Amending Order-in Council fixing Dues for the Use of the Akaroa Wharf.
LIVERPOOL, Governor.
ORDER IN COUNCIL.
At the Government Buildings at Wellington, this twenty-seventh day of April, 1916.
Present:
THE RIGHT HONOURABLE W. F. MASSEY, P.C., PRESIDING IN COUNCIL.
WHEREAS by Order in Council dated the fifteenth day of December, one thousand nine hundred and thirteen, and published in the New Zealand Gazette No. 91, of the eighteenth day of the same month, the dues and rates specified in the Second Schedule thereto were prescribed for the use of the Akaroa Wharf:
And whereas it is desirable that certain of the dues prescribed in the said Order in Council should be altered:
Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the power and authority conferred upon him by subsection two of section thirteen of the Harbours Act, 1908, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby revoke the following charges prescribed by the hereinbefore-recited Order in Council of the fifteenth day of December, one thousand nine hundred and thirteen, namely:—

Calves, under one year old; sheep, lambs, goats, and pigs; per score (20) .. .. .. 3 4
and doth hereby substitute the following charges in lieu thereof:—

Cancelling Portion of the License authorizing the Invercargill Borough Council to erect Electric Lines within the Borough of Invercargill, Portion of the Borough of South Invercargill, and Portion of the Southland County.

WHEREAS by a license dated the seventh day of June, one thousand nine hundred and thirteen, and issued under section two of the Public Works Amendment Act, 1911 (and hereinafter referred to as “the said license”), the Invercargill Borough Council was authorized to erect electric lines within the Borough of Invercargill, portion of the Borough of South Invercargill, and portion of the Southland County:
And whereas the South Invercargill Borough Council has made application to have cancelled that portion of the said license which refers to the Borough of South Invercargill, and the Invercargill Borough Council has no objection thereto:
Now, therefore, in pursuance and exercise of the powers conferred upon him by the said section, and of all other powers in anywise enabling him in that behalf, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby cancel and annul so much of the said license as refers to the Borough of Invercargill South.

Closing Makaraka Cemetery, County of Cook.

ORDER IN COUNCIL.
At the Government Buildings at Wellington, this twenty-seventh day of April, 1916.

THE RIGHT HONOURABLE W. F. MASSEY, P.C., PRESIDING IN COUNCIL.
WHEREAS it appears to the Governor that burials in the Makaraka Cemetery, in the County of Cook, which said cemetery is described in the Schedule hereto, should be wholly discontinued: And whereas a sufficient cemetery not within the limits of any borough or town district has been provided, and has been prepared for the interment of the dead, as required by the Cemeteries Act, 1908:
Now, therefore, His Excellency the Governor, acting by and with the advice and consent of the Executive Council of the Dominion of New Zealand, and in pursuance of the authorities vested in him by the said Cemeteries Act, 1908, doth hereby order and direct that, from and after the first day of November, one thousand nine hundred and sixteen, the Makaraka Cemetery, in the County of Cook, described in the aforesaid Schedule, shall be closed and burials therein discontinued; and, further, that the said cemetery shall, from and after the said first day of November, one thousand nine hundred and sixteen, be vested in the Chairman, Councillors, and Inhabitants of the Cook County, under the provisions and for the purposes of the seventy-eighth section of the said Cemeteries Act, 1908.
SCHEDULE.
MAKARAKA CEMETERY.
ALL that area in the Hawke’s Bay Land District, containing by admeasurement 10 acres 3 roods, more or less, being Section 5, Block II, Turanganui Survey District. Bounded towards the north by the Taruheru River; towards the east by the Matawhero B or 5 Block, 835·6 links; towards the south by a public road, 68·3, 50·1, and 982·5 links; and towards the west by a domain reserve, 1079·9 links: be all the aforesaid linkages more or less. As the same is delineated on the plan marked L. and S. 2/27, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon bordered red.

Consenting to stopping a Road in Block XI, Newcastle Survey District, Newcastle Road District, Waipa County.

ORDER IN COUNCIL.
At the Government Buildings at Wellington, this twenty-seventh day of April, 1916.
Present:
THE RIGHT HONOURABLE W. F. MASSEY, P.C., PRESIDING IN COUNCIL.
WHEREAS by section one hundred and thirty-three (a) of the Public Works Act, 1908, it is enacted that a local authority shall not declare any county road or district road to be stopped until the consent thereto of the Governor, by Order in Council gazetted, is obtained:
And whereas the Newcastle Road Board has applied for such consent in respect of the road described in the Schedule hereto:
Now, therefore, in pursuance and exercise of the above-in-part-recited Act, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby consent to the Newcastle Road Board stopping the road described in the Schedule hereto.
SCHEDULE.
APPROXIMATE area of the piece of road permitted to be stopped: 1 acre 2 roods 7·7 perches.
Adjoining or passing through Section 155, Horotiu Parish (S.O. 17783), Block XI, Newcastle Survey District.
In the Auckland Land District; as the same is more particularly delineated on the plan marked P.W.D. 37705, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Provincial District, and thereon coloured green.
