Regulations under the Provisions of the Naval Defence Act, 1913.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 20th day of June, 1921.

IN pursuance and exercise of the powers and authorities conferred on
me by section twenty-five of the Naval Defence Act, 1913 (hereinafter called "the said Act"), and of all other powers and authorities enabling me in that behalf, I, John Rushworth, Viscount Jellicoe, Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, do hereby revoke the regulations made under the said Act by Order in Council dated the twentieth day of August, one thousand nine hundred and fourteen, and in lieu thereof do hereby make the regulations set out in the Schedule hereto under and for the purposes of the said Act.

SECTION I.—GENERAL INSTRUCTIONS.

  1. Designation of the Naval Forces of the Dominion.—The ships and personnel comprising the New Zealand Naval Forces shall be described respectively as forming and belonging to "the New Zealand Division of the Royal Navy," which shall be the official designation of the Force.

  2. Government of the New Zealand Division of the Royal Navy.—The New Zealand Division of the Royal Navy shall be subject to such Acts as have been or from time to time may be passed by the Dominion Parliament, and to such regulations in agreement therewith as may be made from time to time.

  3. Every officer of the New Zealand Division of the Royal Navy shall make himself acquainted with, and shall duly observe, obey, and, so far as he is able, enforce these regulations and such further regulations, orders, or instructions as may be issued by the Naval Board or with their authority.

  4. The Commanding Officer of the Depot Ship or Establishment shall be the Superintendent of Training and Director of Recruiting for new entries into the New Zealand Division, and, subject to the authority of the Naval Board and to such orders as may be issued from time to time, shall be responsible for all matters connected therewith.

  5. Flags flown in Ships of the New Zealand Division.—All ships of the New Zealand Division in commission shall fly the white ensign in the position laid down in the King's Regulations, and, at the jackstaff, the distinctive flag of New Zealand in lieu of the Union Jack.

  6. The distinctive flags and pendants of Naval authorities shall accord to H.M. Naval service pattern.

  7. Leave of Absence to Officers and Men.—Officers lent from the Royal Navy shall be subject to such regulations regarding leave of absence as apply in the Royal Navy, and be entitled to foreign-service leave at the expiration of their service in the New Zealand Division on the scale laid down in regulations issued by the Admiralty.

  8. Officers permanently transferred to or who have regularly joined the New Zealand Division shall be entitled to forty-two days' leave per annum if serving in sea-going ships, or thirty-five days per annum if serving in harbour-ships and shore establishments.
