  1. The rights, powers, and privileges hereby granted and conferred may be at any time resumed by the Governor-General, without payment of any compensation whatsoever, on giving to the company three calendar months’ previous notice in writing. Such notice shall be sufficient if given by the Minister and delivered at or posted to the last known registered office of the company in New Zealand.

  2. In case the company shall—
    (1.) Commit or suffer a breach of the conditions hereinbefore set forth, or any of them, or any breach of the Fisheries Act, 1908, or its amendments;
    (2.) Be in any manner wound up or dissolved; or
    (3.) Fail to pay the sums specified in clause 3 of these conditions,—
    then and in any such case this Order in Council, and every license, right, power, or privilege thereby conferred, may be revoked and determined by the Governor-General in Council without any notice to the company or other proceeding whatsoever; and publication in the New Zealand Gazette of an Order in Council containing such revocation shall be sufficient notice to the company, and to all persons concerned or interested, that this Order in Council, and the license, rights, and privileges thereby granted and conferred, have been revoked and determined.

  3. Payment by the company of any of the sums hereinbefore mentioned shall be sufficient evidence of the acceptance by the company of the terms and conditions of this Order in Council.

The North-western Side of Portion of Spur Road, in the Borough of Sumner, exempted from the Provisions of Section 117 of the Public Works Act, 1908.

ORDER IN COUNCIL.

At the Government House at Wellington, this 26th day of November, 1923.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1908, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Sumner Borough Council on the sixteenth day of August, one thousand nine hundred and twenty-three, viz. :

That the Sumner Borough Council hereby declares that, pursuant to the provisions of section 117 of the Public Works Act, 1908, the said section 117 shall not apply to that portion of the Spur Road in the Borough of Sumner fronting Lots 73, 74, 75, 76, 77, on deposit plan No. 926 of the subdivision of Rural Section 261, Block II, Sumner, as shown on attached plan coloured red”; such portion of street being described in the Schedule hereto.

SCHEDULE.

THE north-western side of all that portion of street, situated in the Canterbury Land District, Borough of Sumner, known as Spur Road, fronting part of Lot 73 and Lots 74, 75, 76, and 77, on D.P. 926 of the subdivision of R.S. 261, Block II, Sumner Survey District. As the same is more particularly delineated on the plan marked P.W.D. 57848, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Land District, and thereon coloured red.

The Western and Eastern Sides of Portions of Creswick Terrace, in the City of Wellington, exempted from the Provisions of Section 117 of the Public Works Act, 1908, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.

At the Government House at Wellington, this 26th day of November, 1923.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1908, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Wellington City Council on the eighteenth day of October, one thousand nine hundred and twenty-three, viz. :

“The Wellington City Council, being the local authority having control of the streets in the City of Wellington, hereby declares that the provisions of section 117 of the Public Works Act, 1908, shall not apply to the western side of all that portion of Creswick Terrace beginning at the northern boundary of Lot 42, and extending for a distance of 181·82 links, being frontages of Lots 43 and 44, deeds plan 108, and also shall not apply to all that portion of the eastern side of the same street beginning at the southern boundary of Lot 45, and extending for a distance of approximately 284·09 links, being frontages of Lots 44, 43, and 42, deeds plan 108, Township of Creswick, Karori District ”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the said portions of Creswick Terrace (described in the Schedule hereto), within a distance of thirty-three feet from the centre-line of the said portions of street.

SCHEDULE.

THE western side of all that portion of street situated in the Wellington Land District, City of Wellington, known as Creswick Terrace, fronting Lots 43 and 44, deeds plan 108, Township of Creswick, Karori District ; also the eastern side of the portion of the said Creswick Terrace fronting Lots 42, 43, and 44, deeds plan 108, Township of Creswick, Karori District. As the said portions of street are more particularly delineated on the plan marked P.W.D. 58104, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Land District, and thereon coloured red.

Ryall’s Road, in the County of Ohinemuri, exempted from the Provisions of Section 117 of the Public Works Act, 1908, subject to a Condition as to the Building-line.

At the Government House at Wellington, this 26th day of November, 1923.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1908, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Ohinemuri County Council on the sixth day of September, 1923, viz. :

“That in respect of the road known as ‘Ryall’s Road’ in the County of Ohinemuri, shown on plan Number 22702, and taken by Proclamation Number 5653, the Ohinemuri County Council, being the local authority having control of the said road, hereby declares that the provisions of section 117 of the Public Works Act, 1908, shall not apply to the said road ”;

subject to the condition that no building or part of a building shall at any time be erected on either side of Ryall’s Road (described in the Schedule hereto), within a distance of thirty-three feet from the centre-line of the said road.

SCHEDULE.

ALL that road in the Auckland Land District, Ohinemuri County, known as Ryall’s Road, situated between the main road from Paeroa to Te Aroha and the north-eastern corner of Lot 5, D.P. 535, being part of Te Waka o Tiki Te Aroha, Block, Block XVI, Waihou Survey District. As the same is more particularly delineated on the plan marked P.W.D. 58254, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Land District, and thereon coloured red.
