power and authority conferred upon him by section ninety-six of the Native Land Amendment Act, 1913, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby declare that the land described in the Schedule hereto shall no longer be subject to Part XV of the Native Land Act, 1909, and shall be revested in the native owners thereof.

SCHEDULE.

ALL that piece or parcel of land known as Paeroa 2a No. 8 Block, containing 228 acres 1 rood 20 perches, more or less, situate in the Opoiti Survey District, in the Land District of Hawke’s Bay.

Portion of Courtenay Street, in the Borough of New Plymouth, exempted from the Provisions of Section 117 of the Public Works Act, 1908.

ORDER IN COUNCIL.

At the Government House at Wellington, this ninth day of January, 1917.

Present:

His Excellency the Governor in Council.

WHEREAS by subsection one of section one hundred and seventeen of the Public Works Act, 1908, it is, inter alia, provided that the said section shall not apply in any case where the local authority having control of any road or street by resolution declares that the provisions thereof shall not apply to any specified road or street, or any specified part thereof, and such resolution is approved by the Governor in Council :-

And whereas by subsection two of section one hundred and seventeen of the Public Works Act, 1908, it is provided that such approval may be either absolute or subject to such conditions with respect to the building-line as the Governor, by Order in Council, thinks fit to impose:

And whereas the New Plymouth Borough Council, being the local authority having control of the portion of street described in the Schedule hereto, has passed the following resolution—viz., “That the New Plymouth Borough Council, being the local authority having control of the street herein-after mentioned, hereby resolves and declares that the provisions of section one hundred and seventeen of the Public Works Act, 1908, shall not apply to that portion of Courtenay Street situate between Watson Street and Ebrington Terrace, within the Borough of New Plymouth”:

And whereas it is deemed expedient that such resolution should be approved:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the powers conferred by the above-in-part-recited Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the said resolution.

SCHEDULE.

ALL that portion of Courtenay Street, in the Taranaki Land District, Borough of New Plymouth, situated between Watson Street and Ebrington Terrace. As the said portion of street is more particularly delineated on the plan marked P.W.D. 41492, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Provincial District, and thereon coloured blue.

Recreation Reserve in Hawke’s Bay Land District brought under Part II of the Public Reserves and Domains Act, 1908.

At the Government House at Wellington, this twenty-second day of December, 1916.

His Excellency the Governor in Council.

BY virtue of the powers and authorities vested in me by the twenty-sixth section of the Public Reserves and Domains Act, 1908, I, Arthur William de Brito Savile, Earl of Liverpool, the Governor of the Dominion of New Zealand, by and with the advice and consent of the Executive Council of the said Dominion, do hereby order and declare that the reserve for recreation in the Hawke’s Bay Land District described in the Schedule hereto shall be and the same is hereby brought under the operation of and declared to be subject to the provisions of Part II of the said Act; and such reserve shall hereafter be known as the Clive Grange Domain, and be managed, administered, and dealt with as a public domain.

SCHEDULE.

CLIVE GRANGE DOMAIN.

ALL that area containing by admeasurement 28 acres 2 roods 35 perches, more or less, being Clive Suburban Sections 9, 302, and 303, Block III, Clive Survey District. Bounded by a line commencing at the intersection of the right bank of the Tukituki River and the eastern side of Grange Road; thence easterly along said river-bank to road reserve on sea-front; thence south-easterly along said road reserve; thence south-westerly along road reserve to northernmost corner of Lot 12 on plan 2279, deposited in the office of the District Land Registrar at Napier; thence along north-western boundary of that lot to Grange Road; thence north-westerly along Grange Road to southernmost corner of Lot 17; thence along south-eastern boundary of said Lot 17 and Lot 18; along Springfield Road abuttal, and along east and north-eastern boundaries of Lots 19, 24, and 25, Deeds Plan 366, and along north-eastern boundary of Suburban Section 55 to its northernmost corner; thence along north-western boundary of said Section 55 to Grange Road; thence north-westerly along Grange Road to southernmost corner of Suburban Section 54; thence along eastern boundaries of Suburban Section 54, and Lots 54, 55, 56, 57, 58, 59, 60, and 61, along Camp Road abuttal, and along north-eastern boundaries of Lots 62, 63, 64, 65, 66, 67, 68, 69, 70, and 71, Deeds Plan 355; thence across tidal swamp and alongside of tidal basin to south-eastern corner of Lot 72; thence along north-eastern boundaries of said Lot 72 and Lot 73, Deeds Plan 355, to north-eastern corner of said Lot 73; thence along north-western boundary of said Lot 73 to Grange Road; thence north-westerly along Grange Road to point of commencement.

Also all that area containing by admeasurement 3 acres 1 rood 5 perches, more or less, being Clive Suburban Section 304, Block III, Clive Survey District. Bounded by a line commencing at northernmost corner of Lot 20; thence proceeding along north-western boundaries of said Lot 20 and Lots 21, 22, 23, 24, and 25 on plan 2279, deposited as aforesaid, to Clifton Road; thence northerly along Clifton Road to southernmost corner of Suburban Section 101; thence along eastern and south-eastern boundaries of said Section 101 and Lots 9, 10, 11, 15, and 16, Deeds Plan 366, to Grange Road; thence south-easterly along Grange Road to point of commencement.

Also all that area containing by admeasurement 1 acre 0 rood 11 perches, more or less, being Clive Suburban Section 305, Block III, Clive Survey District. Bounded by a line commencing at intersection of east side of Grange Road and north side of tidal swamp opposite the westernmost corner of Lot 71, Deeds Plan 355; thence north-westerly along Grange Road to tidal basin; thence easterly along side of tidal basin and south-westerly along side of tidal swamp to point of commencement.

As the same are more particularly delineated on the plan marked L. and S. 1912/1062, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon bordered red.
