ALL that portion of Park Street, situated in the Wellington Land District, City of Wellington, commencing at a point 177·28 links from Grant Road, and proceeding thence in an easterly direction for a distance of 222·72 links, abutting on part Town Acre 649, City of Wellington. As the said portion of street is more particularly delineated on the plan marked P.W D. 50507, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Land District, and thereon coloured red.

The Northern Side of Portion of View Road, in the Borough of Mount Eden, exempted from the Provisions of Section 117 of the Public Works Act, 1908, subject to a Condition as to the Building-line.

At the Government House at Auckland, this 13th day of December, 1920.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1908, and the Public Works Amendment Act, 1911, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Mount Eden Borough Council on the twenty-ninth day of November, one thousand nine hundred and twenty—viz., "The Mount Eden Borough Council, having control of that portion of View Road abutting on Lot 11 and part Lot 6 of Allotment 3 of Section 10, Suburbs of Auckland, as shown on the plan herewith, by resolution declares that the provisions of section one hundred and seventeen of the Public Works Act, 1908, shall not apply to the northern side of that portion of View Road"; subject to the condition that no building or part of a building shall be erected at any time on the northern side of the portion of View Road described in the Schedule hereto within a distance of thirty-three feet from the centre-line of the said portion of street.

SCHEDULE.

ALL that portion of View Road, situated in the North Auckland Land District, Borough of Mount Eden, abutting on part Lot 6 and Lot 11 of Allotment 3 of Section 10, Suburbs of Auckland. As the said portion of street is more particularly delineated on the plan marked P.W.D. 50124, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Land District, and thereon coloured red.

Withdrawing Land from the Operation of the Kauri-gum Industry Act, 1908.

ORDER IN COUNCIL.

At the Government House at Auckland, this 13th day of December, 1920.
Present:

His Excellency The Governor-General in Council.

WHEREAS by section forty-six of the Land Laws Amendment Act, 1913, it is enacted that the Governor-General may, by Order in Council gazetted, on the recommendation of the Land Board, declare that any land comprised in a kauri-gum reserve shall, from a date to be specified in the Order, cease to be subject to the Kauri-gum Industry Act, 1908, and on and after the date so specified the land to which the Order relates shall become subject to the provisions of the Land Act, 1908:

And whereas the Land Board of the North Auckland Land District has duly passed a resolution recommending that the Mangawai No. 3 Kauri-gum Reserve described in the Schedule hereto be excepted from the operations of the Kauri-gum Industry Act, 1908, and it is expedient to give effect to such recommendation:

Now, therefore, I, John Rushworth, Viscount Jellicoe, Governor-General of the Dominion of New Zealand, in pursuance and exercise of the power and authority conferred upon me by section forty-six of the Land Laws Amendment Act, 1913, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and declare that the Mangawai No. 3 Kauri-gum Reserve described in the Schedule hereto shall, from the sixteenth day of December, one thousand nine hundred and twenty, cease to be subject to the Kauri-gum Industry Act, 1908.

SCHEDULE.

ALL that area in the North Auckland Land District, situated in the Parish of Mangawai, containing by admeasurement 401 acres 1 rood 25 perches, being the Mangawai No. 3 Kauri-gum Reserve, as described in the New Zealand Gazette No. 46, of 9th May, 1901, page 1020; excepting areas containing 266 acres 2 roods 15 perches and 732 acres respectively, which have been withdrawn from the reserve.

Also all that area in the North Auckland Land District, situated in Block VII, Ruakaka Survey District, containing by admeasurement 1,485 acres, more or less, and being part of the Marsden Kauri-gum Reserve as described in the New Zealand Gazette No. 79, of the 28th September, 1899, page 1838.
