THE NEW ZEALAND GAZETTE.

No. 135

  1. The cost over and above the ordinary cost of day-work of all labour during any hours not being ordinary business hours as above defined shall be paid by the master or owner of the vessel, in addition to the usual charges, at the rate of 2s. 6d. per hour or part of an hour.

  2. The following days shall be observed as holidays by the Council and its officers—namely, New Year's Day, Good Friday, Easter Monday, King's Birthday, Christmas Day, Boxing Day, and Labour Day.

  3. Consignees shall be liable for all wharfage and other charges on all inward cargo, shippers shall be liable for all wharfage and other charges on all outward cargo. All charges to be paid at the time of receiving and shipping.

  4. If any person fails, or refuses, or neglects to do anything required by these regulations to be done, observed, or performed, or in any manner obstructs, impedes, or interferes with the doing of anything enjoined, required, or authorized to be done, or wilfully does anything prohibited by these regulations, every such person in each and every case so offending shall be liable to a penalty not exceeding £20.

  5. The Council shall appoint the Wharfinger and all other persons necessary for the working of the wharf.

Fixing Date of First Meeting of Otau Domain Board.

ORDER IN COUNCIL.
At the Government House at Wellington, this first day of October, 1918.
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
WHEREAS by an Order in Council issued under the Public Reserves and Domains Act, 1908, on the tenth day of September, one thousand nine hundred and eighteen, and published in Gazette of the twelfth day of September, one thousand nine hundred and eighteen, the Manukau County Council was appointed to be the Otau Domain Board, and the first meeting of the Board was fixed for Tuesday, the eighth day of October, one thousand nine hundred and eighteen, at eight o'clock p.m.:
And whereas the date and time fixed for the first meeting is not suitable, and it is expedient to fix a new date and time for the first meeting:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in exercise of the powers conferred by the said Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby appoint Friday, the eleventh day of October, one thousand nine hundred and eighteen, at one o'clock p.m., as the time when, and Gleeson's Buildings, High Street, Auckland, as the place where, the first meeting of the Otau Domain Board shall be held.

Regulation.—Technical Instruction.

ORDER IN COUNCIL.
At the Government House at Wellington, this first day of October, 1918.
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
IN pursuance and exercise of the powers and authorities vested in him by the Education Act, 1914, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby make the amendment set out in the Schedule hereto in the regulations for the election and appointment of managers of technical schools under the said Act made by Order in Council dated the thirtieth day of July, one thousand nine hundred and eighteen; and, with the like advice and consent, doth prescribe that this Order shall come into force on the date of the first publication thereof in the New Zealand Gazette.

SCHEDULE.

SUBCLAUSE (2) of clause 3 of the said regulations is hereby amended by the addition of the following words: “In the case of a first election the Returning Officer shall be the Secretary of the controlling body.”

The Northern Side of Portion of Smith Street, in the Heathcote County, exempted from the Provisions of Section 117 of the Public Works Act, 1908, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.
At the Government House at Wellington, this first day of October, 1918.
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
WHEREAS by subsection one of section one hundred and seventeen of the Public Works Act, 1908, it is, inter alia, provided that the said section shall not apply in any case where the local authority having control of a road or street by resolution declares that the provisions thereof shall not apply to any specified road or street, or any specified part thereof, and such resolution is approved by the Governor-General in Council:
And whereas by subsection two of section one hundred and seventeen of the Public Works Act, 1908, and clause (b) of subsection one of section thirteen of the Public Works Amendment Act, 1911, it is provided that such approval may be either absolute or subject to such conditions with respect to the building-line as the Governor-General by Order in Council thinks fit to impose, and may refer to one or both sides of the road or street:
And whereas the Heathcote County Council, the local authority having control of the portion of street described in the Schedule hereto, hereinafter referred to as the said portion of street, has passed the following resolution—viz., “That, pursuant to section one hundred and seventeen of the Public Works Act, 1908, the north side of Smith Street, bounding Lot 41, D.P. 26, R.S. 254, be exempted from the provisions of the said section relating to setting back the frontage to thirty-three feet from the centre of the street, subject to the building-line being set back to thirty-three feet from the centre of the said street”:
And whereas it is deemed expedient that such resolution should be approved in so far as it refers to the northern side of the said portion of street, subject to the condition herein-after mentioned:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers conferred by the above-in-part-recited Acts, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the said resolution to the extent hereinbefore mentioned, subject to the condition that no building, or part of a building, shall be erected at any time on the northern side of the said portion of street, within a distance of thirty-three feet of the centre-line of the said street.

SCHEDULE.

ALL that portion of the northern side of Smith Street, situated in the Canterbury Land District, Heathcote County, adjoining Lot 41, D.P. 26, R.S. 254, Block XVI, Christchurch Survey District. As the said portion of street is more particularly delineated on the plan marked P.W.D. 44502, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Land District, and thereon coloured red.
