Partial Revocation of an Order in Council under Section 296 of the Native Land Act, 1909.

ORDER IN COUNCIL.

At the Government House at Wellington, this 5th day of September, 1921.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS by section two hundred and ninety-six of the Native Land Act, 1909, it is enacted that any Order in Council made under Part XVI of that Act, or under Part II of the Native Land Settlement Act, 1907, may be at any time revoked, either wholly or as to any part or parts of the land included therein, by the Governor-General by Order in Council:

And whereas the land set out in the Schedule hereto became subject, by virtue of an Order in Council dated the eighteenth day of February, one thousand nine hundred and eight, to the provisions of Part XVI of the Native Land Act, 1909:

And whereas the Tairawhiti District Maori Land Board has recommended that such land be no longer subject to Part XVI aforesaid:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby revoke the said Order in Council dated the eighteenth day of February, one thousand nine hundred and eight, in so far as such Order in Council affects the land set out in the Schedule hereto.

Prohibiting all Alienation of certain Native Land other than Alienation in favour of the Crown.

At the Government House at Wellington, this 5th day of September, 1921.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

ON the recommendation of the Native Land Purchase Board, referred to in section three hundred and sixty-three of the Native Land Act, 1909, and in exercise of the power in this behalf conferred upon him by that section, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby prohibit, for the period of one year from the date of this Order in Council, all alienation of the Native lands specified in the Schedule hereto other than alienation in favour of the Crown.

Regulations and Rates for Grouping of Telephone Exchange Subscribers’ Lines after Exchange closed.

At the Government House at Wellington, this 5th day of September, 1921.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the power and authority vested in him by the Post and Telegraph Act, 1908, for fixing and determining the fees and rates to be demanded for telephone-exchange connections, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby make regulations and prescribe the rates set forth in the Schedule hereto for the grouping of subscribers’ lines for the purpose of intercommunication after the exchange is closed; and doth declare that such regulations shall have effect from the date of publication of this Order in Council in the New Zealand Gazette.

SCHEDULE.

GROUPING OF SUBSCRIBERS’ LINES AFTER EXCHANGE CLOSED.

  1. IN the case of a telephone exchange which is not open continuously, the Minister of Telegraphs may agree to a group of two or more lines being joined together at the switchboard for the purpose of providing means of intercommunication outside the ordinary hours of exchange attendance.

  2. Such connections shall be made only at certain approved exchanges for which the arrangement is authorized, and any approval given may be withdrawn and the arrangement terminated without prejudice if and when a change of exchange equipment or system renders it impracticable to give such service.

  3. The charges shall be as follows for each line so connected:—

(a.) At an exchange with 151 subscribers and over, 10s. per annum.

(b.) At an exchange with 150 subscribers or less, 5s. per annum.

  1. The fee as aforesaid shall be payable half-yearly in advance, together with the ordinary telephone-exchange rental charge, and in the case of a party line the agent shall be responsible for the collection and payment of the fee.

  2. The number of individual subscribers connected in one group shall not exceed ten in cases where the whole of the lines so connected are held by exclusive subscribers, but if the lines connected together consist either partially or wholly of party lines, the number of individual subscribers shall not exceed fourteen.

  3. No line shall be connected to more than one group.

  4. Prior to the formation of a group, the approved form of agreement shall be signed by each of the subscribers desirous of being so grouped, and before an additional subscriber may be added to the group a fresh agreement shall be signed by all the parties.

  5. A party line shall not be joined to a group unless every subscriber on the party line signs the agreement.

  6. Notwithstanding the provisions of regulations 5, 6, 7, and 8, if the Department considers such an arrangement practicable, an exchange subscriber may, in case of sickness or other like emergency, be connected outside the ordinary hours of exchange attendance with a local doctor, or with a group of which the doctor’s connection forms part, and such connection shall be free of charge. This free night service is limited to the special requirements mentioned and to a period of one week.

  7. The Department will allot to subscribers special-code calls to be used exclusively for intercommunicating outside the ordinary hours of exchange attendance with other subscribers of a group.

The Northern Side of Portion of John Street, in the Borough of New Plymouth, exempted from the Provisions of Section 117 of the Public Works Act, 1908.

ORDER IN COUNCIL.

At the Government House at Wellington, this 5th day of September, 1921.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1908, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the New Plymouth Borough Council on the eighteenth day of April, one thousand nine hundred and twenty-one, viz.:—

“That the New Plymouth Borough Council, being the local authority having control of the street hereinafter mentioned, hereby resolves and declares that the provisions of section one hundred and seventeen, subsection one, of the Public Works Act, 1908, shall not apply to the following portions of streets within the Borough of New Plymouth,—

“(a.) That portion of the eastern side of Gover Street to which Subdivisions 3 to 12 (both inclusive) of Sections 1686, 1687, 1688, 1713, 2334, part P, part Sections 1752, 1774, 1801, 1802, 1803, and part John Street Deviation (closed) have frontages;

“(b.) That portion of the northern side of John Street to which Subdivisions 12 and 13 of Sections 1686, 1687, 1688, 1713, 2334, part P, part Sections 1752, 1774, 1801, 1802, 1803, and part John Street Deviation (closed) have frontages;

“(c.) That portion of the southern side of Gilbert Street to which Subdivisions 1, 2, and 15 of Sections 1686, 1687, 1688, 1713, 2334, part P, part Sections 1752, 1774, 1801, 1802, 1803, and part John Street Deviation (closed) have frontages”;
