Empowering Maori Land Board to Dispose of Land by Way of Sale under the Native Land Act, 1909.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this fifth day of March, 1917.

Present :

THE HONOURABLE A. L. HERDMAN PRESIDING IN COUNCIL.

WHEREAS by Order in Council dated the fifth day of July, one thousand nine hundred and nine, the block or parcel of land named in the Schedule hereto was declared to be subject to Part I of the Native Land Settlement Act, 1907, and by virtue of section two hundred and thirty-three of the Native Land Act, 1909, became subject to Part XIV of that Act :

And whereas by subsection three of section two hundred and thirty-nine of the Native Land Act, 1909, it is provided that, notwithstanding anything hereinbefore contained in that section, the Governor may by Order in Council, on the recommendation of the Board in whose district the land is situated, in any case in which he is of opinion that an equal division of that land for disposal by sale and lease would be impracticable or inexpedient in the public interest or in the interests of the owners, authorize the division of that land in other than equal proportions, or authorize the whole of that land to be disposed of either by sale or lease :

And whereas the Waikato-Maniapoto District Maori Land Board has recommended that it is expedient that the whole of the land described in the Schedule hereto should be disposed of by way of sale, and the Governor is of opinion that it should be so disposed of :

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the power and authority conferred on him by subsection three of the said section two hundred and thirty-nine, and acting by and with the advice and consent of the Executive Council thereof, doth hereby authorize the whole of the said land described in the Schedule hereto to be disposed of by way of sale.

SCHEDULE.

ALL that parcel of land, containing by admeasurement 1,865 acres, more or less, situated in the Harataunga Survey District, in the Land District of Auckland, and known as Moehau No. 2A No. 2B Block.

Order in Council confirming Scheme of Consolidation of Interests in various Blocks of Native Land.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this fifth day of March, 1917.

Present :

THE HONOURABLE A. L. HERDMAN PRESIDING IN COUNCIL.

WHEREAS it is enacted by section one hundred and thirty (hereinafter referred to as “the said section”) of the Native Land Act, 1909, that the Governor, if satisfied that any scheme of consolidation of interests of owners in any specified area or areas of Native land duly submitted to him under the provisions of the said section is just and equitable and is in the public interest, may by Order in Council confirm such scheme :

And whereas, upon the application of the Native Minister, the Tairawhiti District Native Land Court prepared a scheme of consolidation of interests of owners in the blocks of Native land mentioned in the Schedule hereto, and submitted same on the third day of February, one thousand nine hundred and seventeen, and under the seal of the Court, to the Governor for his approval :

And whereas the Governor is satisfied that such scheme as submitted to him is just and equitable and is in the public interest :

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council thereof, and in exercise of the powers conferred upon him by the said section, doth hereby confirm the said scheme of consolidation of interests of owners in the blocks of Native land mentioned in the Schedule hereto.

Extending Prohibition of Private Alienation of certain Native Land.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this fifth day of March, 1917.

THE HONOURABLE A. L. HERDMAN PRESIDING IN COUNCIL.

ON the recommendation of the Native Land Purchase Board, referred to in section three hundred and sixty-three of the Native Land Act, 1909, and in exercise of the power in this behalf conferred upon him by that section, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council thereof, doth hereby extend for a further period of six months the Order in Council made the twenty-first day of March, one thousand nine hundred and sixteen, and gazetted the thirtieth day of March, one thousand nine hundred and sixteen, but only in so far as such Order in Council prohibits all alienations of the lands specified in the Schedule hereto other than alienations in favour of the Crown.

Partial Revocation of Order in Council prohibiting all Private Alienation of certain Native Lands.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this fifth day of March, 1917.

Present :

THE HONOURABLE A. L. HERDMAN PRESIDING IN COUNCIL.

WHEREAS by section three hundred and sixty-three of the Native Land Act, 1909, it is enacted that any Order in Council made under that section may at any time be varied or revoked :

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the power and authority hereinbefore mentioned, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby revoke the Order in Council as set out in Part I of the Schedule hereto, but only in so far as it affects the land mentioned in Part II of the said Schedule.

SCHEDULE.

PART I.

ORDER in Council under Section 363 of the Native Land Act, 1909, dated the 10th July, 1916, and gazetted 13th July, 1916, affecting Parihaka A and other blocks.

PART II.

Parihaka No. 24B Block: Approximate area, 113 acres; Block VIII, Cape Survey District.
