CROWN LANDS NOTICES.
Timber in Southland Land District for Sale by Public Auction.
District Lands and Survey Office,
Invercargill, 22nd March, 1918.
NOTICE is hereby given that the right to cut and remove the timber on the undermentioned Crown lands will be offered for sale by public auction at the District Lands and Survey Office, Invercargill, at 11 o'clock a.m. on Friday, 26th April, 1918, under the provisions of the Land Act and the Forest Regulations thereunder.
SCHEDULE.
SOUTHLAND LAND DISTRICT—SECTIONS 480 AND 481, BLOCK VI, FOREST HILL HUNDRED.
SECTION 480.—Area, 221 acres l rood 39 perches. Situated four miles from Lochiel Railway-station (Invercargill–Kington line), access being by a cart-road, gravelled to within half a mile of south-west corner.
Estimated to contain—
White-pine, 916,000 sup. ft.; rate per 100 sup. ft., 1s.; upset price, £458.
Red-pine and miro, 78,500 sup. ft.; rate per 100 sup. ft., 1s.; upset price, £39 5s.
Black-pine, 85,550 sup. ft.; rate per 100 sup. ft., 2s.; upset price, £85 10s.
Totara, 15,500 sup. ft.; rate per 100 sup. ft., 2s. 6d.; upset price, £19 7s. 6d.
Total upset price, £602 2s. 6d.
Section 481.—Area, 199 acres 2 roods 15 perches. Situated about three miles and a quarter from Spring Hills Railway-station (Hokonui–Winton branch line), access being by formed ungravelled cart-road to south-east corner.
Estimated to contain—
White-pine, 45,500 sup. ft.; rate per 100 sup. ft., 1s.; upset price, £22 15s.
Red-pine and miro, 655,000 sup. ft.; rate per 100 sup. ft., 1s.; upset price, £327 10s.
Black-pine, 40,000 sup. ft.; rate per 100 sup. ft., 2s.; upset price, £40.
Totara, 55,000 sup. ft.; rate per 100 sup. ft., 2s. 6d.; upset price, £68 15s.

Conditions of Sale.

The timber on each section will be offered separately, and the right to cut and remove the timber will be sold generally in accordance with the provisions of the Land Act, 1908, the Timber Regulations made thereunder, and the following conditions; and may contain such additional conditions as the Commissioner in his discretion considers necessary in the interests of the Crown or of the public.

The quantities of the various timbers set forth in the above Schedule are approximate only, and are furnished for the information of intending purchasers, who are expected, previous to the sale, to make their own estimate of the
quantity of timber. No contract for purchase shall be voidable, nor shall the licensee be entitled to any abatement in price, by reason of the said timber being of less quantity, quality, and kind than as stated herein; nor shall any extra sum be claimed by the Crown if for any reason the quantity of timber is found to be in excess of that stated herein.

The successful bidder shall purchase the whole of the timber, and shall, on the fall of the hammer, pay in cash a deposit of one-third of the amount bid, together with £1 1s. license fee, and shall also deposit two promissory notes, each for one-half of the balance, payable on demand, and endorsed by two persons to be approved by the Commissioner. Such promissory notes shall bear interest at the rate of 5 per centum per annum as from date of sale, in accordance with clause 86 of the regulations. These promissory notes will be presented, the first at an interval of twelve months from the date of sale, and the other at eighteen months from said date; but they may be presented for payment at earlier dates if more than a due proportion of timber is found to be cut, or should any breach of the conditions occur, or if in the opinion of the Commissioner the interest of the Crown is jeopardized.

Three years and a half will be allowed in which to cut and remove the timber, but if one purchaser secures both lots six years will be allowed.

The timber shall be cut in a face, and the Crown reserves the right of following up the mill workings by felling and grassing such areas as from time to time will have been cleared of milling-timber, or of disposing of the land. Sufficient timber shall be left for fencing and general farming purposes.

The licensee shall not put, throw, or place, or allow to be put, thrown, or placed, into any river, stream, or watercourse, or into any place where it may be washed into any river, stream, or watercourse, any sawdust or other sawmill refuse.

In the event of the above not being disposed of, applications may be received and dealt with at any time within six months from the above date of sale (unless previously formally withdrawn); provided, however, that the amount offered is not less than the upset price stated herein.

No compensation will be given nor shall any be claimed for any error, discrepancy, or misdescription whatever in respect of the timber or in these conditions.

Any timber not specified milled for sale shall be purchased at the rate of 6d. per 100 sup. ft.

The purchasers shall be required to clear all noxious weeds growing on the above areas specified, in accordance with the Noxious Weeds Act, 1908, and its amendments.

White-pine (kahikatea) must not be exported, but is to be disposed of for the benefit of the dairying industry within the Dominion.
