ALL that area in the Canterbury Land District, containing by admeasurement 10 acres, more or less, being Reserve 3999, situated in Block XI, Opuha Survey District. Bounded towards the north, east, and south by Section 1, Clayton Settlement, 1000 links, 1000 links, and 1000 links respectively; and towards the west by a public road, 1000 links. As the same is more particularly delineated on the plan marked L. and S. 1/649, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon bordered red.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this fifth day of February, 1920.

WHEREAS by subsection one of section one hundred and seventeen of the Public Works Act, 1908, it is, inter alia, provided that the said section shall not apply in any case where the local authority having control of any road or street by resolution declares that the provisions thereof shall not apply to any specified road or street, or any specified part thereof, and such resolution is approved by the Governor-General in Council:

And whereas by subsection two of section one hundred and seventeen of the Public Works Act, 1908, it is provided that such approval may be either absolute or subject to such conditions with respect to the building-line as the Governor-General, by Order in Council, thinks fit to impose:

And whereas the Wellington City Council, being the local authority having control of the street described in the Schedule hereto, has passed the following resolution—viz., “The Wellington City Council, being the local authority having control of the streets in the City of Wellington, hereby declares that the provisions of section one hundred and seventeen of the Public Works Act, 1908, shall not apply to Leraud Street in the said city”:

And whereas it is deemed expedient that such resolution should be approved:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers conferred by the above-in-part-recited Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the said resolution.

SCHEDULE.

ALL that street in the Wellington Land District, City of Wellington, known as Leraud Street, situated between Adelaide Road and Russell Terrace. As the said street is more particularly delineated on the plan marked P.W.D. 47664, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Land District, and thereon coloured red.

License authorizing the Auckland City Council to erect Electric Lines within the Ellerslie Town District, the One-tree Hill Road District, and the Mount Roskill Road District.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this fifth day of February, 1920.

WHEREAS by section two of the Public Works Amendment Act, 1911, it is provided that no person shall lay, construct, place, put up, or use any electric line except under the authority of a license issued by the Governor-General in Council under that Act:

And whereas the Auckland City Council (hereinafter referred to as “the licensee”) desires to erect lines within the area of supply, as defined in the Schedule hereto, and hereinafter called “the area of supply,” and it is expedient accordingly to issue a license in respect thereof under the said section:

Now, therefore, in pursuance and exercise of the powers conferred upon him by the said section, and of all other powers in anywise enabling him in that behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth, subject to the conditions set forth in the Schedule hereto, and to the regulations made under section two of the aforesaid Act dated the twenty-second day of September, one thousand nine hundred and nineteen, and published in the New Zealand Gazette dated the twenty-fifth day of September, one thousand nine hundred and nineteen, or any regulations hereafter made in substitution therefor, and hereinafter collectively referred to as “the regulations,” hereby authorize the licensee to erect and maintain electric lines for lighting, power, and heating purposes within the area of supply hereinafter described, the roads along which such electric lines are at present proposed to be erected being indicated in pink colour on the plan marked P.W.D. 47282, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Land District.

SCHEDULE.

  1. AREA OF SUPPLY.

THE area of supply comprises the Ellerslie Town District, the One-tree Hill Road District, and the Mount Roskill Road District, as indicated by distinctive borders coloured red on the plan marked P.W.D. 47282 aforesaid.

  1. SYSTEM OF SUPPLY.

The system of supply shall be as described in paragraph (c) of clause 3 of the regulations.

The generating voltage shall be approximately 6,600 volts between the terminals.

  1. DATUM TEMPERATURE.

For the purpose of calculating the stresses as provided in clause 15 of the regulations, the datum temperature shall be taken as 32 degrees Fahrenheit.

  1. CHARGES FOR ELECTRIC ENERGY.

The charge for electrical energy shall not exceed 1s. per unit for lighting purposes, and 6d. per unit for motor-power, heating, or cooking purposes; provided that “lighting purposes” shall include the operation of motor generators for lighting purposes.

  1. DURATION OF LICENSE.

This license shall, unless sooner determined in accordance with the provisions hereinafter expressed, continue in force for a period of forty-two years from the date hereof. Upon the expiry of the said term, or upon the sooner determination of this license by revocation or otherwise, all rights hereby granted to the licensee shall thereupon cease and determine; but such expiration or determination shall not relieve the licensee of any liability theretofore incurred under this license.

  1. REQUIREMENTS OF THE ELLERSLIE TOWN BOARD, THE ONE-TREE HILL ROAD BOARD, AND THE MOUNT ROSKILL ROAD BOARD.

Notwithstanding anything hereinbefore contained, the licensee shall not be entitled to erect, maintain, or use any electric lines within the Ellerslie Town District, the One-tree Hill Road District, and the Mount Roskill Road District except subject to such conditions, not inconsistent with the provisions of this license and the regulations relating thereto, as may from time to time be agreed upon between the licensee and the Ellerslie Town Board, the One-tree Hill Road Board, and the Mount Roskill Road Board.
