Fixing Open Season for Godwits (Curlew).

ORDER IN COUNCIL.

At the Government House at Wellington, this twenty-third day of December, 1919.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS by an Order in Council dated the seventeenth day of December, one thousand nine hundred and seventeen, made under the Animals Protection Act, 1908, it was ordered and declared that the season during which godwits may be killed shall be the first day of January to the thirty-first day of March, both days inclusive, in each year, except in the Opotiki, Southland, and Auckland Acclimatization Districts: And whereas it is expedient to amend the said Order in Council:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the power and authority vested in him by the said Animals Protection Act, 1908, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and declare that the season during which godwits (Limosa Nova Zealandiae — native name Kauka or Hakakao) may be killed shall, except in the Opotiki and Southland Acclimatization Districts, be the first day of January to the thirty-first day of March, both days inclusive, in each year; provided that no such birds shall be trapped, netted, snared, or taken by any other means prohibited by the Animals Protection Act, 1908.

Kimihia Drainage District, County of Waikato, constituted.

ORDER IN COUNCIL.

At the Government House at Wellington, this twenty-third day of December, 1919.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS, in accordance with the provisions of the third section of the Land Drainage Act, 1908, a majority of the ratepayers in the area of land described in the Schedule hereto, situated in the County of Waikato, have presented a petition to His Excellency the Governor-General of the Dominion of New Zealand, praying that the said area be constituted a drainage district under the provisions of the said Act:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the power and authority contained in the third section of the Land Drainage Act, 1908, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby constitute and declare the area of land described in the Schedule hereto to be a district for the purposes of Part I of the said Act, to be called by the name of the “Kimihia Drainage District”; and also, in pursuance and exercise of the power and authority contained in the fourth section of the said Act, doth hereby declare that the Board of Trustees of the said district shall consist of five persons to be elected as members of the said Board under and in accordance with the said Act.

SCHEDULE.
KIMIHIA DRAINAGE DISTRICT.

ALL that area in the Auckland Land District, in the Rangiriri Survey District, bounded by a line commencing at a point on the right bank of the Waikato River on the line of the northern boundary of Section 26, Taupiri Parish; thence to and along that boundary to the north-western corner of Section 25, Taupiri Parish; thence south-westerly along the western boundary of the said section to a public road; thence along that road, being the southern and eastern frontages of the said Section 25, and the eastern frontage of Section 29 to the road along the southern frontage of Section 397, Taupiri Parish; thence easterly along that road to the north-western corner of Section 396, Taupiri Parish; thence south-easterly along the western boundaries of Sections 396, 1, and 2; thence easterly along the southern boundary of the said Section 2; thence southerly along the eastern boundaries of Sections 3, 4, 5, 6, 7, 8, 9, and 10; thence north-westerly along the south-western boundary of the said Section 10 to a public road; thence north-easterly along that road to its junction with a road along the north-eastern frontage to Section 21B; thence along the last-mentioned road, being the north-eastern and north-western frontages to the said Section 21B, the northern frontages of Section 21A, and Section 306, the south-eastern frontages of Sections 9 and 7, and the north-eastern frontages of Sections 7 and 9, to the boundary of the Huntly Town District; thence north-westerly along that boundary as described in the New Zealand Gazette of 1908, page 1128, to the right bank of the Waikato River; thence northerly along the said bank to the point of commencement.

Licensing Herbert Charles Harris to occupy a Portion of the Land between High- and Low-water Marks in the Mangamuka River, Hokianga Harbour, and to reclaim such Land.

ORDER IN COUNCIL.

At the Government House at Wellington, this twenty-third day of December, 1919.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS it is enacted by section thirty-nine of the Harbours Amendment Act, 1910 (hereinafter called “the said Act”), that in the case of lands between high- and low-water marks which belong to the Crown, and on which at high-water spring tides the depth of water is not sufficient for purposes of navigation, the Governor-General in Council may grant occupation licenses for periods not exceeding twenty-one years, at such rent and on such conditions as he thinks fit, and any such lease may contain a provision authorizing the lessee to reclaim the land the subject of the lease without complying with the requirements of section forty-one of the said Act:

And whereas it is desirable to license Herbert Charles Harris (hereinafter called “the licensee”) to occupy a part of the land between high- and low-water marks, belonging to the Crown, in the Mangamuka River, Hokianga Harbour, on which at high-water spring tides the depth of water is not sufficient for the purposes of navigation:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the hereinbefore-recited power and authority, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby license the licensee to occupy the piece of land between high- and low-water marks of spring tides in the Mangamuka River, Hokianga Harbour, containing four acres, more or less, as shown edged red on plan marked M.D. 5090, and deposited in the office of the Marine Department at Wellington; and doth also authorize the licensee to reclaim the land subject to the following conditions.

CONDITIONS.

  1. THE licensee shall pay to the Marine Department a rental in advance each year of 1s. per acre per annum, the first of such annual payments to be made on the licensee being supplied with a copy of this Order in Council.

  2. The licensee shall keep any stop-banks which he may construct for the purpose of reclaiming the land included in this license in good order and condition, and shall provide and maintain all necessary outlets for storm-water.

  3. The licensee shall keep the land included in this license free from noxious weeds.

  4. The licensee shall not assign, charge, or part with any right, power, or privilege granted by this license without the previous written consent of the Minister of Marine.
