And whereas at least one-half of the total number of the owners or occupiers of the lands which are likely to be benefited thereby have entered into contracts with His Majesty to take water from such works when completed, which contracts specify the quantity of water to be supplied:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers conferred by the above-in-part-recited Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve and confirm the terms of the several contracts aforesaid, and doth hereby authorize the Minister of Public Works to construct, maintain, and control the water-supply works described in the First Schedule hereto.

FIRST SCHEDULE.

TEVIOT irrigation works, for the irrigation of the Teviot District as described in the Second Schedule hereto, by means of water drawn from the Teviot River, and any dam or dams which are or may be constructed or acquired on that stream or any other stream, such water being conveyed into the said district by the race known as Ewing’s Race and by any extension thereof, or by any other race or races constructed or acquired by the Minister of Public Works in addition to or in lieu of the said Ewing’s Race and extension thereof; the said works including all dams, weirs, reservoirs, tunnels, fluming, siphons, piping, measuring or regulating devices, and races, and all other works incidental to or required for the construction, maintenance, and control of the said works for the irrigation of the said Teviot District.

SECOND SCHEDULE.

TEVIOT IRRIGATION DISTRICT.

ALL that area in the Otago Land District bounded by a line commencing at a point in Section 23, Block IV, Teviot Survey District, on the left bank of the Clutha River, and proceeding thence in a south-easterly direction generally through Sections 23, 19, 17, 15, 13, 25, 12, 10, and 8 in the said Block IV; thence through the westernmost portions of Runs 199F, 199E, occupation license, and Run 199D; thence in a south-westerly direction generally through Sections 15, 13, 11, 7, 5, 8, 6, 4, and 2, Block III, Teviot Survey District, to the right bank of the Teviot River; thence across and by the left bank of the said river in an easterly direction to the eastern boundary of Block VII in the same survey district; thence to the south along the said block boundary to the point of intersection by the line of the water-race, and along the said water-race through Sections 3, 2, and 1, Block VII, to the southern boundary of the Teviot Survey District, and along that boundary in a westerly direction to a point midway between the Lawrence-Roxburgh Road and the Clutha River; thence to the south by a right line to the left bank of the Clutha River; thence in a northerly direction generally along that bank to the point of commencement: all as is delineated on the plan marked P.W.D. 57224, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

Authorizing the Minister of Public Works to construct and maintain Water-supply Works in the Teviot Irrigation District.

ORDER IN COUNCIL.

At the Government House at Wellington, this 25th day of June, 1923.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS it is provided by section two of the Public Works Amendment Act, 1910 (hereinafter called “the said Act”), that the Governor-General may, if he thinks fit, by Order in Council, authorize the Minister of Public Works to construct, maintain, or control any water-race or water-supply works, either within or outside a mining district, which are proposed to be constructed or which have been constructed out of funds provided by Parliament:

And whereas it is further provided by section five of the said Act that before any Order in Council is issued authorizing the said Minister to construct any water-race or water-supply works the owners or occupiers of all the lands likely to be benefited thereby shall be given an opportunity to enter into contracts with His Majesty to take water from such works when completed; and such contracts shall specify the quantity of water to be so taken, and the price or rate to be paid for same:

And whereas it is also provided by section five of the said Act that if at least one-half of the total number of those owners or occupiers enter into contracts to take such quantity of water as the Governor-General thinks reasonable, at such a price or rate as the Governor-General may approve, an Order in Council authorizing the construction of the works may be issued:

And whereas the water-supply works mentioned in the First Schedule hereto are proposed to be constructed out of the funds provided by Parliament:

And whereas at least one-half of the total number of the owners or occupiers of the lands which are likely to be benefited thereby have entered into contracts with His Majesty to take water from such works when completed, which contracts specify the quantity of water to be supplied:

Amending and making New Financial Instructions and Allowance Regulations for the New Zealand Military Forces.

JELLICOE, Governor-General.

IN pursuance and exercise of the powers and authority conferred on me by the Defence Act, 1909, and its amendments, I, John Rushworth, Viscount Jellicoe, Governor-General of the Dominion of New Zealand, do hereby amend the Financial Instructions and Allowance Regulations for the New Zealand Military Forces, published in the New Zealand Gazette of the eighteenth day of May, one thousand nine hundred and twenty-two, and do also hereby make new regulations in accordance with the Schedule hereto; and I do hereby declare that such amendments shall take effect and new regulations come into force as from the date of the publication thereof in the Gazette.

SCHEDULE.

FINANCIAL INSTRUCTIONS AND ALLOWANCE REGULATIONS FOR THE NEW ZEALAND MILITARY FORCES.

PARAGRAPH 43 is hereby amended by deleting the words “by the G.O.C.”

Paragraph 56 is hereby amended by adding at the end of the paragraph “If the circumstances warrant it the G.O.C. may approve payment at full or half the daily rate for such further periods as he may consider necessary.”
