  1. A bursary shall become vacant by failure on the part of the holder to satisfy such conditions as the Director of Education may deem necessary. Generally, such conditions shall include the passing of the college examinations in subjects of the course on which he enters, and the attainment of success in connection with the examination for the degree or for the associateship, as the case may be.

  2. The term of a bursary under these regulations shall in general be three years if the holder so long fulfils the prescribed conditions, but under special circumstances, on the recommendation of the Engineering faculty concerned, the bursary may be extended for a further term, provided that the whole period of the bursary so extended shall in no case exceed five years.

  3. The bursary must be held continuously, except in the case of illness or special circumstances approved by the Director.

  4. On receipt of an unfavourable report on the conduct, progress, or diligence of the holder of a bursary from the Engineering faculty concerned, the tenure of the bursary shall forthwith be determined; and the holder shall, if the Director so requires, refund the fees paid during the current year on his behalf.

  5. Every applicant for a bursary under these regulations shall enter, by his parent or guardian, or some other person approved by the Director, into a bond the condition of which shall be that the applicant shall during the continuance of the bursary faithfully observe the conditions of these regulations, and that in default of such observance the applicant or other obligor, as the case may be, shall forthwith pay into the Public Account a sum equal to the total amount payable by way of refund under the last preceding regulation.

The Eastern Side of Portion of Buchanan Street, in the Borough of Devonport, exempted from the Provisions of Section 117 of the Public Works Act, 1908, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.

At the Government House at Wellington, this twenty-first day of May, 1919.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS by subsection one of section one hundred and seventeen of the Public Works Act, 1908, it is, inter alia, provided that the said section shall not apply in any case where the local authority having control of a road or street by resolution declares that the provisions thereof shall not apply to any specified road or street, or any specified part thereof, and such resolution is approved by the Governor-General in Council:

And whereas by subsection two of section one hundred and seventeen of the Public Works Act, 1908, and clause (b) of subsection one of section thirteen of the Public Works Amendment Act, 1911, it is provided that such approval may be either absolute or subject to such conditions with respect to the building-line as the Governor-General by Order in Council thinks fit to impose, and may refer to one or both sides of the road or street:

And whereas the Devonport Borough Council, the local authority having control of the portion of street described in the Schedule hereto, hereinafter referred to as the said portion of street, has passed the following resolution—viz., “That Buchanan Street and Rattray Street, abutting on the property of the late Mr. William Philcox, be exempted from the provisions of section one hundred and seventeen, subsection one, of the Public Works Act, 1908”:

And whereas it is deemed expedient that such resolution should be approved in so far as it refers to the eastern side of the said portion of street, subject to the condition herein-after mentioned:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers conferred by the above-in-part-recited Acts, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the said resolution to the extent hereinbefore mentioned, subject to the condition that no building, or part of a building, shall be erected at any time on the eastern side of the said portion of street within a distance of thirty feet of the centre-line of the said portion of street.

SCHEDULE.

ALL that portion of the eastern side of Buchanan Street, in the North Auckland Land District, Borough of Devonport, adjoining portion of Allotment 20A of Section 2, Takapuna Parish. As the said portion of street is more particularly delineated on the plan marked P.W.D. 44195, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Land District, and thereon coloured blue.

Amending Notice under Animals Protection Act.—Nelson Acclimatization District.

LIVERPOOL, Governor-General.

WHEREAS it is expedient to amend, in manner hereinafter provided, the notification made under the Animals Protection Act, 1908, dated the ninth day of April, one thousand nine hundred and nineteen, and published in the New Zealand Gazette of the fourteenth day of the same month, declaring a special shooting season for imported game in the Nelson Acclimatization District:

Now, therefore, I, Arthur William de Brito Savile, Earl of Liverpool, the Governor-General of the Dominion of New Zealand, do hereby notify that the period wherein imported game may be taken or killed within the said district shall be from the first day of May, one thousand nine hundred and nineteen, to the thirty-first day of July, one thousand nine hundred and nineteen, in lieu of the period first day of May, one thousand nine hundred and nineteen, to thirtieth day of June, one thousand nine hundred and nineteen, as stated in the Warrant of the ninth April, which said Warrant is hereby amended accordingly.

As witness the hand of His Excellency the Governor-General, this thirteenth day of May, one thousand nine hundred and nineteen.
