Validating Proceedings in connection with a Loan of £2,000
proposed to be raised by the Mount Roskill Road Board.

LIVERPOOL, Governor-General.
ORDER IN COUNCIL.
At the Government Buildings at Wellington, this eighteenth
day of March, 1918.

Present :
THE RIGHT HONOURABLE W. F. MASSEY, P.C., PRESIDING
IN COUNCIL.

WHEREAS the Mount Roskill Road Board (hereinafter
referred to as the said Board) lately proposed to
raise a loan of two thousand pounds, under the Local Bodies’
Loans Act, 1913, for the purpose of improving its system of
water-supply :

And whereas in the first two notices published in pursuance
of section nine of the said Act, the proposed work was stated
as including, inter alia, the addition of a further four feet
to the top of the storage tank :

And whereas it was resolved by the said Board, after the
publication of the first two notices aforesaid, to increase the
capacity of the said tank by the addition of a further eight
feet instead of a further four feet as originally intended :

And whereas notice of such amended intention and of
such increase was set forth in the last two notices published
in pursuance of section nine aforesaid and in the voting-
paper used at the poll upon the said proposal :

And whereas it appears that the ratepayers have not been
misled by such irregularity, and it is expedient to validate
the same :

Now, therefore, His Excellency the Governor-General of
the Dominion of New Zealand, in pursuance and exercise
of the powers and authorities conferred on him by section
one hundred and eleven of the Local Bodies’ Loans Act, 1913,
and acting by and with the advice and consent of the Execu-
tive Council of the said Dominion, doth hereby declare that
the proceedings in connection with the said loan shall be
valid to all intents and purposes as though the requirements
of paragraph (a) of section nine of the said Act had been
strictly complied with, and that the proceedings in connection
with the said loan shall not be called into question by reason
only of the irregularity aforesaid.

proposed to be raised by the Tumu-Kaituna Drainage Board.

WHEREAS the Tumu-Kaituna Drainage Board lately
proposed to raise a loan of three thousand two
hundred and fifty pounds, under the Local Bodies’ Loans
Act, 1913, for the purpose of widening, deepening, and
constructing drains as mentioned in the voting-paper used
at the poll upon the said proposal :

And whereas an irregularity or defect occurred both in the
notice published in pursuance of section nine of the said Act
and in the voting-paper used at the poll upon the said pro-
posal, in that the term of the said loan (namely, thirty-six
years and a half) was not set forth in such notice and voting-
paper :

And whereas it appears that the ratepayers have not been
misled by such irregularity or defect, and it is expedient to
validate the same :

Now, therefore, His Excellency the Governor-General of
the Dominion of New Zealand, in pursuance and exercise of
the powers and authorities conferred on him by section one
hundred and eleven of the Local Bodies’ Loans Act, 1913,
and acting by and with the advice and consent of the Execu-
tive Council of the said Dominion, doth hereby declare that
the proceedings in connection with the said loan shall be
valid to all intents and purposes as though the term of the

day of March, 1918.

IN COUNCIL.

WHEREAS the Hauraki Drainage Board lately pro-
posed to raise a loan of five thousand pounds, under
the Local Bodies’ Loans Act, 1913, for the purpose of
widening, deepening, and improving existing watercourses
and drains and for constructing new watercourses and drains :

And whereas an irregularity or defect occurred in the
voting-paper used at the poll upon the said proposal, in that
the term of the said loan (namely, thirty-six years and a
half) was not set forth in such voting-paper :

And whereas twenty-four days intervened between the
last publication of the notice of intention to raise the loan
prescribed by section nine of the said Act and the date on
which the poll of the ratepayers upon the said proposal was
taken, instead of a period of not more than three weeks
as required by subsection two of section ten of the said Act :

And whereas it appears that the ratepayers have not been
misled by such irregularities or defects, and it is expedient to
validate the same :

Now, therefore, His Excellency the Governor-General of
the Dominion of New Zealand, in pursuance and exercise of
the powers and authorities conferred on him by section one
hundred and eleven of the Local Bodies’ Loans Act, 1913,
and acting by and with the advice and consent of the Execu-
tive Council of the said Dominion, doth hereby declare that
the proceedings in connection with the said loan shall be
valid to all intents and purposes as though the term of the
said loan had been stated in the said voting-paper, and as
though the requirements of section ten of the said Act as
above mentioned had been strictly complied with, and that
the proceedings in connection with the said loan shall not be
called into question by reason only of the irregularities or
defects aforesaid.

Revoking License for Occupation of Foreshore of Whangaroa
Harbour.

ORDER IN COUNCIL.
At the Government Buildings at Wellington, this eighteenth
day of March, 1918.

Present :
THE RIGHT HONOURABLE W. F. MASSEY, P.C., PRESIDING
IN COUNCIL.

WHEREAS by Order in Council dated the twenty-
fourth day of February, one thousand nine hundred
and nine, and published in the New Zealand Gazette No. 18,
of the fourth day of the following month, Frederick William
Sanderson, of Whangaroa, was licensed to occupy a part of
the foreshore and land below low-water mark of Whangaroa
Harbour as a site for a boat-shed for a period of fourteen
years : And whereas the licensee desires that the said license
shall be revoked :

Now, therefore, His Excellency the Governor-General of the
Dominion of New Zealand, in pursuance and exercise of the
power and authority conferred upon him by the Harbours
Act, 1908, and of all other powers and authorities enabling
him in that behalf, and acting by and with the advice and
consent of the Executive Council of the said Dominion, doth
hereby revoke the hereinbefore-recited Order in Council of
the twenty-fourth day of February, one thousand nine hun-
dred and nine, and the rights and privileges thereby conferred.
