Height, 22 feet.\nRemarks.—The light will be unwatched. (standing\nmeasurement).\nDistinguishing brand: A.\nUpset price: £2,115.\nTerms for payment: Half in cash, together with timber-\ncutting license fee £1 ls., and half in six months thereafter.\nTime for removal of timber: One year.\nAbout fourteen isolated kauri-trees (unbranded), as approxi-\nmately shown on plan, not included in this sale (subject to\ncondition 5).\nCONDITIONS OF SALE.\n1. Intending tenderers are expected to visit the locality\nand satisfy themselves in every particular on all matters\nrelating to the sale.\n2. The right is reserved to the Commissioner of Crown\nLands to withdraw from sale the above lot of timber.\n3. The aforementioned quantity, quality, and kind as to\nthe said timber shall be taken as sufficiently accurate for the\npurpose of this sale, and no contract for purchase shall be\nvoidable, nor shall the purchaser be entitled to any abate-\nment in price, by reason of the said timber being of less\nquantity, quality, and kind than as stated herein or in any\nadvertisement having reference to the said timber, nor shall\nany extra sum be claimed by the Crown if the said quantity\nof timber is found to be in excess of that stated herein.\n4. All timber, whether standing, felled, or in logs, shall\nremain the property of the Crown until paid for.\n5. The quantity stated is standing measurement, and only\nthose trees bearing the special distinguishing brand are in-\ncluded in the sale, but an offer may be made by the success-\nful tenderer for the fourteen isolated kauri-trees not included\nin the sale.\n6. Should any dispute arise as to the boundaries, the deci-\nsion of the Commissioner of Crown Lands shall be final.\n7. In the event of the lot not being disposed of, applica-\ntions may be received and dealt with at any time within six\nmonths from date of sale (unless previously formally with-\ndrawn); provided, however, that the amount offered is not\nless than the upset price stated herein.\n8. Tenders must be accompanied by a deposit of 5 per\ncent. on the amount of tender in cash, marked cheque, or\npost-office order; the balance of the first payment to be\npaid within thirty days of date of accepting of tender. The\ninstalment payment shall bear interest at the rate of 5 per\ncent. per annum as from the date of sale, and, with the\ninterest added, shall be secured by an “on demand” pro-\nmissory note made and endorsed to the satisfaction of the\nCommissioner.\n9. The highest or any tender not necessarily accepted.\nTenders to be addressed “Commissioner of Crown Lands,”\nand envelopes to be marked “Tender for Timber.”\nPlans and conditions of sale may be seen at the Whenua-\nkite Post-office, or at the Lands and Survey Office, Auckland.\nH.
