And whereas the Government road described in the
Schedule hereto is no longer required for the purpose of
a road:
Now, therefore, I, Arthur William de Brito Savile, Earl of
Liverpool, the Governor-General of the Dominion of New
Zealand, in pursuance and exercise of the above-in-part-
recited Act, and of all other powers in anywise enabling
me in this behalf, do hereby proclaim as stopped the road
described in the Schedule hereto.

SCHEDULE.

APPROXIMATE area of the piece of road hereby stopped:
2 acres 1 rood 27·9 perches.
Being road through Section 20, Block V, Cambridge Survey
District (Auckland R.D.). (S.O. 19510.)

In the Auckland Land District; as the same is more
particularly delineated on the plan marked P.W.D. 45103
(sheet 2), deposited in the office of the Minister of Public
Works at Wellington, in the Wellington Land District, and
thereon coloured green.

Given under the hand of His Excellency the Right
Honourable Arthur William de Brito Savile,
Earl of Liverpool, Member of His Majesty’s
Most Honourable Privy Council, Knight Grand
Cross of the Most Distinguished Order of Saint
Michael and Saint George, Knight Grand Cross
of the Most Excellent Order of the British
Empire, Member of the Royal Victorian Order,
Knight of Justice of the Order of Saint John of
Jerusalem, Governor-General and Commander-
in-Chief in and over His Majesty’s Dominion
of New Zealand and its Dependencies; and

Revoking a Proclamation taking Land for a Further Portion
of the East Coast Main Trunk Railway (Napier North-
wards), Portion of Eskdale Section, and for a Road-diversion
in connection therewith.

A PROCLAMATION.

WHEREAS by the Public Works Amendment Act, 1909,
it is enacted that if at any time after the issue or
making of any Proclamation or Order in Council taking land
under the Public Works Act, 1908, and before the payment
or award of any compensation in respect of the taking thereof,
it is found that the land or any part thereof is not required
for the purpose for which it was taken, or that any error in
form or substance exists in or in relation to that Proclamation
or Order in Council or the making or gazetting thereof, the
Governor-General may, by a subsequent Proclamation or
Order in Council gazetted, revoke the former Proclamation
or Order in Council either wholly or so far as he thinks
necessary:

And whereas it is found that the pieces of land taken for
a further portion of the East Coast Main Trunk Railway
(Napier Northwards), portion of Eskdale Section, and for a
road-diversion in connection therewith, by a Proclamation
made under the Public Works Act, 1908, and dated the
seventh day of November, one thousand nine hundred and
nineteen (hereinafter termed “the said Proclamation”), and
published in the New Zealand Gazette No. 135, page 3513,
of the twentieth day of the same month, are incorrectly
described:

And whereas compensation in respect of the land taken by
the said Proclamation has not been paid or awarded:

Now, therefore, I, Arthur William de Brito Savile, Earl of
Liverpool, the Governor-General of the Dominion of New
Zealand, in pursuance and exercise of the powers vested in
me by the Public Works Amendment Act, 1909, and of all
other powers enabling me in this behalf, do hereby revoke
the said Proclamation.

Authorizing the Special Investment of Five Hundred Pounds
of the Public Trust Office Funds.

LIVERPOOL, Governor-General.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this nineteenth
day of January, 1920.

Present:

THE RIGHT HONOURABLE W. F. MASSEY, P.C., PRESIDING
IN COUNCIL.

WHEREAS by section ninety-one of the Public Revenues
Act, 1910, it is enacted that it shall be lawful to
invest any part of the balance of the Public Trust Office
Account in any securities which shall be declared by the
Governor-General by Order in Council to be securities in
which such balance may be invested:

And whereas the Tauranga Fire Board (hereinafter called
“the said Board”), constituted under the provisions of the
Fire Brigades Act, 1908, and its amendments, has applied
to the Public Trustee to advance to the said Board the sum
of five hundred pounds upon the security hereinafter men-
tioned:

And whereas the Public Trustee is desirous of lending to
the said Board out of the balance of the said Public Trust
Office Funds the said sum of five hundred pounds, repay-
ment whereof is intended to be secured by a deed of covenant
by the said Board with the Public Trustee that the said
Board will include a sum sufficient to meet the annual pay-
ments of principal and interest payable by the said Board
to the Public Trustee in the estimate of the Board’s expendi-
ture under section thirty of the Fire Brigades Act, 1908 (such
security being hereinafter referred to as “the said security”):

And whereas before the said sum of five hundred pounds
can be advanced out of the balance of the Public Trust Office
Account it is necessary that an Order in Council should issue,
pursuant to the statutory provisions hereinbefore recited,
declaring the said security to be one upon which such money
may be invested:

And whereas it is proper that such an Order in Council
should issue:

Now, therefore, I, Arthur William de Brito Savile, Earl
of Liverpool, the Governor-General in and for the Dominion
of New Zealand, acting by and with the advice of the Execu-
tive Council of the said Dominion, do hereby declare that it
shall be lawful for the Public Trustee to invest out of the
balance of the Public Trust Office Account the said sum of
five hundred pounds on the said security.
