Validating Proceedings in connection with the Raising of a Loan
by the Council of the Borough of Whakatane.
LIVERPOOL, Governor-General.
ORDER IN COUNCIL.
At the Government Buildings at Wellington, this fifteenth
day of December, 1919.
Present:
THE HONOURABLE SIR WILLIAM FRASER PRESIDING IN
COUNCIL.
WHEREAS the Whakatane Borough Council lately proposed to raise a loan of ten thousand pounds, under
the provisions of the Local Bodies' Loans Act, 1913 (hereinafter called “the said Act”), for the improvement of streets
within the Borough of Whakatane :
And whereas section ten of the said Act provides that the
poll of ratepayers shall be taken not less than one nor more
than three weeks after the day of the last publication of the
notice of intention to raise the loan:
And whereas the poll of ratepayers was taken within one
week after the day of the last publication of the notice of
intention to raise the loan, inasmuch as the last publication
of the said notice appeared in the issue of the Whakatane
Press dated the eighth day of August, one thousand nine
hundred and nineteen, and the poll of ratepayers was held
on the thirteenth day of August, one thousand nine hundred
and nineteen:
And whereas it appears that the ratepayers have not been
misled by such irregularity or defect, and it is expedient to
validate the said proceedings:
Now, therefore, His Excellency the Governor-General of
the Dominion of New Zealand, in pursuance and exercise of
the powers and authorities conferred on him by section one
hundred and eleven of the Local Bodies' Loans Act, 1913,
and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby declare that
the said proceedings shall be valid to all intents and purposes
as though the poll of ratepayers had been taken in the proper
manner, and that the proceedings in connection with the
said loan shall not be called into question by reason only of
the irregularity aforesaid.

Validating Proceedings in connection with the Raising of a
Loan by the Council of the Borough of Kaitangata.

ORDER IN COUNCIL.
At the Government Buildings at Wellington, this fifteenth
day of December, 1919.
Present:
THE HONOURABLE SIR WILLIAM FRASER PRESIDING IN
COUNCIL.
WHEREAS the Kaitangata Borough Council lately proposed to raise a loan of six hundred and fifty pounds,
under the provisions of the Local Bodies' Loans Act, 1913,
hereinafter called the said Act, for the construction of a
culvert bridge and flood lock:
And whereas section nine of the said Act provides that
a notice setting forth the proposal to raise the loan shall be
published once in each week for four successive weeks:
And whereas the notice setting forth the proposal to raise
the loan was not published once in each week for four successive weeks, inasmuch that the said notices were published in the Free Press on the first, eighth, twelfth, and
twenty-second days of August, one thousand nine hundred
and nineteen:
And whereas it appears that the ratepayers have not been
misled by such irregularity or defect, and it is expedient
to validate the same:
Now, therefore, His Excellency the Governor-General of
the Dominion of New Zealand, in pursuance and exercise of
the powers and authorities conferred on him by section one
hundred and eleven of the Local Bodies' Loans Act, 1913,
and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby declare that
the said proceedings shall be valid to all intents and purposes as though the notice of proposal to raise the loan had
been published in the manner prescribed in section nine
aforesaid, and that the proceedings in connection with the
said loan shall not be called into question by reason only of
the irregularity aforesaid.

Validating Proceedings in connection with the Raising of a
Loan by the Council of the County of Eltham.

ORDER IN COUNCIL.
At the Government Buildings at Wellington, this fifteenth
day of December, 1919.
Present:
THE HONOURABLE SIR WILLIAM FRASER PRESIDING IN
COUNCIL.
WHEREAS the Eltham County Council, acting under
and in pursuance of subsection (e), section sixteen,
of the Local Bodies' Loans Act, 1913, lately proposed to
raise a loan of three thousand pounds for the purpose of
forming and metalling the Rawhitiroa Road in the Omana Riding of the said county:
And whereas the ratepayers' consent given under the said
subsection (e) of section sixteen of the said Act is irregular,
inasmuch that no mention is made of the date upon which
the special rate proposed to be levied thereunder shall be
payable, and inasmuch that two of the subscribing rate-
payers have witnessed the signatures of other subscribers
thereto:
And whereas it appears that the ratepayers have not
been misled by the said irregularities, and it is expedient to
validate the same:
Now, therefore, His Excellency the Governor-General of
the Dominion of New Zealand, in pursuance and exercise
of the powers and authorities conferred on him by section
one hundred and eleven of the Local Bodies' Loans Act,
1913, and acting by and with the advice and consent of the
Executive Council of the said Dominion, doth hereby order
and declare that the proceedings taken to raise the said loan shall be valid to all intents and purposes as though the
ratepayers' consent had been properly completed and as
though the said consent had been properly witnessed, and
that the proceedings shall not be called into question by
reason only of the irregularities aforesaid.

Validating Proceedings in connection with the Raising of a
Loan by the Council of the County of Horowhenua.
LIVERPOOL, Governor-General.
ORDER IN COUNCIL.
At the Government Buildings at Wellington, this fifteenth
day of December, 1919.
Present:
THE HONOURABLE SIR WILLIAM FRASER, PRESIDING IN
COUNCIL.
WHEREAS the Horowhenua County Council lately proposed to raise a loan of one thousand four hundred
pounds, under the provisions of section sixteen (e) of the
Local Bodies' Loans Act, 1913 (hereinafter called “the said
Act”), for road-construction:
And whereas the special roll of ratepayers was not deposited
for public inspection in accordance with the provisions of
the said Act and the regulations thereunder, inasmuch as
in the public notification of the deposit of the special roll
of ratepayers no reference was made to the period for which
the roll was deposited for inspection, or that objections to
anything contained in the said roll could be lodged within
seven days from the last day of the deposit of the said roll:
And whereas the ratepayers' consent to the raising of the
loan contains no reference to the payment of the cost of
raising the loan out of the proceeds thereof:
And whereas the special order authorizing the raising of
the loan provides for the payment of the cost of raising the
loan out of the proceeds thereof:
And whereas certain sections comprising part of the special
rating area over which a special rate is to be levied as security
for the said loan—namely, Sections 1D and 1E 1A--have
been omitted from the special order authorizing the raising
of the said loan and the resolution making the special rate
in respect thereof:
And whereas it appears that the ratepayers have not been
misled by such irregularities or defects, and it is expedient
to validate the said proceedings:
Now, therefore, His Excellency the Governor-General of
the Dominion of New Zealand, in pursuance and exercise
of the powers and authorities conferred on him by section
one hundred and eleven of the Local Bodies' Loans Act,
1913, and acting by and with the advice and consent of the
Executive Council of the said Dominion, doth hereby declare
