Tariff Agreement with Commonwealth of Australia.

ORDER IN COUNCIL.

At the Government House at Wellington, this 24th day of August, 1922.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS by the Customs Amendment Act, 1921 (hereinafter referred to as “the said Act”), various powers to alter the Tariff are conferred on the Governor-General in Council:

And whereas by section ten of the said Act it is enacted that the powers conferred on the Governor-General in Council by sections five to nine of that Act (relating to the alteration of the Tariff) shall be exercisable, inter alia, for the purpose of giving effect to any agreement or arrangement entered into by or on behalf of the Government of New Zealand with the Government of any other country for the purpose of promoting trade between those countries: And whereas such an agreement as set out in the Appendix hereto has been duly entered into with the Government of the Commonwealth of Australia: And whereas by section ten of the said Act it is further enacted that no such agreement or arrangement as aforesaid shall have any effect unless and until it is ratified by Parliament: And whereas by the Tariff Agreement (New Zealand and Australia) Ratification Act, 1922, the aforesaid agreement has been duly ratified as required by the said Act: And whereas it is desirable to alter the Tariff pursuant to the powers conferred by the said Act for the purpose of giving effect to the said agreement:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers particularly conferred on him by sections eight and twelve of the said Act, and of all other powers enabling him in that behalf, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby alter the Tariff in so far as it relates to goods imported into New Zealand and being the produce or manufacture of the Commonwealth of Australia in the manner and to the extent set forth in the Appendix hereto, and doth hereby declare that in lieu of the duties and exemptions from duty prescribed by the Customs Amendment Act, 1921, and by an Order in Council thereunder dated the twenty-second day of December, one thousand nine hundred and twenty-one, with respect to goods being the produce or manufacture of the Commonwealth of Australia, there shall be payable on all goods to which the aforesaid agreement relates, being the produce or manufacture of the Commonwealth of Australia, and imported or entered for home consumption in New Zealand on or after the first day of September, one thousand nine hundred and twenty-two, the rates of Customs duties (if any) provided for in the said agreement (being, with respect to goods of the classes therein numbered consecutively from one to one hundred and twenty-nine, the duties set forth in the column of the Schedule to the agreement headed “Proposed Duties against Australia”; and being, with respect to other classes of goods, the rates for the time being applicable to goods of the same class being the produce or manufacture of the United Kingdom). The Order in Council aforesaid of the twenty-second day of December, one thousand nine hundred and twenty-one, is hereby accordingly declared to be revoked as from the said first day of September, one thousand nine hundred and twenty-two, save so far as it applies to goods entered for home consumption before that date.
