Validating Proceedings in connection with a Loan of £8,434
proposed to be raised by the Council of the Borough of
Taumarunui.

ORDER IN COUNCIL.

At the Government House at Wellington, this ninth day of
October, 1916.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS the Taumarunui Borough Council lately
proposed to raise a loan of eight thousand four
hundred and thirty-four pounds for the extension of the
sewerage system to certain streets, under the Local Bodies’
Loans Act, 1913 :

And whereas irregularities or defects occurred both in the
notice published in pursuance of section nine of the said Act
and in the voting-paper used at the poll upon the said pro-
posal, in that though the proposed security for such loan
and the provision for repayment thereof were stated to be
an annual-recurring rate on the unimproved value of all the
rateable property within the special-rating district, the
amount of such rate (namely, one and one-ninth of a penny
in the pound on the rateable value, on the basis of the un-
improved value, of all rateable property within the said
rating area) was not set forth in such notice and voting-paper :

And whereas the first publication of the date of the poll
was not given not less than fourteen days before the date of
the poll of ratepayers, as required by the provisions of sec-
tion ten, subsection two, of the above-named Act :

And whereas six days intervened between the last publica-
tion of the notice of intention to raise the loan prescribed by
section nine of the said Act and the date on which the above
poll of ratepayers was taken, instead of a period of not less
than one week, as required by section ten, subsection two, of
the above-mentioned Act :

And whereas it appears that the ratepayers have not been
misled by such irregularities or defects, and it is expedient
to validate the same :

Now, therefore, His Excellency the Governor of the Do-
minion of New Zealand, in pursuance and exercise of the
powers and authorities conferred on him by section one
hundred and eleven of the Local Bodies’ Loans Act, 1913,
and acting by and with the advice and consent of the Execu-
tive Council of the said Dominion, doth hereby declare that
the proceedings in connection with the said loan shall be
valid to all intents and purposes as though the said amount
of such rate had been stated in the said notice and voting-
paper, and as though the requirements of section ten of the
said Act had been strictly complied with, and that the said
proceedings shall not be called in question by reason only of
the irregularities or defects aforesaid.

Validating Public Notifications of the Special Order authorizing
the Raising of a Loan of £400 proposed to be raised by the
Council of the County of Franklin.

ORDER IN COUNCIL.

At the Government House at Wellington, this ninth day of
October, 1916.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS the Franklin County Council lately proposed
to raise a loan of four hundred pounds, under the
Local Bodies’ Loans Act, 1913, for the purpose of constructing
Brown’s Road (Tuakau) :

And whereas the public notices of the special order autho-
rizing the raising of the above loan, although four publications
were made, were not given once in each of the four weeks
immediately preceding the day of which the special order
was confirmed, inasmuch as no public notice was given in

the fourth week as required by section ninety-seven of the
Counties Act, 1908 :

And whereas it appears that the ratepayers have not been
misled by such irregularity, and it is expedient to validate
the said proceedings :

Now, therefore, His Excellency the Governor of the Do-
minion of New Zealand, in pursuance and in exercise of the
powers and authorities conferred on him by section one
hundred and eleven of the Local Bodies’ Loans Act, 1913,
and acting by and with the advice and consent of the Execu-
tive Council of the said Dominion, doth hereby validate the
said proceedings; and doth hereby order and declare that
the said public notifications of the special order authorizing
the loan shall be valid to all intents and purposes as though
the same had been published in the proper manner, and that
the proceedings in connection with the said loan shall not be
called into question by reason only of the irregularity afore-
said.

Validating Proceedings in connection with a Loan of £1,000
proposed to be raised by the Council of the County of
Manawatu.

ORDER IN COUNCIL.

At the Government House at Wellington, this ninth day of
October, 1916.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS the Manawatu County Council lately pro-
posed to raise a loan of one thousand pounds, under
the Local Bodies’ Loans Act, 1913, for the purpose of con-
structing Lake Road :

And whereas the special roll of the ratepayers interested,
although prepared, completed, and deposited for public
inspection, was not so deposited before any steps were taken
to raise the loan, as required by section seventeen of the
above-mentioned Act :

And whereas it appears that the said ratepayers have not
been misled by such irregularity or defect, and it is expedient
to validate the aforesaid proceedings :

Now, therefore, His Excellency the Governor of the Do-
minion of New Zealand, in pursuance and exercise of the
powers conferred by section one hundred and eleven of the
Local Bodies’ Loans Act, 1913, and acting by and with the
advice and consent of the Executive Council of the said
Dominion, doth validate the proceedings taken to raise the
above loan; and doth hereby declare that the said pro-
ceedings shall be valid to all intents and purposes as though
the same had been carried out in the proper manner, and that
the proceedings in connection with the said loan shall not
be called in question by reason only of the irregularity
aforesaid.

The Permanent Building Society of Nelson.—Under the Trustee
Amendment Act, 1914.


LIVERPOOL, Governor.
ORDER IN COUNCIL.

At the Government House at Wellington, this ninth day of
October, 1916.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS it is deemed expedient to approve the
Permanent Building Society of Nelson as an institu-
tion for the purposes of section three of the Trustee Amend-
ment Act, 1914 :

Now, therefore, His Excellency the Governor of the
Dominion of New Zealand, in pursuance and exercise of the
power and authority conferred upon him by the said Act,
and acting by and with the advice and consent of the Execu-
tive Council of the said Dominion, doth hereby approve the
said Permanent Building Society of Nelson as an institution
with which, subject to the provisions of the said Act, it shall
be lawful for a trustee, unless expressly forbidden by the
instrument (if any) creating the trust, to invest any trust
funds in his hands on deposit at interest.
