(10.) The driver or person in charge of any traction-engine having attached thereto any vehicle shall, when taking such traction-engine and vehicle over or across any bridge or culvert within the road district, provide proper appliances to keep a sufficient distance between such traction-engine and vehicle, to prevent there being upon any one span of any bridge or upon any culvert a weight exceeding 14 tons.

(11.) The driver or person in charge of any traction-engine shall, when crossing any bridge or culvert in the road district, place under the wheels of such traction-engine and along such bridge or culvert planks of not less than 12 in. wide and 3 in. thick, so that the wheels will not at any time come into direct contact with the bridge or culvert.

(12.) No traction-engine which, together with the maximum weight of fuel and water which such engine is constructed to carry for its propulsion, weighs more than 14 tons, and no vehicle or agricultural or other machine of any kind drawn thereby which weighs more than 10 tons shall be taken by any person on to or over any bridge or culvert on any road without a special permit signed by the Clerk.

(13.) Whenever the driver or person in charge of any traction-engine travelling on any road shall, from any cause whatever, be unable to have a clear and uninterrupted view of the said road or of the traffic thereon for at least 50 yards ahead of such engine, the said driver or person in charge of such engine shall stop, and before proceeding farther shall cause a man to go in advance of the said engine at a distance of not less than 50 yards therefrom to warn all riders or drivers or persons in charge of cattle of the proximity of the engine, and, if required so to do, to assist any such rider or driver or person in charge of cattle; and the driver of the engine, whenever required by any rider or driver or person in charge of cattle, shall stop the engine at some suitable point or place so as to allow such rider or driver or person in charge of cattle to pass with such cattle.

(14.) Whenever a traction-engine shall be or be propelled upon or along any road the driver or person in charge of such engine shall provide and maintain between sunset and sunrise two efficient lights to be fixed conspicuously, one on each side, on the front of the same, and one efficient tail-light in the rear of the same; or, when vehicles are being drawn by such traction-engine, an efficient tail-light in the rear of the last vehicle drawn by such traction-engine.

(15.) The driver or person in charge of any traction-engine on any road, while employed as such driver or in charge as aforesaid, shall have in his possession a printed copy of this Part of these by-laws, and shall exhibit the same on demand being made by the police, Clerk or a Foreman of the Board, or by any other person authorized in that behalf by the Board.

(16.) Nothing herein contained shall be held to relieve owners or employers of traction-engines from liability in respect of injury done and damage sustained by the traction of any excessive weight or extraordinary traffic over any public road.

(17.) No traction-engine having less than 8 in. tires on the front wheels and 12 in. tires on the back wheels, and no vehicle attached to such traction-engine and having less than 6 in. tires, shall be used on any road.

(18.) All licenses issued under Part V of these by-laws in respect of traction-engines shall be and be deemed to be issued subject to the provisions of this Part of these by-laws.

PART IV.

Width of Tires of Wheels.

10. The width of the tires of vehicles passing over any road shall, according to the class of vehicle used, be regulated with regard to the number of wheels and the number of animals drawing the same, as provided in the Schedule to these by-laws.

11. The driver or owner of any vehicle which shall be driven, taken, or used upon or over any road shall be guilty of an offence if the width of the tires of the wheels or of the tire of any of the wheels of such vehicle be less than is required by the last by-law.

12. The driver or person for the time being in charge of any vehicle proceeding or being upon any road shall, whenever required by any person authorized in that behalf by the Board who shall be of opinion that this by-law is being infringed, stop and detain such vehicle for a reasonable and sufficient time for the purpose of enabling such officer or person to inspect, examine, and measure the tires of such vehicle; and the driver or person in charge shall permit such inspection, examination, and measurement to be made accordingly, and no person shall obstruct any such officer or person authorized as aforesaid in or about making such inspection, examination, or measurement.

PART V.

Heavy Traffic.

13. In this Part of these by-laws "heavy traffic" shall mean—

(a.) The transportation of any vehicle, engine, or machine which itself or together with any thing or things being transported thereon weighs more than 1½ tons avoirdupois to each pair of wheels;

(b.) The traction of any vehicle or thing by means of bullocks, notwithstanding that such vehicle or thing may separately or together with any load thereon weigh less than 1½ tons avoirdupois;

(c.) Any traffic which may from time to time be declared to be “heavy traffic” by Order in Council.

14. On every vehicle to which this Part of these by-laws applies there shall be paid to the Board a yearly license fee according to the following scale:

(1.) On every traction-engine under 8 tons in weight, exclusive of the weight of fuel and water carried therein, while used only in transporting threshing-mill, chaff-cutting, or corn-crushing machine plant belonging to the person owning or using the said engine, the yearly license fee shall be £3.

(2.) On every traction-engine over 8 tons in weight, exclusive of the weight of fuel and water carried therein, while used only as described in subsection (1) of this Part of these by-laws, the yearly license fee shall be £5.

(3.) On every other traction-engine under 8 tons in weight, exclusive of the weight of fuel and water carried therein, the yearly license fee shall be £25.

(4.) On each wagon, truck, trailer, or other vehicle attached thereto the yearly license fee shall be £5.

(5.) On every other traction-engine over 8 tons in weight, exclusive of the weight of fuel and water carried therein, the yearly license fee shall be £40.

(6.) On each wagon, truck, trailer, or other vehicle attached thereto the yearly license fee shall be £5.

(7.) On every traction steam-engine, which is of the kind or class ordinarily known as a motor-wagon, the yearly license fee shall be £10.

(8.) On each wagon, truck, trailer, or other vehicle attached thereto the yearly license fee shall be £5.

(9.) On every portable engine the yearly license fee shall be £2 10s.

(10.) On every motor-wagon or lorry driven by petrol or other inflammable or explosive liquid or fuel (if provided with rubber tires) the yearly license fee shall be £5.

(11.) On every vehicle drawn by bullocks or horses and not being a traction-engine or portable engine, and irrespective of the number of wheels, the yearly license fee shall be as follows:

(a.) For a vehicle with 3 in. tires or under, £20;

(b.) For a vehicle with tires exceeding 3 in. but not exceeding 4 in., £16;

(c.) For a vehicle with tires exceeding 4 in. but not exceeding 5 in., £12;

(d.) For a vehicle with tires exceeding 5 in. but not exceeding 6 in., £8;

(e.) For a vehicle with tires exceeding 6 in. but not exceeding 7 in., £4;

(f.) For a vehicle with tires exceeding 7 in. no license fee shall be charged.

15. The owner or driver of any traction-engine shall, when applying for a license for a traction-engine, produce the driver's certificate issued by the Government.

16. Any person who desires to obtain a license under this Part of these by-laws for any vehicle or machine intended to be used for heavy traffic shall deliver at the Board’s office an application in writing addressed to the Clerk, and signed by the applicant, specifying the name, occupation, and address of the applicant, the class of vehicle, the weight, the number of wheels, width of tires, mode of traction, the purpose for which it is to be used, the period for which the license is required, and (in the case of a traction-engine) further specifying the name of the maker, the number, the horse-power, and the weight when loaded with the weight of fuel and water carried therein and when unloaded.

17. The Clerk may require the person applying for a license for a traction-engine to produce the last annual certificate issued by the Inspector of Machinery in respect of the boiler of such engine, under the Inspection of Machinery Act, 1908, or any Act amending or in substitution thereof, and any person knowingly producing a forged, counterfeited, or false certificate, or a certificate which has been suspended or which has for any reason known to such person ceased to have full force and effect, or which has not been issued in respect of the said boiler, shall be guilty of an offence.
