compensation in respect of the taking thereof, it is found that the land or any part thereof is not required for the purpose for which it was taken, or that any error in form or substance exists in or in relation to that Proclamation or the making or gazetting thereof, the Governor-General may, by a subsequent Proclamation gazetted, revoke the former Proclamation, either wholly or so far as he thinks necessary:
And whereas it is found that part of the land taken for a further portion of the Huntly-Awaroa Branch of the Kaipara-Waikato Railway by a Proclamation made under the Public Works Act, 1908, dated the eleventh day of October, one thousand nine hundred and seventeen (hereinafter termed “the said Proclamation”), and published in the New Zealand Gazette No. 160, page.3934, of the eighteenth day of the same month, is incorrectly described:
And whereas compensation in respect of the taking of the said land has not been paid or awarded:
Now, therefore, I, Arthur William de Brito Savile, Earl of Liverpool, Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers vested in me by the Public Works Amendment Act, 1909, and of all other powers enabling me in this behalf, do hereby revoke so much of the said Proclamation as affects the land described in the Schedule hereto.

APPROXIMATE areas of the pieces of land incorrectly described:—

In the Auckland Land District; as the same are more particularly delineated on the plan marked P.W.D. 42960 (sheet 2), deposited in the office of the Minister of Public Works at Wellington, in the Wellington Land District, and thereon coloured as above mentioned.

Given under the hand of His Excellency the Right Honourable Arthur William de Brito Savile, Earl of Liverpool, Knight Grand Cross of the Most Distinguished Order of Saint Michael and Saint George, Member of the Royal Victorian Order, Governor-General and Commander-in-Chief in and over His Majesty’s Dominion of New Zealand and its Dependencies; and issued under the Seal of the said Dominion, at the Government House at Wellington, this seventh day of February, in the year of our Lord one thousand nine hundred and eighteen.

A PROCLAMATION.

WHEREAS by paragraph (c) of section one hundred and thirty-three of the Public Works Act, 1908, it is enacted that the Governor-General may, by Proclamation publicly notified, stop or alter the course of any Government road or any part thereof:
And whereas the Government roads described in the Schedule hereto are no longer required for the purpose of roads:
Now, therefore, I, Arthur William de Brito Savile, Earl of Liverpool, the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the above-in-part-recited Act, and of all other powers in anywise enabling me in this behalf, do hereby proclaim as stopped the roads described in the Schedule hereto.

Amended Fees under the Tobacco Act.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this fourth day of February, 1918.

Present:
THE RIGHT HONOURABLE W. F. MASSEY, P.C., PRESIDING IN COUNCIL.

WHEREAS by Order in Council dated the seventeenth day of December, one thousand nine hundred and seventeen, and published in the New Zealand Gazette of the twentieth day of December, one thousand nine hundred and seventeen, a certain regulation was made under the Tobacco Act, 1908, as amended by the Finance Act, 1917, imposing a scale of fees to be paid for warrants to make cigarettes by hand:
And whereas it is expedient to revoke the said regulation and to make a regulation in lieu thereof:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred upon him by the Tobacco Act, 1908, as amended by the Finance Act, 1917, and of all other powers and authorities enabling him in that behalf, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby revoke the said regulation made on the seventeenth day of December, one thousand nine hundred and seventeen, and doth make the following regulation in lieu thereof; and doth order that this regulation shall be deemed to have come into force as on and from the first day of January, one thousand nine hundred and eighteen.

REGULATION.

  1. (1.) THE scale of fees payable under subsection (3) of section 28 of the Tobacco Act, 1908, as amended by section 51 of the Finance Act, 1917, shall be as follows:—
    For an annual warrant to make cigarettes, where the number of cigarettes intended to be made as specified in the declaration of the manufacturer made in accordance with Schedule B to the regulation made on the 11th day of January, 1897 (under the Tobacco Amendment Act, 1896), and gazetted on the 28th day of January then instant, does not exceed 50,000: £10.
    Where the number of cigarettes to be made exceeds 50,000, for every 5,000 cigarettes or fraction thereof intended to be made in excess of 50,000: £1.
