Declaring Portion of Mapua – Upper Moutere Road to Appleby, in the Waimea West Road District, to be a District Road.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 16th day of May, 1921.

Present:

THE HONOURABLE SIR F. H. D. BELL, K.C.M.G.,
PRESIDING IN COUNCIL.

IN pursuance and exercise of the powers vested in him by the Public Works Act, 1908, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and declare that the portion of road described in the Schedule hereto shall, on and after the date of this Order in Council, become a district road.


SCHEDULE.

ALL that portion of Mapua – Upper Moutere Road to Appleby in the Nelson Land District, Waimea West Road District, commencing at the boundary between the Upper Moutere Road District and the Waimea West Road District, and proceeding thence generally in a south-easterly direction, adjoining or passing through Sections 26, 27, 28, 29, 30, 21, 20, and 31, Block I, Waimea Survey District, and terminating at its junction with the Waimea West Road opposite the boundary between Sections 18 and 45, Block I, Waimea Survey District; being a distance of 2 miles 34 chains, more or less. As the said portion of road is more particularly delineated on the plan marked P.W.D. 51393, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Land District, and thereon coloured red.

Declaring that certain Native Lands are vested in the Native Trustee.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 16th day of May, 1921.

Present:

PRESIDING IN COUNCIL.

WHEREAS the lands mentioned in the Schedule hereto were vested in the Public Trustee under the Native Reserves Act, 1882, and were leased by the Public Trustee under the provisions of the Nelson and Westland Native Reserves Act, 1887: And whereas some of the leases will expire shortly:

And whereas, without the knowledge or consent of the Public Trustee, land transfer certificates of title were issued in respect of some of the said lands (in the names of the original Native owners as ascertained in the year 1879), under the authority of section two of the Native Reserves Titles Grant Empowering Act, 1886, and section four hundred and thirty-six of the Native Land Act, 1909:

And whereas in consequence thereof the question arose whether such titles were still vested in the Public Trustee under the Native Reserves Act, 1882, and it is expedient to settle any doubt thereon:

And whereas by section five of the Native Reserves Act Amendment Act, 1895, it is enacted that if any question arises whether any land is vested in the Public Trustee under the Native Reserves Act, 1882, the Governor-General may by Order in Council declare that such land is so vested:

And whereas all Native reserves are by virtue of the Native Trustee Act, 1920, transferred to and vested in the Native Trustee:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred by the Native Reserves Act Amendment Act, 1895, and the Native Trustee Act, 1920, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby declare that the lands set out in the Schedule hereto are vested in the Native Trustee under and subject to the provisions of the Native Reserves Act, 1882, and the Native Trustee Act, 1920, and any Acts read or incorporated therewith.

ALL those parcels of land known as Section 2, Block IV, Inangahua Survey District; Section 45, Square 141, Block VII, Kawatiri Survey District; Section 47, Square 141, Block III, Kawatiri Survey District; Sections 105, 121, 126, 143, 218, 249, 250, 257, 262, 267, 373, 380, 414, 516, Town of Westport; Sections 147, 181, 182, 272, 281, 292, 390, 399, Town of Westport; Sections 163, 297, 405, 459, 460, 522, 579, 630, 637, 991, Town of Westport; Sections 357, 599, 644, 672, 692, 715, 721, 732, Town of Westport; all in County of Buller, in the Provincial District of Nelson; being the land more particularly described in Vol. 43, folios 189, 190, 191, 192, 193, 194, and 195, in the Nelson Land Registration District.

Extending Time for holding Annual Meeting of Councillors in Ashley County.

ORDER IN COUNCIL.

At the Government House at Wellington, this 25th day of May, 1921.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS by section seventy-seven of the Counties Act, 1920 (hereinafter termed “the said Act”), it is provided that the annual meeting of the various County Councils throughout the Dominion shall be held on the fourth Wednesday in May:

And whereas it is expedient to extend the time for holding such meeting in the Ashley County:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in exercise of the powers and authorities vested in him by section two hundred and sixteen of the said Act, and of all other powers in anywise enabling him in this behalf, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby extend the time for holding the annual meeting of the Ashley County Council, and doth hereby order and declare that in the aforesaid county the said annual meeting shall be held and take place on Thursday, the second day of June, one thousand nine hundred and twenty-one.

Extending Prohibition of Alienation of certain Native Land other than Alienation in favour of the Crown.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 16th day of May, 1921.

Present:

THE HONOURABLE SIR F. H. D. BELL, K.C.M.G.,
PRESIDING IN COUNCIL.

ON the recommendation of the Native Land Purchase Board, referred to in section three hundred and sixty-three of the Native Land Act, 1909, and in exercise of the power in this behalf conferred upon him by that section, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council thereof, doth hereby extend for a further period of six months the Order in Council dated the twenty-eighth day of June, one thousand nine hundred and twenty, and gazetted the first day of July, one thousand nine hundred and twenty, prohibiting all alienation of the land specified in the Schedule hereto other than alienation in favour of the Crown.
