LIVERPOOL, Governor.
ORDER IN COUNCIL.
At the Government House at Wellington, this twenty-fourth day of July, 1916.
Present :
HIS EXCELLENCY THE GOVERNOR IN COUNCIL.
WHEREAS by an Order in Council dated the thirty-first day of March, one thousand nine hundred and fifteen, and published in the New Zealand Gazette of the eighth day of April, one thousand nine hundred and fifteen, certain powers of a Drainage Board have been conferred on the Otonomomo River Board :
And whereas the said River Board lately proposed to raise a loan of seven hundred pounds, under the Local Bodies’ Loans Act, 1913, for the purpose of draining lands in a certain defined portion of the river district :
And whereas the public notices of the special order authorizing the raising of the above loan, although four were issued, were not given once in each of the four weeks immediately preceding the day on which the special order was confirmed, inasmuch as no public notice was given in the first of the four weeks, as required by section three of the Land Drainage Amendment Act, 1908 :
And whereas it appears that the ratepayers have not been misled by such irregularity, and it is expedient to validate the said proceedings :
Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and in exercise of the powers and authorities conferred on him by section one hundred and eleven of the Local Bodies’ Loans Act, 1913, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby validate the said proceedings; and doth hereby order and declare that the said public notifications of the special order authorizing the loan shall be valid to all intents and purposes as though the same had been published in the proper manner, and that the proceedings in connection with the said loan shall not be called into question by reason only of the irregularity aforesaid.
