SCHEDULE.

REGULATION 77 is hereby amended by deleting the rates of pay laid down therein for the rank of Major-General, and substituting in lieu thereof the following: “Minimum, £1,100; after one year, £1,200.”

Warrant apportioning the Cost of Maintaining, Repairing, or Improving Portions of Herbertville–Cape Turnagain and Te Awa Putahi Roads, in the Porangahau Road District.

LIVERPOOL, Governor.

WHEREAS by section one hundred and nine of the Public Works Act, 1908 (hereinafter termed “the said Act”), it is provided that in any case where a road in one district is largely used by or for the purpose of traffic to or from any other district or districts; and affords access to or from such districts, and the Governor is of opinion that it is equitable that the latter district or districts shall contribute towards the cost of constructing or maintaining the whole or any portion of such road in the former district, the Governor may from time to time apportion the cost of constructing or maintaining the whole or any portion of such road among the local authorities of the respective districts as he thinks fit; and for that purpose, and to enable effect to be given thereto, the provisions of section one hundred and nineteen thereof shall, mutatis mutandis, apply in the case of the construction or reconstruction of the road and the provisions of section one hundred and twenty in the case of the maintenance of the road:

And whereas a dispute has arisen between the local authorities hereinafter mentioned on the question of the maintenance of the portions of roads hereinafter mentioned:

And whereas by the said section one hundred and twenty it is, inter alia, provided that the Governor may, with a view of determining what proportion of the cost of maintaining, repairing, improving, or reconstructing any work should be borne by any local authority, direct any Magistrate or other person to be a Commissioner to inquire into and report to him upon any matter which he shall deem necessary to enable him to determine any such question aforesaid:

And whereas a Commissioner was appointed for the purpose aforesaid, and an inquiry was duly held:

And whereas such Commissioner did report to the Governor, after due inquiry, his opinion thereon:

And whereas the Governor is of opinion that it is equitable that the cost of maintaining, repairing, or improving the portions of roads mentioned in the Schedule hereto should be provided and paid in the manner and in the proportion hereinafter set forth:

Now, therefore, I, Arthur William de Brito Savile, Earl of Liverpool, the Governor of the Dominion of New Zealand, in pursuance and exercise of the power and authority vested in me by the said Act, do hereby direct that from and after the date of this Warrant the Weber County Council shall pay to the Porangahau Road Board the sum of ten pounds (£10) per annum towards the cost of maintaining, repairing, or improving the Herbertville–Cape Turnagain Road, and the sum of ten pounds (£10) per annum towards the cost of maintaining, repairing, or improving the Te Awa Putahi Road. And I do hereby direct that the contributions hereby required to be made as aforesaid by the Weber County Council shall be paid from time to time, out of the funds of the said Council, within a period of thirty days after demand in writing made by or on behalf of the said Board, and such payments shall be made from time to time to the Clerk of the said Board for and on account of such County Council.

SCHEDULE.

THAT portion of the Herbertville–Cape Turnagain Road commencing at its junction with the Herbertville–Porangahau Road; and proceeding thence in a south-easterly direction generally to the point where it first strikes the sea-coast, all in Block XI, Tautane Survey District.

Also all that portion of road known as Te Awa Putahi Road, commencing at the Weber County boundary, and proceeding thence in an easterly direction generally to its junction with the Wimbledon–Porangahau Road, all in Block II, Tautane Survey District.

As the said portions of road are more particularly delineated on the plan marked P.W.D. 39561, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Provincial District, and thereon coloured red.

As witness the hand of His Excellency the Governor, this second day of February, one thousand nine hundred and seventeen.

Warrant vesting Control of the Tautane Bridge in the Porangahau Road Board, and apportioning Cost of Maintenance.

LIVERPOOL, Governor.

WHEREAS by section one hundred and twenty of the Public Works Act, 1908 (hereinafter called “the said Act”), it is, inter alia, enacted that the Governor may, by Warrant under his hand publicly notified and gazetted, direct that any bridge already constructed, or which may hereafter be constructed, over or across any river or arm of the sea respectively shall, from and after a date fixed in such Warrant, be under the exclusive care, control, and management of such local authority as shall be mentioned in that behalf in such Warrant, and may by any such Warrant as aforesaid fix and determine whether all or any, and (if so) what part, of the cost, whether theretofore incurred or thereafter to be incurred, of maintaining, repairing, improving, or reconstructing any such bridge is to be provided and paid by the local authority or local authorities; and may by any such Warrant as aforesaid direct how, when, and to whom any such payment is to be made:

And whereas by the said section one hundred and twenty it is, inter alia, provided that the Governor may, with a view of determining what proportion of the cost of maintaining, repairing, improving, or reconstructing any work should be borne by any local authority or local authorities, direct any Magistrate or other person to be a Commissioner to inquire into and report to him upon any matter which he shall deem necessary to enable him to determine any such question aforesaid:

And whereas a Commissioner was appointed for the purpose as aforesaid, and an inquiry duly held:

And whereas such Commissioner did report to the Governor, after due inquiry, his opinion thereon:

And whereas the Governor is of opinion that it is equitable that the cost of maintaining, repairing, or improving the bridge mentioned in the Schedule hereto should be provided and paid in the manner and in the proportions hereinafter respectively set forth:

Now, therefore, I, Arthur William de Brito Savile, Earl of Liverpool, the Governor of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities vested in me by the said Act, and of every other power and authority in any wise enabling me in this behalf, do hereby direct that the bridge described in the Schedule hereto, and known as Tautane Bridge (hereinafter called “the said bridge”), shall, from and after the date of gazetting hereof, be under the exclusive care, control, and management of the Porangahau Road Board; and, in further pursuance and exercise of the powers aforesaid, I do hereby direct that the Weber County Council shall pay to the Porangahau Road Board the sum of five pounds eleven shillings and sixpence (£5 11s. 6d.) per annum towards the cost of maintaining, repairing, or improving the said bridge. And I do hereby direct that the contribution hereby required to be made as aforesaid by the Weber County Council towards the cost of maintaining, repairing, or improving the said bridge shall be paid from time to time, out of the funds of the Weber County Council, within a period of one month after demand in writing made by or on behalf of the Porangahau Road Board; and the payments so required to be made shall be made from time to time to the Clerk of the Porangahau Road Board for and on behalf of the Council of the County of Weber.

SCHEDULE.

THAT bridge over the Tautane River, situated on the Herbertville–Cape Turnagain Road, in Block XI, Tautane Survey District. As the site of the said bridge is more particularly delineated on the plan marked P.W.D. 39561, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Provincial District, and thereon shown by a blue cross.

As witness the hand of His Excellency the Governor, this second day of February, one thousand nine hundred and seventeen.
