The Education Act, 1914.-Regulations regarding Free Places in Secondary Schools, District High Schools, Technical High Schools, and Technical Schools and Classes.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 19th day of December, 1922.

Present:

IN pursuance and exercise of the powers and authorities vested in him by the Education Act, 1914, and its amendments, and of all other powers enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby revoke the regulations at present in force regarding Free Places in Secondary Schools and District High Schools, and doth also hereby revoke clauses seventy-seven to one hundred and nine inclusive of the regulations for Manual and Technical Instruction at present in force, and in lieu thereof doth hereby make the regulations set forth in the Schedule hereto; and, with the like advice and consent, doth prescribe that this Order shall come into force on the date of the first publication thereof in the New Zealand Gazette.

SCHEDULE.

FREE PLACES.

  1. A FREE place under clauses 3 to 21 inclusive of these regulations tenable at a secondary school, district high school, or technical high school, hereinafter referred to as "a high school," shall be regarded as alternative with (not in addition to) a free place held on a corresponding qualification under clauses 22 to 28 inclusive of these regulations.

  2. A high school shall be held to provide free places within the meaning of section 97 of the Education Act, 1914, if, in accordance with the Act and these regulations, it admits to such free places all qualified pupils who wish to attend such school.

JUNIOR FREE PLACES IN SECONDARY SCHOOLS, DISTRICT HIGH SCHOOLS, AND TECHNICAL HIGH SCHOOLS.

  1. Subject to these regulations a pupil shall be qualified to be a junior free pupil or the holder of a junior free place under the Act if-

(a.) He is the holder of a Junior National Scholarship, or any other scholarship that the Minister shall approve for this purpose: Provided that the value of any such scholarship is not greater than Β£50 per annum in the case of any pupil who is obliged to live away from home in order to attend the high school, or than Β£15 per annum in any other case; or if

(b.) He has qualified for a free place in the Junior National Scholarship Examination on such pass conditions as the Minister may from time to time determine; or if

(c.) Being not over fifteen years of age on the 1st December preceding the date of his admission to a free place, he has obtained a certificate of proficiency as defined by regulations under the Act, or an equivalent or higher qualification:

Provided that any pupil who has obtained a certificate of proficiency but by reason of age is not qualified for a free place under paragraph (c) hereof may, within six months after obtaining such certificate, be admitted to a free place in a high school if he has been recommended therefor by a Senior Inspector of Schools, and takes a course of instruction that meets with the approval of the Director:

Provided further that if any pupil is in attendance at a secondary school or district high school at the date of coming into force of this proviso, and has been debarred from holding a free place solely by reason of age, he may, on the receipt of a favourable report from the Principal, be admitted by the Director to a junior free place during the year 1923.

In the case of a pupil applying for admission to a technical high school or district high school, a certificate of competency in the subjects of the Sixth Standard, with special merit in handwork or elementary science, shall be deemed to be equivalent to a certificate of proficiency.
