Apportioning the Cost of Maintenance, &c., of Gordonton-Motumaho Road Drain in the County of Waikato.

A PROCLAMATION.

WHEREAS under the provisions of the Land Drainage Act, 1908 (hereinafter termed “the said Act”), a Commission was appointed and an inquiry was duly held with a view to determining what local authority could most conveniently and efficiently control the Gordonton-Motumaho Road drain situated on the northern portion of the Gordonton-Motumaho Road, in the County of Waikato (and hereinafter referred to as “the said drain”), and what proportion of the cost of maintaining, repairing, improving, or reconstructing the said drain should be paid by any, and, if so, which, local authority or authorities: And whereas such Commission did report to the Governor-General, after due inquiry, its opinion as to the matters respecting which it was appointed to report: And whereas it is expedient to make provision under the said Act for the purposes and in the manner hereinafter set forth:

Now, therefore, I, John Rushworth, Viscount Jellicoe, the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the power and authority vested in me by the said Act, and all other powers and authorities in anywise enabling me in this behalf, do hereby proclaim and direct as follows, that is to say:—

  1. That the said drain shall from and after the date of this Proclamation be under the exclusive care, control, and management of the Waikato County Council.

  2. I fix and determine that the future cost of maintaining, repairing, improving, or reconstructing the said drain shall be provided and paid from time to time by the under-mentioned local authorities, in the proportion set opposite the name of each local authority, that is to say,—

The Woodlands Drainage Board, in the proportion of nineteen-twentieths of such cost.

The Waikato County Council, in the proportion of one-twentieth of such cost.

  1. I direct that any payment hereby required to be made as aforesaid by the Woodlands Drainage Board shall be paid from time to time, in the proportions hereinbefore fixed and determined, out of the funds under the control of the said Drainage Board, within a period of thirty days after demand in writing made by or on behalf of the Waikato County Council; and all such payments shall be made from time to time to the County Clerk of the said County Council, for and on account of such County Council.

  2. And I further direct that the costs, charges, and expenses of and incidental to the inquiry by the Commission aforesaid touching and concerning the premises shall be paid and borne by the said Woodlands Drainage Board.

Given under the hand of His Excellency the Governor-General of the Dominion of New Zealand; and issued under the Seal of that Dominion, at the Government House at Wellington, this 4th day of July, 1921.

A PROCLAMATION.

IN pursuance of the power and authority conferred upon me by section four of the Discharged Soldiers Settlement Act, 1915, I, John Rushworth, Viscount Jellicoe, Governor-General of the Dominion of New Zealand, do hereby proclaim and declare that the area of Crown land described in the Schedule hereto shall be and the same is hereby set apart and declared open for disposal by way of sale or lease to discharged soldiers, under special tenures, in the manner provided in the said Act.

WELLINGTON LAND DISTRICT.—CROWN LAND.

Waimarino County.

Sections 18 and 30, Block III, Makotuku Survey District: Area, 190 acres 2 roods 20 perches.

Given under the hand of His Excellency the Governor-General of the Dominion of New Zealand; and issued under the Seal of that Dominion, at the Government House at Wellington, this 5th day of July, 1921.
