any case where the local authority having control of any road or street by resolution declares that the provisions thereof shall not apply to any specified road or street, or any specified part thereof, and such resolution is approved by the Governor in Council :

And whereas by subsection two of section one hundred and seventeen of the Public Works Act, 1908, and clause (b) of subsection one of section thirteen of the Public Works Amendment Act, 1911, it is provided that such approval may be either absolute or subject to such conditions as the Governor in Council thinks fit to impose, and may refer to one or both sides of the road or street :

And whereas the Wairarapa South County Council, the local authority having control of the portions of roads described in the Schedule hereto (hereinafter referred to as “the said roads”), has passed the following resolution—viz., “That, pursuant to section one hundred and seventeen of the Public Works Act, 1908, this Council declares that the provisions of subsection one of section one hundred and seventeen of the Public Works Act, 1908, shall not apply to the whole of the roads in or adjoining the Carter Estate, as delineated in the Public Works Department Plan No. 40593, as are less than one chain in width ; and that this Council is satisfied with the existing width of the roads specified (that is to say, thirty-three feet), provided that it is agreed that no new building or new plantation is erected within thirty-three feet of the centre-line of the said roads” :

And whereas the owner of the land has agreed to the building-line condition :

And whereas it is deemed expedient that such resolution should be approved in so far as it refers to such side of the said roads as adjoins Carter’s Estate, subject to the condition hereinafter mentioned :

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the powers conferred by the above-in-part-recited Acts, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the said resolution to the extent hereinbefore mentioned, subject to the condition that no new buildings or part of a building shall be erected at any time on Carter’s Estate within a distance of thirty-three feet of the centre-line of the said roads.

SCHEDULE.

Those portions of roads (five), coloured burnt sienna, adjoining the whole or portions of the north-western boundaries of Lots 1 and 17; 8; 18, 7, and 19; 14 and 9; 15; Carter’s Estate.

Also those portions of roads (two), coloured burnt sienna, adjoining the north-eastern boundaries of Lots 2; and 3; Carter’s Estate.

Also that portion of road, coloured burnt sienna, adjoining the south-western boundary of Lot 1, Carter’s Estate.

Also those portion of roads (four), coloured burnt sienna, adjoining the south-eastern boundaries of Lots 1; 8; and 4; Carter’s Estate.

As the said portions of roads are more particularly delineated on the plan marked P.W.D. 40593, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Provincial District, and thereon coloured as above mentioned.

Portions of Roads through the Carter’s Estate, Carterton, exempted from the Provisions of Section 117 of the Public Works Act, 1908, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.

At the Government House at Wellington, this twenty-first day of August, 1916.

Present :

His Excellency the Governor in Council.

WHEREAS by subsection one of section one hundred and seventeen of the Public Works Act, 1908, it is, inter alia, provided that the said section shall not apply in any case where the local authority having control of any road or street by resolution declares that the provisions thereof shall not apply to any specified road or street, or any specified part thereof, and such resolution is approved by the Governor in Council :

And whereas by subsection two of section one hundred and seventeen of the Public Works Act, 1908, it is provided that such approval may be either absolute or subject to such conditions with respect to the building-line as the Governor, by Order in Council, thinks fit to impose :

And whereas the Wairarapa South County Council, the local authority having control of the roads described in the Schedule hereto, did, on the twenty-ninth day of July, one thousand nine hundred and sixteen, pass the following resolution—viz., “That, pursuant to section one hundred and seventeen of the Public Works Act, 1908, this Council declares that the provisions of subsection one of section one hundred and seventeen of the Public Works Act, 1908, shall not apply to the whole of the roads in or adjoining the Carter Estate, as delineated in the Public Works Department Plan No. 40593, as are less than one chain in width ; and that this Council is satisfied with the existing width of the roads specified (that is to say, thirty-three feet), provided that it is agreed that no new building or new plantation is erected within thirty-three feet of the centre-line of the said roads.”

Also those roads, coloured red, situated between Lots 1, 17, 2, and 8; 2, 8, and 3; 8, 3, and 4, 5, 6, 18; 5, 6, 7, and 14, 15; 10, 11; 18, 6, 15, and 7, 14; Carter’s Estate.

As the said roads are more particularly delineated on the plan marked P.W.D. 40593, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Provincial District, and thereon coloured as above mentioned.

Reserve in the Tarawera Survey District brought under the Tourist and Health Resorts Control Act, 1908.

ORDER IN COUNCIL.

At the Government House at Wellington, this twenty-first day of August, 1916.

Present :

His Excellency the Governor in Council.

BY virtue of the powers and authorities conferred upon me by the sixth section of the Tourist and Health Resorts Control Act, 1908, I, Arthur William de Brito Savile, Earl of Liverpool, the Governor of the Dominion of New Zealand, by and with the advice and consent of the Executive Council of the said Dominion, do hereby order and declare that the reserve for landing purposes in the Tarawera Survey District, Auckland Land District, described in the Schedule hereto shall be and the same is hereby brought under the operation of and declared to be subject to the provisions of the Tourist and Health Resorts Control Act, 1908 ; and such reserve shall hereafter be managed, administered, and dealt with in manner directed by the said Act.

SCHEDULE.

All that area in the Auckland Land District, containing 7 acres 0 roods 15 perches, more or less, being Section 4, Block VII, Tarawera Survey District. Bounded towards the north generally by Wairoa Stream; towards the east by Run 78, 130 links; towards the south generally by aforesaid Run 78, 1103·3 links; and towards the west and south by the eastern and northern boundaries of the Rotomahana-Parekarangi Block No. 6J 2B, 504·4 links and 1377·5 links respectively, to the aforesaid Wairoa Stream: be all the aforesaid linkages more or less. (Auckland Plan 13500.)
