The Eastern Side of Portions of Holmwood Road, in the City of Wellington, exempted from the Provisions of Section 117 of the Public Works Act, 1908.

ORDER IN COUNCIL.

At the Government House at Wellington, this 30th day of August, 1921.

Present:

His Excellency the Governor-General in Council.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1908, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolutions (two) passed by the Wellington City Council on the seventh day of July, one thousand nine hundred and twenty-one, and the twenty-first day of July, one thousand nine hundred and twenty-one, viz.:

(1.) “The Wellington City Council, being the local authority having control of the streets in the City of Wellington, hereby declares that the provisions of section one hundred and seventeen of the Public Works Act, 1908, shall not apply to that portion of the eastern side of Holmwood Road beginning at the southern corner of Lot 42 and extending for a distance of 169·2 links, being whole frontage of Lots 42 and 43, D.P. 889, being part Section 12, Ohio Registration District, Block X, Port Nicholson Survey District;

(2.) “The Wellington City Council, being the local authority having control of the streets in the City of Wellington, hereby declares that the provisions of section one hundred and seventeen of the Public Works Act, 1908, shall not apply to all that portion of the eastern side of Holmwood Road beginning at the north-western corner of the right-of-way between Lots 29 and 44 and extending for a distance of 205·69 links, being whole frontage of Lot 44, D.P. 889, being part Section 12, Ohio Registration District”;

such portions of street being described in the Schedule hereto.

SCHEDULE.

ALL that portion of street, situated in the Wellington Land District, City of Wellington, known as Holmwood Road, fronting Lots 42 and 43, D.P. 889, being part Section 12, Ohio Registration District.

Also all that portion of street, situated in the said land district and city, known as Holmwood Road, fronting Lot 44, D.P. 889, being part Section 12, Ohio Registration District.

As the said portions of street are more particularly delineated on the plans marked P.W.D. 52183 and 52342 respectively, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Land District, and thereon coloured red.

The Western Side of Portion of Grey Street, the Southern Side of Portion of Kerr Street, and the Northern Side of Portion of Rattray Street, in the Borough of Devonport, exempted from the provisions of Section 117 of the Public Works Act, 1908, subject to a Condition as to the Building-line.

His Excellency the Governor-General in Council.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1908, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Devonport Borough Council on the eighteenth day of May, one thousand nine hundred and twenty-one, viz.,—

“The Devonport Borough Council, having control of those streets known as Grey, Kerr, and Rattray Streets, by resolution declares that the provisions of section one hundred and seventeen of the Public Works Act, 1908, shall not apply to that portion of the said streets as indicated on sketch plan and coloured brown”;

subject to the condition that no building or part of a building shall at any time be erected on the western side of the portion of Grey Street, the southern side of the portion of Kerr Street, and the northern side of the portion of Rattray Street described in the Schedule hereto within a distance of thirty-three feet from the centre-line of the said portions of Grey and Kerr Streets, and thirty feet from the centre-line of the said portion of Rattray Street.

SCHEDULE.

ALL that portion of street, situated in the North Auckland Land District, Borough of Devonport, known as Grey Street, abutting on part Lot 13, D.P. 669, of Allotments 19 and 20A, Section 2, Parish of Takapuna.

Also all that portion of street, situated in the said land district and borough, known as Kerr Street, abutting on part Lot 13 aforesaid.

Also all that portion of street, situated in the said land district and borough, known as Rattray Street, abutting on part Lot 13 aforesaid.

As the said portions of street are more particularly delineated on the plan marked P.W.D. 50851, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Land District, and thereon coloured brown.

Prescribing the Rate of Interest to be paid by the Wairoa Electric-power Board in respect of £30,000, being Part of a Loan of £100,000 authorized to be raised for the Construction of Electric Transmission-lines between Waikaremoana and Wairoa.

ORDER IN COUNCIL.

At the Government House at Wellington, this 30th day of August, 1921.

Present:

His Excellency the Governor-General in Council.

WHEREAS section eleven of the Finance Act, 1921, provides that, notwithstanding anything to the contrary in any Act or in any rule of law, where a local authority or public body has been authorized before the passing of the said Act, or is thereafter authorized, to borrow money, whether pursuant to a poll of ratepayers or otherwise howsoever, at a specified rate of interest, or for a specified term exceeding ten years, and such money or any part thereof has not been borrowed, the local authority may, with the precedent consent of the Minister of Finance, borrow such money, or such amount thereof as has not been borrowed, at such rate of interest, or for such term not less than ten years, as may be prescribed by the Governor-General by Order in Council:

And whereas the Wairoa Electric-power Board has been authorized to borrow the sum of one hundred thousand pounds for the construction of electric transmission-lines, and is now desirous of borrowing the sum of thirty thousand pounds, being part of the one hundred thousand pounds, at an increased rate of interest:

And whereas the Minister of Finance has given his precedent consent as required by the above-recited section eleven, and it is desired that the rate of interest at which the said thirty thousand pounds may be borrowed be increased to not exceeding six per centum:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby prescribe that the rate of interest that may be paid by the Wairoa Electric-power Board in respect of the said thirty thousand pounds shall be a rate not exceeding six per centum, and the said Wairoa Electric-power Board is hereby authorized to borrow the said sum of thirty thousand pounds accordingly.
