And whereas it has been determined to construct and maintain a further portion of the said railway:

Now, therefore, I, Arthur William de Brito Savile, Earl of Liverpool, the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred upon me by the Public Works Act, 1908, and of every other power and authority in anywise enabling me in this behalf, do hereby proclaim and declare that the middle-line of the said further portion of the said railway shall be that defined and set forth in the Schedule hereto.

SCHEDULE.

COMMENCING at a point in Hereheretau B 2 Block, Block VIII, Clyde Survey District, marked 9 miles 0 chains, which point is the point of termination of the railway described in a Proclamation dated the 24th day of February, 1920, and published in the New Zealand Gazette No. 21, of the 26th day of the same month, and proceeding thence generally in an easterly direction, and passing in, into, through, over, or under the following lands, &c.—viz., Hereheretau B 2 Block, Blocks VIII, Clyde Survey District, and IV, Nuhaka Survey District; Kahaatureia No. 7 Block, Block IV, Nuhaka Survey District; Subdivisions Nos. 1, 2B 2, 2A 1, 2A 2, 3A 2, 3B 2, 3B 1, 3C 2B, 3C 2A, and 4A of the Opoho Block, Block V, Nuhaka Survey District; Subdivisions 9B, 9C, 8B, 8A, 11A, 11B 1, 11B 2, 7, 6A, 6B, 5B, 4, 3, 2B, 2D, 1A, 1B, and 1C of Nuhaka 2A 4A Block, Block VII, Nuhaka Survey District; Sections 4 and 5 and Subdivisions 2F 2A and 2F 2B of Nuhaka Block, Block VII, Nuhaka Survey District; Subdivisions 2E 3C 12, 2E 3C 13A, 2E 3C 13B, 2E 3C 14, 2E 3C 15B, 2E 3C 15C, 2E 3A 6, 2E 3A 8, 2E 3A 7, of the Nuhaka Block, Block VIII, Nuhaka Survey District; Sections 148 and 137, Subdivision 2C 1, education reserve, Sections 127, 122, 111, 112, 116, 118, 214, 121, 251, 252, of the Nuhaka Township, Block VIII, Nuhaka Survey District; Sections 2C 2D and 2C 2N of the Nuhaka Block, Block VIII, Nuhaka Survey District; Sections 2, 16, and 17, Block IX, Nuhaka Survey District; Sections 1, 2, and 3, Block X, Nuhaka Survey District; Blocks 2 and 1, Waikokopu Harbour Reserve, Block X, Nuhaka Survey District; and terminating at a point in the said Block I, Waikokopu Harbour Reserve, marked 23 miles 15 chains: including all adjoining and intervening places, lands, reserves, roads, tracks, lakes, rivers, streams, and watercourses: all in the Hawke’s Bay Land District. As the same is delineated on the plan marked P.W.D. 48369, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Land District.

Given under the hand of His Excellency the Right Honourable Arthur William de Brito Savile, Earl of Liverpool, Member of His Majesty’s Most Honourable Privy Council, Knight Grand Cross of the Most Distinguished Order of Saint Michael and Saint George, Knight Grand Cross of the Most Excellent Order of the British Empire, Member of the Royal Victorian Order, Knight of Justice of the Order of Saint John of Jerusalem, Governor-General and Commander-in-Chief in and over His Majesty’s Dominion of New Zealand and its Dependencies; and issued under the Seal of the said Dominion, at the Government House at Wellington, this third day of May, in the year of our Lord one thousand nine hundred and twenty.

Defining the Middle-line of a Portion of the Waikokowai Branch Railway, from the Huntly-Awaroa Railway from a Point in the existing Railway Reserve in Section 39, Pepepe Parish, Block XV, Rangiriri Survey District, to a Point in Section 37, Pepepe Parish, Block X, Rangiriri Survey District (0 M. to 3 M.).

A PROCLAMATION.

WHEREAS a branch railway from the Huntly-Awaroa Railway from a point in the existing railway reserve in Section 39, Pepepe Parish, Block XV, Rangiriri Survey District, to a point in Section 37, Pepepe Parish, Block X, Rangiriri Survey District (0 M. to 3 M.), (hereinafter termed “the said railway”), is a portion of the railway the construction of which is authorized by the Railways Authorization Act, 1919:

And whereas it has been determined to construct and maintain the said railway:

Now, therefore, I, Arthur William de Brito Savile, Earl of Liverpool, the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred upon me by the Public Works Act, 1908, and of every other power and authority in anywise enabling me in this behalf, do hereby proclaim and declare that the middle-line of the said railway shall be that defined and set forth in the Schedule hereto.

SCHEDULE.

COMMENCING at a point in the existing railway reserve in Section 39, Pepepe Parish, Block XV, Rangiriri Survey District, marked 0 M., which point is also marked 0 M. 38-55 Ch. P.W. chainage on Huntly-Awaroa Railway described in a Proclamation dated the 27th day of February, 1911, and published in the New Zealand Gazette No. 16, of the 2nd day of March, 1911, and proceeding thence in a westerly direction along the northern shore generally of Wahi Lake for a distance of about three miles, and passing in, into, through, or over the following lands, &c.—viz., railway reserve, Sections 40 and 44, Pepepe Parish, Block XV, Rangiriri Survey District; Sections 26, 27, 28, 29, 30, 31, 32, 33, 34, 35, 36, 37, Pepepe Parish, Blocks X and X1, Rangiriri Survey District; and terminating at a point marked 3 M. in the said Section 37, thirty-nine chains west and thirty-two chains south of the northern corner of the said Section 37: including all adjoining and intervening places, lands, reserves, roads, tracks, lakes, rivers, streams, and watercourses: all in the Auckland Land District. As the same is delineated on the plan marked P.W.D. 48428, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Land District.

Revoking Part of a Proclamation taking Land for a Further Portion of the East Coast Main Trunk Railway (Paengaroa Section) and for Road-diversions in connection therewith.

A PROCLAMATION.

WHEREAS by the Public Works Amendment Act, 1909, it is enacted that if at any time after the issue or making of any Proclamation or Order in Council taking land under the Public Works Act, 1908, and before the payment or award of any compensation in respect of the taking thereof, it is found that the land or any part thereof is not required for the purpose for which it was taken, or that any error in form or substance exists in or in relation to that Proclamation or Order in Council, or the making or gazetting thereof, the Governor-General may, by a subsequent Proclamation or Order in Council gazetted, revoke the former Proclamation or Order in Council, either wholly or so far as he thinks necessary:

And whereas it is found that portion of the land taken for a further portion of the East Coast Main Trunk Railway (Paengaroa Section), and for road-diversions in connection therewith, by a Proclamation made under the Public Works Act, 1908, dated the tenth day of August, one thousand nine hundred and seventeen (hereinafter termed “the said Proclamation”), and published in the New Zealand Gazette No. 129, of the sixteenth day of August, one thousand nine hundred and seventeen, is incorrectly described:

And whereas compensation in respect of the land taken by the said Proclamation has not been paid or awarded:

Now, therefore, I, Arthur William de Brito Savile, Earl of Liverpool, the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers vested in me by the Public Works Amendment Act, 1909, and of all other powers enabling me in this behalf, do hereby revoke so much of the said Proclamation as affects the land described in the Schedule hereto.
