Lands in the Auckland Land District forfeited.

Department of Lands and Survey, Wellington, 16th May, 1921.

NOTICE is hereby given that the leases and licenses of the undermentioned lands having been declared forfeited by resolution of the Auckland Land Board, the said lands have thereby reverted to the Crown, under the provisions of the Land Act, 1908, and the Discharged Soldiers Settlement Act, 1915.

Timber in North Auckland Land District for Sale by Public Tender.

North Auckland District Lands and Survey Office,
Auckland, 16th May, 1921.

NOTICE is hereby given that written tenders for the purchase of the undermentioned milling timber will be received from dairying companies, sawmillers, and others at the North Auckland District Lands and Survey Office, Auckland, up to 12 o’clock noon on Monday, 4th July, 1921, under the provisions of the Land Act, 1908, and the Forest Regulations thereunder.

SCHEDULE.

NORTH AUCKLAND LAND DISTRICT.—HOKIANGA COUNTY.

Lot 1. Sections 62, 63, 64, Block IX, Mangamuka Survey District :—

1,272 rimu-trees, containing about 1,391,708 sup. feet.

Undersized, defective, and isolated trees : All totara trees and 59 isolated trees branded “ F.R. ” are excluded from this sale, and are reserved for settlement purposes, and must not be cut by the licensee.

Lot 2. Section 85, Block IX, Waoku Survey District :—

375 kauri-trees, containing about 833,444 sup. feet.

Upset price : £3,450.

Undersized, defective, and isolated trees : All totara-trees are excluded from this sale and are reserved for settlement purposes, and must not be cut by the licensee.

Conditions of Sale.

  1. Intending tenderers are expected to visit the locality and satisfy themselves in every particular on all matters relating to their tenders.

  2. The right is reserved to the Commissioner of Crown Lands to withdraw from sale the above lots of timber.

  3. The aforementioned quantity, quality, and kind as to the said timber shall be taken as sufficiently accurate for the purpose of this sale, and no contract for purchase shall be voidable, nor shall the purchaser be entitled to any abatement in price, by reason of the said timber being of less quantity, quality, and kind than as stated herein or in any advertisement having reference to the said timber, nor shall any extra sum be claimed by the Crown if the said quantity of timber is found to be in excess of that stated herein.

  4. All timber, whether standing, felled, or in logs, shall remain the property of the Crown until the instalments are paid.

  5. Should any dispute arise as to the boundaries, the decision of the Commissioner of Crown Lands shall be final.

  6. In the event of either or both of the lots not being disposed of, applications may be received and dealt with at any time within six months from date of sale (unless previously formally withdrawn); provided, however, that the amount offered is not less than the upset price stated herein.

  7. Tenders must state a lump sum, and must be accompanied by a deposit of 5 per cent. on the amount of tender in cash, marked cheque, or post-office order; the balance to be paid, if tender accepted, in terms as stated hereunder.

  8. The highest or any tender not necessarily accepted.

Regulations 58 and 114 of the Forest Regulations, relative to the protection of small trees and to the cutting of timber specially excluded from this sale, will be strictly enforced.

The sale of the above timber will be subject to the restrictions of export of timber from the Dominion.

Terms of Payment.

Lot 1.—One-third of amount of tender to be paid in cash within seven days after acceptance of tender (together with £1 1s. license fee), one-third in eight months, and one-third in sixteen months thereafter.

Lot 2.—One-half of amount of tender to be paid in cash within seven days after acceptance of tender (together with £1 1s. license fee), one-half in six months thereafter.

All instalment payments shall bear interest at the rate of 5 per cent. per annum as from the date of acceptance of tender,
