(3.) If the occupier fails or neglects to duly comply with such notice he commits an offence under these regulations, and the Inspector may enter upon the said land and do the necessary work at the expense in all things of the occupier. But nothing herein shall relieve the occupier from any penalty he may have incurred or become liable to by reason of his default, failure, or neglect.

(4.) The amount of expenses incurred by the Inspector under this regulation shall be recoverable from the occupier by the Inspector by action in the High Court of the Cook Islands.

  1. In the case of land the title to which has not been individualized and partitioned, the Resident Commissioner shall cause the land to be cleared as provided by clause 5 hereof if the occupier fails or neglects so to do to the satisfaction of an Inspector; and the Resident Commissioner may register in the Native Land Court of the Cook Islands a memorandum under his hand setting forth the amount paid by him for the clearing of such land, and such memorandum shall operate as a charge against the said land, and thereafter no alienation thereof, whether by way of sale, lease, mortgage, or otherwise, shall have any validity unless and until such charge is satisfied.

  2. All lands included in any public reserve shall from time to time be cleared under the authority of the Resident Commissioner.

  3. Every person who commits an offence against these regulations shall be liable to a penalty of £5.

  4. Every person commits an offence who obstructs or hinders any Inspector or any other person in the exercise of any power or function conferred on him by these regulations.

  5. All fines recovered under these regulations shall be paid into the Cook Islands Treasury.

Borage (Borage officinalis).
Burdock (Arctium).
Burr, Australian (Acaena ovina).
Burr, Bathurst (Xanthium spinosum).
Burr, Noogoora (Xanthium strumarium).
California stinkweed (Gillia squarrosea).
Caper spurge (Euphorbia lathgris).
Dock (Rumex, any species).
Dodder (Cuscaha epithymium).
Fennel (Foeniculum vulgare).
Foxglove (Digitalis purpurea).
Giant burdock (Arctium lappa).
Gorse (Ulex europaeus).

Thistle (any species).
