Land taken for a Further Portion of the Huntly-Awaroa Branch of the Kaipara-Waikato Railway, and for a Road Approach thereto.

A PROCLAMATION.

WHEREAS part of the land mentioned in the First Schedule hereto is required to be taken for a further portion of the Huntly-Awaroa Branch of the Kaipara-Waikato Railway, and for a road approach thereto:
And whereas all the conditions precedent required by law to be observed and performed prior to the taking of such land for the purposes hereinafter specified have been observed and performed:
And whereas it is desirable to take only the surface of such land for the purposes hereinafter specified, together with a portion of the subsoil thereof:
Now, therefore, I, Arthur William de Brito Savile, Earl of Liverpool, the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred on me by section one hundred and eighty-eight of the Public Works Act, 1908, and section seven of the Public Works Amendment Act, 1911, and of every other power and authority in anywise enabling me in this behalf, do hereby proclaim and declare that the surface of the land mentioned in the First Schedule hereto, together with that part of the subsoil of such land below the formation-levels of the said railway shown on the plan marked P.W.D. 42960, deposited in the office of the Minister of Public Works at Wellington, as is described in the Second Schedule hereto, is hereby taken for a further portion of the aforesaid line of railway and for the said road approach.

Situated in Pepepe Parish, Newcastle Survey District.
In the Auckland Land District; as the same are more particularly delineated on the plan marked P.W.D. 42960, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Land District, and thereon coloured as above mentioned.

SECOND SCHEDULE.

SUBSOIL TAKEN.

As to all the areas mentioned in the First Schedule: All the subsoil down to a plane 100 ft. below and approximately parallel to the said line of formation-levels, such plane being horizontal transversely to the said line of formation-levels.

Given under the hand of His Excellency the Right Honourable Arthur William de Brito Savile, Earl of Liverpool, Knight Grand Cross of the Most Distinguished Order of Saint Michael and Saint George, Member of the Royal Victorian Order, Governor-General and Commander-in-Chief in and over His Majesty’s Dominion of New Zealand and its Dependencies; and issued under the Seal of the said Dominion, at the Government House at Wellington, this eleventh day of October, in the year of our Lord one thousand nine hundred and seventeen.

GOD SAVE THE KING!

Declaring Land taken for a Public Work, and not required for such Public Work, to be Crown Land.

A PROCLAMATION.

WHEREAS it is provided by section thirty of the Public Works Act, 1908, that if it is found that any land held, taken, purchased, or acquired at any time under this or any other Act or Provincial Ordinance, or otherwise howsoever, for any public work is not required for such public work the Governor-General may, by an Order in Council publicly notified and gazetted, cause the same to be sold under the conditions therein mentioned:
And whereas it is further provided by section five of the Public Works Amendment Act, 1909, that in the case of any land so taken, purchased, or acquired for a Government work and not required for that purpose the Governor-General may, on the recommendation of the Minister, and without complying with any other requirements of the aforesaid section thirty, by Proclamation declare such land to be Crown land subject to the Land Act, 1908, and thereupon the land may be administered and disposed of under that Act accordingly:
And whereas the land described in the Schedule hereto was taken for the purposes of a road: And whereas such road has been stopped, and it is desirable to declare the land contained therein to be Crown land:
And whereas a plan has been prepared, and the Minister has recommended the Governor-General to declare such land to be Crown land:
Now, therefore, in pursuance and exercise of the powers and authorities conferred upon me by the above-in-part-recited Acts, and of all other powers in anywise enabling me in this behalf, I, Arthur William de Brito Savile, Earl of Liverpool, the Governor-General of the Dominion of New Zealand, do hereby declare the land described in the Schedule hereto to be Crown land subject to the Land Act, 1908, and that such land may be administered and disposed of under that Act accordingly.

SCHEDULE.

APPROXIMATE areas of the pieces of stopped road declared to be Crown land: 2 acres 2 roods 8 perches and 19 acres 1 rood 32 perches.
Adjoining or passing through H.P.L. 130, situated in Block V, Harataunga Survey District.

In the Auckland Land District; as the same are more particularly delineated on the plan marked P.W.D. 43060, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Land District, and thereon coloured green.

Given under the hand of His Excellency the Right Honourable Arthur William de Brito Savile, Earl of Liverpool, Knight Grand Cross of the Most Distinguished Order of Saint Michael and Saint George, Member of the Royal Victorian Order, Governor-General and Commander-in-Chief in and over His Majesty’s Dominion of New Zealand and its Dependencies; and issued under the Seal of the said Dominion, at the Government House at Wellington, this twelfth day of October, in the year of our Lord one thousand nine hundred and seventeen.
