Avarua (Island of Rarotonga) The area enclosed by a line extending from high-water mark at a point 400 yards eastward of the Union Steam Ship Company's wharf at Avarua Harbour, in the Island of Rarotonga; extending thence northward 1,000 yards, thence westward 800 yards, thence southward to high-water mark, thence along high-water mark eastward to the starting-point; together with land lying immediately south and within 400 yards of such area.
Alofi (Island of Niue) All such portion of sea and land comprised within a circle with a radius of one mile from the foot of the Mission Pier at Alofi, in the Island of Niue.

Appointing Members of Assessment Courts under the Valuation of Land Act, 1908.

At the Government House at Wellington, this seventeenth day of April, 1916.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

IN pursuance and exercise of the power and authority vested in him by the Valuation of Land Act, 1908, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby appoint the persons mentioned in the Schedule hereto to be members of the Assessment Court for the special district set opposite their names.

Hull, Francis: Point Chevalier and Mount Wellington Road Districts of Eden County; Mount Eden Borough; Ellerslie Town District.
Lane, John E.: Counties of Waipawa, Dannevirke, Waipukurau, and Borough of Hastings.

Approving the Term of the License granted to the Kauri Timber Company (Limited) by the Thames County Council for a Tramway along the Road Reserve adjoining the Waiwhakaurunga Stream in Blocks III and VI, Thames Survey District.

ORDER IN COUNCIL.
At the Government House at Wellington, this seventeenth day of April, 1916.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS it is provided by section sixteen of the Tramways Act, 1908, as amended by section six of the Tramways Amendment Act, 1911, that any local authority may from time to time, on the application of any person in that behalf, grant a license to such person to lay down, construct, and maintain a private tramway on, along, or across any street or road under its control, subject to such terms and conditions as such local authority approves, provided that such tramway shall be used only in connection with and for the purposes of the business of such person, and that such business shall not be the carriage of passengers or goods for hire:

And whereas it is provided by section ten of the Tramways Amendment Act, 1910, that the license may be for such term not exceeding twenty-one years as the Governor in Council approves:

And whereas the Kauri Timber Company (Limited), a company duly incorporated in the State of Victoria in the Commonwealth of Australia, having its registered office therein in the City of Melbourne, and carrying on in New Zealand and elsewhere the business of a timber-merchant, has made application to the Thames County Council for a license to lay down, construct, and maintain a private tramway along the road reserve adjoining the Waiwhakaurunga Stream, in Blocks III and VI, Thames Survey District, shown coloured burnt sienna on the plan marked P.W.D. 39739, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Provincial District:

And whereas the said Council has granted such license for a term of fourteen years from the first day of March, one thousand nine hundred and fifteen:

And whereas such tramway is to be used by the said company in connection with and for the purposes of its business as a timber-merchant, and such business is not the carriage of passengers or goods for hire:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the power and authority conferred on him as aforesaid, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the aforesaid term.

Consenting to the Raising of a Loan by the Council of the Borough of Gisborne.

LIVERPOOL, Governor.
ORDER IN COUNCIL.
At the Government House at Wellington, this seventeenth day of April, 1916.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by section twenty-six, subsection one, of the Appropriation Act, 1915, it is provided that, notwithstanding any Act to the contrary, it shall not be lawful or competent for any local authority or for any Harbour Board, during the present war with Germany, to borrow or contract to borrow any money (otherwise than by way of bank overdraft within the limit of its powers, if any, in that behalf) whether from the State Advances Office or from any other source whatever, and whether in pursuance of a special Act or under any other authority whatever, without the precedent consent of the Governor in Council:

And whereas application has been made for the consent of the Governor in Council to enable the Gisborne Borough Council to raise a loan of two thousand five hundred pounds for the Derby Street Bridge:

And whereas it is expedient that the precedent consent of the Governor in Council should issue:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby consent to the borrowing of the said loan by the Gisborne Borough Council; provided that the rate of interest at which the loan is to be raised shall not exceed five and one-quarter per centum per annum; and it is hereby declared that this Order in Council is made under the provisions in that behalf of the Appropriation Act, 1915, and shall operate accordingly as a consent of the Governor in Council to the raising of the loan hereby authorized.
