License authorizing the Otorohanga Town Board to erect Electric Lines within the Otorohanga Town District.

LIVERPOOL, Governor-General.
ORDER IN COUNCIL.
At the Government House at Wellington, this seventeenth day of September, 1917.
Present:
His Excellency The Governor-General in Council.
WHEREAS by section two of the Public Works Amendment Act, 1911, it is provided that no person shall lay, construct, place, put up, or use any electric line except under the authority of a license issued by the Governor-General in Council under that Act:
And whereas the Otorohanga Town Board (hereinafter referred to as "the licensee"), desires to erect lines within the area of supply as defined in the Schedule hereto, and hereinafter called "the area of supply," and it is expedient accordingly to issue a license in respect thereof under the said section:
Now, therefore, in pursuance and exercise of the powers conferred upon him by the said section, and of all other powers in anywise enabling him in that behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth, subject to the conditions set forth in the Schedule hereto, and to the regulations made under section two of the aforesaid Act, and published in the New Zealand Gazette dated the twenty-ninth day of April, one thousand nine hundred and fifteen, and hereinafter referred to as "the regulations," hereby authorize the licensee to erect and maintain electric lines for lighting, power, and heating purposes within the area of supply hereinafter described, such electric lines at present proposed to be erected being indicated by means of blue lines shown on the plan marked P.W.D. 42652, and deposited in the office of the Minister of Public Works at Wellington, in the Wellington Provincial District.

SCHEDULE.

  1. AREA OF SUPPLY.
    The area of supply comprises the Otorohanga Town District as at present constituted.

  2. SYSTEM OF SUPPLY.
    The system of supply shall be as described in paragraph (a) (1) of clause 2 of the regulations.
    The generated voltage shall be approximately 100 to 120 volts between the terminals.

  3. DATUM TEMPERATURE.
    For the purpose of calculating the stresses as provided in clause 12 of the regulations, the datum temperature shall be taken as 20 degrees Fahrenheit.

  4. NOTICES re EXTENSIONS, ETC.
    Records of results of tests (Regulation 37), and notices re commencement of work (Regulation 44) and re extensions and alterations (Regulation 49), should be sent to the Under-Secretary, Public Works Department, Wellington, and to the Telegraph Engineer of the district, or his deputy, at present stationed at Hamilton.

  5. CHARGES FOR ELECTRIC ENERGY.
    The charge for electrical energy shall not exceed 1s. per unit for lighting purposes, and 6d. per unit for motor-power, heating, or cooking purposes; provided that "lighting purposes" shall include the operation of motor generators for lighting purposes.

  6. DURATION OF LICENSE.
    This license shall, unless sooner determined in accordance with the provisions hereinafter expressed, continue in force for a period of forty-two years from the date hereof. Upon the expiry of the said term, or upon the sooner determination of this license by revocation or otherwise, all rights hereby granted to the licensee shall thereupon cease and determine; but such expiration or determination shall not relieve the licensee of any liability therefor incurred under this license.

Licensing George Chamberlin to use and occupy a Part of the Foreshore of Ponui Island as a Site for a Wharf.

ORDER IN COUNCIL.
At the Government House at Wellington, this seventeenth day of September, 1917.

His Excellency The Governor-General in Council.
WHEREAS by Order in Council dated the twenty-fourth day of August, one thousand nine hundred and three, and published in the New Zealand Gazette No. 67, of the twenty-seventh day of the same month, George Chamberlin, of Ponui Island (hereinafter called "the licensee"), was licensed under the Harbours Act, 1908 (hereinafter called "the said Act"), to occupy for a period of fourteen years from the twenty-fourth day of August, one thousand nine hundred and three, a part of the foreshore and land below low-water mark of Ponui Island, Hauraki Gulf, in order to construct thereon a wharf as shown on the plan marked M.D. 2650, and deposited in the office of the Marine Department, at Wellington:-
And whereas the licensee has made application for a fresh license under the said Act for a further term of fourteen years computed from the twenty-fourth day of August, one thousand nine hundred and seventeen, and it is expedient to grant the same for the term and subject to the conditions hereinafter expressed:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the power and authority vested in him by the said Act, and of all other powers and authorities enabling him in that behalf, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the purpose or object for which the said license is required by the licensee as aforesaid; and, in further pursuance and exercise of the said power and authority, and by and with the like advice and consent as aforesaid, doth hereby license and permit the licensee to use and occupy that part of the foreshore and land below low-water mark which is particularly shown and delineated on the plan so deposited as aforesaid, for the purpose of maintaining the aforesaid wharf, such license to be held and enjoyed by the licensee upon and subject to the terms and conditions set forth in the Schedule hereto.

SCHEDULE.

  1. In these conditions the term "Minister" means the Minister of Marine as defined by the Shipping and Seamen Act, 1908, and includes any officer, person, or authority acting by or under the direction of such Minister.
  2. The concessions and privileges conferred by this Order in Council shall extend and apply only to that part of the foreshore and land below low-water mark occupied by the said wharf, as shown on the plan marked M.D. 2650.
  3. In consideration of the concessions and privileges granted by this Order in Council the licensee shall, on being supplied with a copy thereof, pay to the Minister the sum of Β£2 10s., and thereafter an annual sum of Β£1 in advance, payable on the 1st day of August, dating from the 1st day of August, 1917, the first of such annual payments to be made on the licensee being supplied with a copy of this Order in Council.
  4. All persons shall, at all reasonable times, upon payment of the proper dues, have free and full liberty to use the said wharf, and all rights of ingress and egress thereon and therefrom.
  5. His Majesty or the Governor-General, and all officers in the Government service acting in the execution of their duty, shall at all times have free ingress, passage, and egress into, through, and out of the said wharf without payment.
  6. The licensee shall maintain the above-mentioned wharf in good order and repair, and shall at all times exhibit therefrom and maintain at his own cost suitable and necessary lights for the guidance of vessels; provided that no light shall be exhibited until after it has been approved of by the Minister.
  7. Any person authorized by the Minister may at all reasonable times enter upon the said wharf and view the state of repair thereof; and upon such Minister leaving at or posting to the last known address of the licensee a notice in writing of any defect or want of repair in such wharf, requiring him, within a reasonable time, to be therein prescribed, to repair the same, he shall with all convenient speed cause such defect to be removed or such repairs to be made.
  8. Nothing herein contained shall authorize the licensee to do or cause to be done anything repugnant to or inconsistent with any law relating to the Customs, or any regulation-
