinafter mentioned, hereby resolves and declares that the provisions of section one hundred and seventeen, subsection one, of the Public Works Act, 1908, shall not apply to that portion of the northern side of Pendarves Street to which Section 1633, New Plymouth, has frontage ”;

subject to the condition that no building or part of a building shall at any time be erected on the northern side of the portion of Pendarves Street (described in the Schedule hereto), within a distance of thirty-three feet from the centre-line of the said portion of street.


SCHEDULE.

THE northern side of all that portion of street, situated in the Taranaki Land District, Borough of New Plymouth, known as Pendarves Street, abutting on Section 1633, Town of New Plymouth. As the same is more particularly delineated on the plan marked P.W.D. 59197, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Land District, and thereon coloured blue.
