CROWN LANDS NOTICES.

Land in Canterbury Land District for Lease by Public Tender.

District Lands and Survey Office,
Christchurch, 4th July, 1922.

NOTICE is hereby given that written tenders for the lease of the undermentioned land will be received at this office up to 4 o’clock p.m. on Tuesday, 8th August, 1922, under the Land Act, 1908, and amendments. The highest or any tender will not necessarily be accepted.

SCHEDULE.

CANTERBURY LAND DISTRICT.

ALL that piece of the Orari River bed adjoining Lot 48, Block VI, Geraldine Survey District: Area, 15 acres; minimum annual rental, £1 10s.

This is an isolated piece of river-bed mainly covered in gorse, but suitable for grazing.

ABSTRACT OF TERMS AND CONDITIONS OF LEASE.

  1. The lease will be from year to year, terminable at any time; possession on acceptance of tender.

  2. The rent shall be paid half-yearly in advance.

  3. No compensation can be claimed by the lessee, nor shall any be allowed by the Government, on account of any improvements effected by the lessee, nor on account of the aforesaid possible resumption; but the tenant shall have the right to remove any fencing or buildings he may have erected during his term of occupancy.

  4. The lessee shall have no right to sublet, transfer, or otherwise dispose of the land comprised in the lease without the written consent of the Commissioner of Crown Lands first had and obtained.

  5. The lessee shall prevent the growth and spread of gorse, broom, and sweetbrier on the land comprised in the lease, and he shall with all reasonable despatch remove, or cause to be removed, all gorse, broom, sweetbrier, or other noxious weeds or plants, as may be directed by the Commissioner of Crown Lands. He shall also destroy all rabbits on the land and prevent their increase or spread.

  6. The lease shall be liable to forfeiture in case the lessee fails to fulfil any of the conditions of the said lease.

Tenders should be marked on envelope “Tender for lease, Orari River bed.”

Timber for Sale by Public Tender, Auckland Forest-conservation Region.

NOTICE is hereby given that written tenders for the purchase of the undermentioned lots of milling-timber will close at the office of the Conservator of Forests, Auckland, at 12 o’clock noon on Wednesday, the 9th day of August, 1922.

SCHEDULE.

Lot 1.

ALL the milling-timber branded X and K situated on Sections 2 and 3, Block X, Pekapekarau Survey District, between Kaihu and Whangarei, and estimated in superficial feet as follows:—

Kahikatea .. .. 507 trees. 760,808 feet.

All the milling-timber branded A and Y situated on Sections 6 and 7, Block XIII, Pekapekarau Survey District, between Kaihu and Whangarei, and estimated in superficial feet as follows:—

Terms of Payment.—One-sixth of purchase-price, together with £1 1s. license fee and £20 half-yearly ground rent, must accompany the tender, and the balance be paid by five equal quarterly instalments from the date of sale.

Lot 3.

430 dry kauri-trees, containing by estimation 710,962 superficial feet, branded V, II, and X, situated in Block VII, Waipoua Survey District, about nine miles from Kaihu Railway-station.

Upset price, £1,810.

Terms of Payment.—One-sixth of purchase-price, together with £1 1s. license fee and £5 half-yearly ground rent, must accompany the tender, and the balance be paid by five equal quarterly instalments from the date of sale.

Lot 4.

729 green and dry kauri-trees and 42 rimu-trees, branded V, and estimated to contain 1,185,392 and 59,515 superficial feet respectively, situated in Hastings Survey District, on Black Sawn Creek Watershed, about five miles from Tapu, Firth of Thames.

Upset price, £3,060.

Terms of Payment.—One-sixth of purchase-price, together with £1 1s. license fee and £17 10s. half-yearly ground rent, must accompany the tender, and the balance be paid by five equal quarterly instalments from the date of sale.

Lot 5.

396 green and dry kauri-trees, branded V, estimated to contain 746,617 superficial feet, and situated in Omahuta State Forest, about fifteen miles from Kohukohu.

Upset price, £2,270.

Terms of Payment.—One-sixth of purchase-price, together with £1 1s. license fee and £8 5s. ground rent, must accompany the tender, and the balance be paid by five equal quarterly instalments from the date of sale.

The time for the removal of the timber from each lot will be eighteen months.

All instalment-payments shall be secured by “On demand” promissory notes made and endorsed to the satisfaction of the Conservator of Forests, and interest at the rate of 5 per cent. per annum will be charged on all notes overdue from the date of maturity to the date of payment.

CONDITIONS OF SALE.

  1. The right to cut and remove the timber will be sold in accordance with the terms of the Forests Act, 1921–22, the regulations made thereunder, and the following conditions.

  2. Intending tenderers are expected to visit the locality and to satisfy themselves in every particular on all matters relative to the sale.

  3. The aforementioned quantities, qualities, and kinds as to the said timber shall be taken as sufficiently accurate for the purposes of this sale, and no contract for the purchase shall be voidable, nor shall the successful purchaser be entitled to any abatement in price, by reason of the said timber being of less quantity, quality, or kind than as stated herein or in any advertisement having reference to the said timber.

  4. The promissory notes will be presented at intervals as indicated in the terms of payment, but they may be presented for payment at an earlier date if it is found that more than a due proportion of the timber has been cut, or should any breach of the conditions occur, or if in the opinion of the Conservator the interests of the Crown are being jeopardized.

  5. Each tenderer must state the total price that he is prepared to pay for each species. The highest or any tender will not necessarily be accepted, and the timber described is submitted for sale subject to the final acceptance of the tender by the Commissioner of State Forests.

  6. A return, verified by affidavit, giving the number of logs cut of each species and their contents, must be made quarterly by the licensee each quarter ending on the last day of June, September, December, and March respectively in each year. A return, similarly verified, must be made quarterly on the same dates showing the output of sawn timber of each species.

  7. All timber must be cut to the best advantage, and cutting operations must be carried on regularly and generally in a manner approved of by the Conservator.

  8. The settlement of any disputes shall be effected by the Conservator, and there will be a right of appeal to the Commissioner of State Forests, whose decision in all cases shall be final. Should the licensee fail to fulfil any and every obligation incumbent upon him the license will be subject to cancellation.

  9. The Commissioner of State Forests may authorize the laying-down and working of tram-lines through the land by other persons than the licensees.
