Resuming Land in Tiger Hill Survey District, Otago Land District, for Sites for Racemen’s Cottages.

A PROCLAMATION.

WHEREAS by section one hundred and forty-four of the Land Act, 1908 (hereinafter termed “the said Act”), it is, inter alia, enacted that the Governor-General in Council may by Proclamation resume possession of any land leased under Part V of the said Act, or under any corresponding Part of the Land Act, 1892, which in his opinion is required for any public purpose:

And whereas the land described in the Schedule hereto forms part of land held under small grazing-run lease from His Majesty the King, issued under Part V of the Land Act, 1908, dated the eleventh day of December, one thousand nine hundred and twelve:

And whereas, in the opinion of the Governor-General, the land mentioned in the Schedule hereto is required for a public purpose—that is to say, for sites for racemen’s cottages:

Now, therefore, in pursuance and exercise of the powers and authorities conferred upon me by section one hundred and forty-four of the Land Act, 1908, and of all other powers and authorities in anywise enabling me in this behalf, I, John Rushworth, Viscount Jellicoe, Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, do hereby proclaim and declare that I hereby resume possession of the land mentioned in the Schedule hereto for the public purpose hereinbefore mentioned, the same being part of the land held under small grazing-run lease as aforesaid.

SCHEDULE.

OTAGO LAND DISTRICT.

ALL that area in the Otago Land District, containing by admeasurement 11 acres 1 rood 13 perches, more or less, being part of Run 223c, Tiger Hill Survey District, and bounded as follows: Commencing at the southern corner of said Run 223c, thence by the Otago Central Railway Reserve 5° 34′, 2132·8 links, and 85° 13′, 405 links; thence by the other part of said Run 223c 65° 12′, 833·1 links; thence by main Ophir–Alexandra Road 208° 36′ 30″, 2854·5 links, to the point of commencement: be all the aforesaid linkages more or less. As the same is delineated on the plan marked 8/9/103, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon bordered red.

Given under the hand of His Excellency the Governor-General of the Dominion of New Zealand, and issued under the Seal of that Dominion, this 27th day of March, 1923.

The Southern Side of Portion of Wellington Road in the City of Wellington exempted from the Provisions of Section 117 of the Public Works Act, 1908, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.

At the Government House at Wellington, this 27th day of March, 1923.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1908, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Wellington City Council on the fifteenth day of February, one thousand nine hundred and twenty-three, viz.:

“The Wellington City Council, being the local authority having control of the streets in the City of Wellington, hereby declares that the provisions of section one hundred and seventeen of the Public Works Act, 1908, shall not apply to that portion of the southern side of Wellington Road, beginning at its junction with Kilbirnie Crescent and extending for a distance of 600 links, being the frontages of Lots 75, 76, 77, 78, 79, and 80, D.P. 65, being part of Section 4, Evans Bay District, Block VII, Port Nicholson Survey District”;

subject to the condition that no building or part of a building shall at any time be erected on the southern side of the portion of Wellington Road described in the Schedule hereto, within a distance of thirty-three feet from the centre-line of the said portion of street.

SCHEDULE.

ALL that portion of street situated in the Wellington Land District, City of Wellington, known as Wellington Road, abutting on Lots 75, 76, 77, 78, 79, and 80, D.P. 65, being part Section 4, Evans Bay District. As the said portion of street is more particularly delineated on the plan marked P.W.D. 56527, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Land District, and thereon coloured red.
